Modernizacja oczyszczalni ściekow w Złocieńcu Wodnik (część ściekowa)

4.1. Przedmiot niniejszego zaof the speech is: "Modernization of the sewage treatment plant in Złocieniec Wodnik, sewage part" in accordance with "Contractual conditions for the construction of civil engineering works designed by the Employer (FIDIC 1999, first edition 1999)". The text in Polish is obligatory, sewage part containing modernization and construction of the following facilities: (specified in SIWZ point 4.1).

4.1. Ninety itemof the order is: "Modernization of the sewage treatment plant in Złocieniec Wodnik, sewage part" in accordance with "Contractual conditions for the construction of civil engineering works designed by the Employer (FIDIC 1999, first edition 1999)". Obligatory text in Polish, sewage part containing modernization and construction of the following facilities:

- extension of the mechanical building of the treatment planta sewage building A,

- construction of pre-treated sewage pumping station No. 21,

- extension of the technical building bud F,

- measuring wells ob. No. 34,

- expansion chamber, overflow chamber, measuring trough renovation works,

- renovation works of the preliminary settling tank ob. No. 13,

- construction of the predenitrification chamber ob. No. 36,

- modernization of the biological reactor 0b. No. 14,

- modernization of blower station ob. No. 7,

- modernization of the coagulant dosing station ob. No. 8,

- repair of the secondary settling tank ob. No. 17,

- construction of a technological tank for purified water buffer ob. No. 33,

- construction of recirculating pumping station ob. No. 37,

- renovation of the retention tank ob. No. 16,

- modernization of the emergency sludge pumping station OBF ob. No. 19,

bodowa of the sludge thickener ob. No. 27,

- modernization of the current station No. 11,

- technological pipelines servicing the above-mentioned facilities,

- electrical and I&C installations regarding the said facilities,

- pedestrian route at the building A,

- elements of the sewage treatment plant (fences and gates).

The Employer resigned from the implementation of the following designed elements of the sewage treatment plant:

- water supply networks,

- sanitary sewage system,

- construction of lighting frominternal,

- renovation of the current separation chamber No. 35,

- concentrated sludge pumping station together with a sludge discharge chamber supplied from No. 26 because this element is a component of the sludge treatment plant,

- catalytic filters at the pre-treated sewage pumping station No. 20.

4.2. A description of the subject and scope of the contract is included in Annex 1 to the contract, a description of the subject of the contractspecific conditions in this respect. Assessment of the fulfillment of the above condition will be based on the statement provided by the Contractor, referred to in point 8.1 of the ToR (EAT). achieved annual turnover understood as net sales revenue in each of the last 2 yearsfinancial period, and if the period of activity was shorter, then in this period, not less than PLN 11, 000, 000.00 in each financial year to confirm the economic situation and in each of the last 2 financial years, and if the period of business activity is shorter in this period achieved the following values of the above indicators:

1) positive net sales profitability (net result) / (withnet sales revenues),

2) financial liquidity being the ratio of current assets to current liabilities (current assets) / (short-term liabilities, short-term passive settlements) not less than 1.10,

3) long-term debt ratio being the ratio (long-term liabilities) / (equity) not more than 0.60;

2. has financial resources or credit standingthe order to be carried out in the amount of at least PLN 1, 500, 000.00 to confirm the financial situation;

3. has a third party liability insurance in the scope of conducted activity in the amount of at least PLN 5, 000, 000.00 to confirm the economic situation.

In order to confirm the fulfillment of the condition, the Contractor must include the appropriate statement in part IV section B EAT.

1List of declarations made by the Contractor along with the offer for the preliminary confirmation that he is not subject to exclusion and fulfills the conditions for participation in the proceedings:

1) a single European order document (hereinafter referred to as EAT) according to Annexes 3 to the ToR,

2) EAT concerning other entities about referred to in point 8.26; 8.27; 9.1 of SETC.

2. List of statements and documents submitted by Contractors on requestie the Employer in order to demonstrate the lack of grounds for exclusion:

1) The Contractor submits:

a) information from the National Criminal Record in the scope specified in art. 24 paragraph 1 point 13.14 and 21 of the PPL Act issued not earlier than 6 months before the deadline for submitting bids or applications for admission to proceedings,

b) certificate of the competent head of the Tax Office according to - 5 point 2 of the Minis RegulationDevelopment Route of 26.VII.2016 (Journal of Laws 2016 item 1126),

c) ZUS or KRUS certificate according to - 5 point 3 of the Regulation of the Minister of Development of 26.IIII 2016 (Journal of Laws 2016 item 1126),

d) an excerpt from the relevant register according to - 5 item 4 of the Regulation of the Minister of Development of July 26, 2016 (Journal of Laws 2016 item 1126),

e) the Contractor`s statement according to - 5 item 5 Regulation of the Minister of Development of 26.VII.2016 (Journal of Laws 2016 item 1126),

f) the Contractor`s declarations according to - 5 item 6 of the Regulation of the Minister of Development of 26.VII.2016 (Journal of Laws of 2016 item 1126),

g) the Contractor`s declarations according to - 5 item 9 of the Regulation of the Minister of Development of 26.II .2016 (Journal of Laws of 2016 item 1126),

2) foreign entities submit documents according to - 7 and - 8 of the Regulation of the Minister of Development of July 26, 2016 (Journal of Laws of 2016 item 1126),

3. To confirm compliance with the conditions Zthe amammer demands:

a) a financial statement for a period not exceeding the last 2 financial years according to - 2 para. 2 point 1 of the Regulation of the Minister of Development of 26.VII.2016 (Journal of Laws 2016 item 1126),

b) information from the bank according to - 2 para. 2 point 3 of the Regulation of the Minister of Development of 26.VII.2016 (Journal of Laws 2016 item 1126),

c) information that, the Contractor is insured against civil liability pursuant to - 2 para. 2 point 4 of the Regulation of the Minister of Developmentof 26.VII.2016 (Journal of Laws 2016 item 1126),

d) list of construction works according to - 2 para. 4 point 1 of the Regulation of the Minister of Development of 26.VII.2016 (Journal of Laws 2016 item 1126),

e) list of persons according to - 2 para. 4 point 10 of the Regulation of the Minister of Development of 26.VII.2016 (Journal of Laws 2016 item 1126).

4. The Contractor shall, within 3 days from the day of placing the advertisement on the website information from the opening of the bidder, send the Orderclaiming a statement of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the PPL Act. Together with the submitted statement, the Contractor may provide evidence that links with another Contractor do not lead to distortion of competition in the procurement procedure.

5. In the case of joint application for the contract, each Contractor submits tothe documents and statements listed in - 5 point 1 6, point 9 and 10 of the Regulation of the Minister of Development of 26.II.2016 (Journal of Laws of 2016 item 1126).

Other documents regarding the fulfillment of conditions in the Contractor`s proceedings shall be submitted in in which each of them indicates that the condition has been met in the proceedings.

6. Contractor who refers to the resources of other entities in order to demonstrate the lack of grounds for exclusionsubmits documents and statements of these entities listed in - 5 point 1 6 and point 9 of the Regulation of the Minister of Development of July 26, 2016 (Journal of Laws of 2016 item 1126), as well as other documents regarding the fulfillment of the conditions in which it is cited on their resources. The contractor together with the documents makes a commitment of these entities to make available to him the necessary resources for the implementation of the contractia.

7. The contractor submits the offer via the form to submit, change, withdraw the offer available on ePUAP and make it available. also on the miniPortal.

8. The Awarding Entity does not allow partial tenders.
