4.1. Przedmiot niniejszego zamowienia is:

Main Site: Złocieniec

4.1. The subject of this contract is:

"Modernization of the sewage treatment plant in Złocieniec Wodnik sedimentary part" in accordance with "Contractual conditions for the construction of civil engineering works designed by the Employer (FIDIC 1999, first edition 1999)". The text in Polish is obligatory,

4.1.1. Sedimentary part containing the construction of the following facilitiesin:

- construction of building D with two-stage sludge processing,

- construction of a shed with a hummock of sludge transported at No. 5,

- construction of a lime silo ob. No. 23,

- construction of catalytic filters ob. No. 20,

- construction of pumping sludge pumping stations with a dropped-in sludge discharge chamber (object No. 26),

- pedestrian pathways at building D,

- technological pipeline connecting ob. No. 26 with building D or in a variant offer withsludge processing building,

- electrical and I&C installations related to the mentioned facilities

4.2. Description of the subject and scope of the contract is included in Annex 1 to the contract. Description of the subject of the order. Assessment of the fulfillment of the above condition will be based on the statement provided by the Contractor, referred to in point 8.1 SIWZ.

The Contractor will meet the condition of participation in the proceedings regarding the economic or financial situation, if he shows that:

1. achieved annual turnover understood as net sales revenue in each of the last 2 financial years, and if the period of activity was shorter, then in this period, not less than 4, 000, 000.00 PLN in each financial year to confirm the economic situation

and

in each ofthe last 2 financial years, and if the business period is shorter in that period, they have achieved the following values of the following indicators:

1) positive net sales profitability (net result) / (net sales revenue),

2) financial liquidity being the ratio of current assets to current liabilities (current assets) / (short-term liabilities, passive settlements, foldterm) not less than 1.10,

3) long-term debt ratio being the ratio (long-term liabilities) / (equity) not greater than 0.60;

2. has financial resources or creditworthiness to perform the order in the amount of at least PLN 1, 000, 000.00 to confirm the financial situation;

3. has insurance against civil liability in the scope of the insuranceactivities in the amount of at least PLN 1, 000, 000.00 to confirm the economic situation.

To confirm compliance with the condition, the Contractor must include an appropriate statement.

In Part IV, Section B of the Single European Order Document (EAT) completed in accordance with the instructions in Annex 5 to ToR see section 8.1 of the ToR.

1. List of statements made by the Contractor along with the offerthis in order to pre-confirm that it is not subject to exclusion and meets the conditions for participation in the proceedings:

1) a single European order document (hereinafter referred to as EAT) according to annexes 3 to the ToR,

2) EAT for other entities referred to in item 8.26; 8.27; 9.1 of SETC.

2. List of statements and documents submitted by Contractors at the request of the Employer in order to demonstrate the lack of grounds for exclteaching:

1) The Contractor submits:

a) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13, 14 and 21 of the PPL Act issued not earlier than 6 months before the deadline for submitting bids or applications for admission to proceedings,

b) a certificate of the competent head of the Tax Office pursuant to - 5 point 2 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126),

c)ZUS or KRUS certificates according to - 5 point 3 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126),

d) excerpt from the relevant register according to - 5 point 4 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126),

e) statements of the Contractor according to - 5 point 5 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 112),

f) statements of the Contractor according to - 5 point 6 of the Regulation of the MinDevelopment Istra from 26.7. 2016 (Journal of Laws of 2016 item 112),

g) statements of the Contractor pursuant to - 5 point 9 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 112),

2) foreign entities submit documents according to - 7 and - 8 of the Regulation of the Minister of Development of 26.7.2016 (Journal of Laws 2016 item 1126),

3. To confirm compliance with the conditions, the Employer requests:

a) financial statements for a period not exceedingthan the last 2 financial years according to - 2 item 2 point 1 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126),

b) information from the bank according to - 2 para. 2 point 3 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 112),

c) information that, the Contractor is insured against civil liability pursuant to - 2 para. 2 point 4 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126),

d) list of construction worksaccording to - 2 par. 4 point 1 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126),

e) list of persons according to - 2 para. 4 point 10 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 112),

4. Within 3 days of placing the announcement on the website, information about the opening bidder, the Contractor shall provide the Employer with a declaration of belonging or non-belonging to thesej of the capital group itself referred to in art. 24 paragraph 1 point 23 of the PPL Act. Together with the submitted declaration, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure.

5. In the case of joint application for the contract, each Contractor submits the documents and statements listed in - 5 item 1 6, item 9 and item 10 of the Ordinanceof the Minister of Development of July 26, 2016 (Journal of Laws of 2016, item 1126).

Other documents regarding the fulfillment of conditions in the Contractor`s proceedings are submitted in the scope in which each of them indicates fulfillment of the condition in the proceedings.

6. The Contractor who refers to the resources of other entities in order to demonstrate the lack of grounds for exclusion submits the documents and statements of these entities listed in - 5 point 16 and point 9 of the Regulation of the Minister of Development of 26.7. 2016 (Journal of Laws 2016 item 1126), and other documents regarding the fulfillment of conditions to the extent that their resources are referred to. The contractor together with the documents makes a commitment of these entities to make available to him the resources necessary for the implementation of the contract.

7. The contractor submits the offer via the Form to submit, diany, withdraw the offer available on ePUAP and make available. also on the miniPortal.

8. The Awarding Entity does not allow partial tenders.
