Liquidation of group nodes together with the construction of connections to existing buildings and the installation of dual-function nodes (domestic hot water) stage I (stage 3). The order isdivided into 5 parts.

Part 1: Reconstruction / construction of a district heating network and high-temperature thermal connections to buildings currently powered by a low-parameter network with SWC at ul. Ułanow 50 in Krakow and disassembly of existing low-parameter nodes, delivery and assembly of high-parameter nodes in these buildings

1. The Contractor is excluded from the procurement procedure, in relation to which any of the approxolicy referred to in art. 24 sec. 1 point 12-23 of the PPL Act, with exclusion specified premises: in art. 24 sec. 1 point 13 lit. d of the Public Procurement Law, and in art. 24 sec. 1 point 14 of the Public Procurement Law, regarding the offense specified in art. 24 sec. 1 point 13 lit. d of the Public Procurement Law Additionally, the Employer will exclude the contractor in the case described in art. 24 sec. 5 points 1 and 8 of the Public Procurement Law.

2. The Contractor shall attach to the offer of the actas at the date of submitting bids, a statement constituting preliminary confirmation that the Contractor: a) is not subject to exclusion; b) meets the conditions for participation in the proceedings.

3. The Contractor is obliged to submit a statement in the form of EED - detailed in point 12.14 IDW - SIWZ.

4. At the request of the Employer (in accordance with Article 26 paragraph 1 of the Public Procurement Law), the Contractor whose tender was the highest ranked shall submit indate (not shorter than 10 days) valid as of the day of submitting the statement or documents confirming the circumstances referred to in art. 25 para. 1 of the Public Procurement Law. In order to confirm the lack of grounds for excluding the Contractor from participation in the proceedings: a) information from the NQF in the scope specified in art. 24 sec. 1 items 13, 14 and 21 (excluding Article 24 paragraph 1 point 13 letter d) of the Public Procurement Law issued toe earlier than 6 months before the deadline for submission of offers; b) a certificate of the competent US governor confirming that the Contractor is not in default of paying taxes, issued not earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of such receivables together withtional interest or fines, in particular it has obtained the legally required exemption, deferral or installment payment of overdue payments or suspension in full of the implementation of the decision of the competent authority; c) a certificate from the relevant ZUS or KRUS organizational unit or other document confirming that the Contractor is not in arrears with paying social security or social security contributionsRather, issued no earlier than 3 months before the deadline for submission of bids, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding repayment of such receivables, including any interest or fines, in particular obtained the legally required exemption, postponement or payment in installments overdue payments or suspension in fulland the decision of the competent authority; d) an excerpt from the relevant register or CEiDG, if separate regulations require an entry in the register or records, in order to confirm the basics of exclusion under Art. 24 sec. 5 point 1 of the Act; e) declaration of the Contractor about the lack of issuing a final court judgment or a final administrative decision on default in payment of taxes, fees or compositionk for social or health insurance, or in the event of issuing such a verdict or decision documents confirming the payment of these claims together with any interest or fines or conclusion of a binding agreement on repayment of these receivables to confirm the absence of grounds for exclusion under Art. 24 sec. 1 point 15 of the Public Procurement Law; f) statements of the Contractor about bthe cancellation of a ruling against him as a preventive measure of a prohibition against applying for public orders to confirm the absence of grounds for exclusion under Art. 24 sec. 1 point 22 of the Public Procurement Law; g) declaration of the Contractor about not paying taxes and local fees in order to confirm the absence of grounds for exclusion under art. 24 sec. 5 point 8 of the PPL Act (see item 9 of the IDW - SIWZ).

1. Based on art. 24aa of the Public Procurement Law, the Employer in the proceedings conducted under an open tender will first evaluate the offers, and then examine whether the Contractor whose tender has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.

2. At the request of the Employer (in accordance with Article 26 paragraph 1 of the PPL Act) the Contractor, whose offer has been the highest rated submitted within the prescribed period (not shorter than 10 days) valid as of the day of submitting the statement or documents confirming the circumstances referred to in art. 25 para. 1 of the Public Procurement Law. In order to confirm that the offered supplies, services or works meet the requirements specified by the ordering party: - Current European Assessment Document or current oneNational Technical Assessment and national declaration of performance or declaration of performance for pre-insulated materials.

3. The Awarding Entity does not provide for the ordering referred to in art. 134 sec. 6 point 3) of the Public Procurement Law

4. Deadlines for the execution of the order are specified in part III of the ToR.

5. The offer binding period is 3 months calculated on the assumption that the monthhas 30 days, i.e. 3 months = 90 days
