Requirement 1:
The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 177, 178, 180 of Law no. 99 / 2016.
The manner by which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with the informationof their situation. The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting entity, only by the tenderer placed on the first place in the intermediate rankings drawn up at the completion of the evaluation of the tenders.
These documents may be:
1) outstanding debts with regard to payment im(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or the members of the administrative, management or supervisory body of the economic operator those who have power of representation, decision-making or control within it, as evidenced by the certificate(3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Public Procurement Act 99/2016; 4) other editorial documents, as the case may be.

Requirement 1:
The economic operators submitting the tender must prove the form of registration under the law of the country of residence, that the economic operator is legally constituted, that it is notin any of the situations of cancellation of the establishment and the fact that it has the professional capacity to carry out the activities that are the subject of the contract.
Mode of accomplishment:
The DUAE will be completed according to art. 202 204 of Law no. 99/2016 and according to ANAP Notification no. 240/2016, with the supporting document, namely ONRC or, for foreign tenderers, -the equivalent document issued in the country of residence shall be presented at the request of the contracting entity only by the tenderer ranked first in the intermediate rankings at the end of the evaluation of the tenders.
The average annual turnover for the last three years (2015, 2016, 2017) be less than RON 450, 000, 000 or the equivalent in another currency (calculated at the average annual exchange rateof the currency / RON set by the NBR for the last three years, respectively 2017, 2016 and 2015, published on the website www.bnr.ro).
If the tenderer demonstrates his economic and financial situation by invoking the support given by another person, then he / she has the obligation to prove his / her support, by presenting a firm commitment of the person, through whichconfirms that it will make available to the economic operator the financial resources invoked. Information on the supporting party (if any) will be provided. The supporting third party shall submit a declaration of non-compliance under Art. 73 Law no. 99/2016 and in the situations stipulated in art. 177 of Law no. 99/2016, art. 178 of Law 99/2016 and art. 180 of Law no. 99/2016 and related informationyou art. 188 of the Law no. 99 / 2016.

It will also be handed over together with the formand a copy of the identity card (IC or passport) of the person. nominated in the Annex. Only nominees can participate in the visit. in the above mentioned request. The costs occasioned by the (transport, accommodation, etc.) for the person. who want to be partial. from op. ec. will be borne by them.
Confom art. 145 par. (3) of H.G. 394/2016: If twoor several bids are ranked first, with equal scores, the tie will be made taking into account the score obtained by the rating factors in descending order of their weight. Where equality is maintained, the contracting entity will request new financial proposals and the winning bid will be the one with the lowest financial proposal.
