The object of the contract is designand the execution of the works for the construction of the Highway Brasov - Targu Mures - Cluj - Oradea, Section 3B: Mihaiesti - Suplacu de Barcau, Subsection 3B5: Nusfalau - Suplacu de Barcau (km 66 500 km 80 054.044), according to the works contract.

Ob ctr-project and execution for Autostr BV-Tg Mures-CJ-Oradea, Sect3B: Mihaiesti-Suplacu de Barcau, Subsect3B5: Nusfalau-Suplacu de Barcau = 13, 554 km. Subsection 3B5 starts at km 66 500. At km 67 740, where the highway intersects DN1H deviate, was the Nusfalau road node. Also, the bidder ranked first after applying the award criterion, prior to awarding the contract, willpresent, at the request of the Contracting Authority, the following editorial documents proving / confirming non-compliance with the situations stipulated in art. 165 above, both for the Single Offeror / Associated Offeror and for the Supported Subcontractor / Tertiary stated in the tender: A. Romanian legal persons must submit: - a certificate of fiscal attestation regarding the fulfillment of the obligationof paying taxes, taxes or contributions to the consolidated general government, which would reveal the lack of overdue debts at the moment of its presentation. B. Foreign legal persons shall present any editorial documents issued by the authorized institutions of the country of origin (tax attestation, criminal records, other equivalent documents, etc.)proves that they have fulfilled their obligations to pay taxes, duties or contributions to the consolidated general budget in accordance with the national law of the country of residence of the sole Tenderer / Tenderer / Subcontractor / Tenderer or the country in which the sole Tender / The Associate Bidder / Subcontractor / Supporter is established. The bidder must demonstrate that the total annual turnover was min. 130, 000, 000 Lei in each of the exercises2015 and 2017.

1. The present public procurement procedure is initiated under the following conditions: - The conclusion of the public procurement contract is conditioned by obtaining / approving the financing of the works from the funds from the state budget and / or European funds non-refundable, the signing of the contract being possible only if the provision is observedissues relating to the commitment of expenditure under the budgets under the public finance legislation. In the event that, for any reason, obtaining / approval of the financing of works from funds from the state budget and / or European non-reimbursable funds is not realized, the Contracting Authority shall apply the provisions of art. 212 alin (1) lit. c) second sentence of Law 98/2016, making it impossible to conclude the public procurement contract. The Contracting Authority estimates that it will obtain the financing required to sign the contract in the second semester of 2019.

2. The deadlines specified in the Payment Contract are justified by the complexity of the road infrastructure project (major interest projects), as well as by the financial circuits of the funds that implyas several state institutions.

3. The duration of the contract is 84 months and includes: 6 months the design period, 18 months the execution period of the works and 60 months the warranty period of the works. The duration of the works contract may vary depending on the warranty period offered by the designated economic operator. In order to complete the DUAE, bidders will use thethe editable copy provided by the Contracting Authority in SEAP, in accordance with the model published by ANAP by the Notification of 01.09.2016. 6. A person who considers himself / herself injured by an act of the contracting authority may refer the matter to the Council for the annulment of the act of the Contracting Authority, its obligation to issue an act orthe adoption of remedial measures, as well as the recognition of the claimed right or of the legitimate interest, within 10 days, according to the provisions of art. 8 par. (1) lit. a) of Law 101/2016. For the judicial settlement, the person who considers himself / herself injured can appeal to the competent court, according to the provisions of art. 49 of Law 101/2016. To solve your accountof the formulated in the conditions of art. 8 or art. 49 of Law 101/2016, under the sanction of its rejection, the person who considers himself / herself injured should be a precaution in advance under the conditions provided by art. 61 index 1 of Law 101 / 2016.
