The subject of the order is the execution of construction works in accordance with the Specification of Essential Terms of Orders (SIWZ), as part of the investment task called. "Construction of a sanitary sewage system in Ligota Pi-na and a water supply network in Machnice, Wisznia Mała - Stage II". Planned channel sections to be builtThe aim is to drain the sanitary sewage from the Ligota Piękna area by gravity. Predicted material range for the task titled "Construction of a sanitary sewage system network in Ligota Piękna and a water supply system in Machnice, Wisznia Mała commune - Stage II" covers a total of approximately 1.6 km of sewerage network, including: 1) construction of a sanitary sewage network by gravityPP Dn 200 mm about 1 340 m and 2) side channels (branches to the boundary) Dn 160 mm about 260 m. A detailed description of the task is included in part III of this SIWZ Description of the Subject of the Order (OPZ).

The subject of the order is the execution of construction works in accordance with the Specification of Essential Terms of Orders (SIWZ), -as part of the investment task called "Construction of sanitary sewerage network in Ligota Piękna and water supply network in Machnice, Wisznia Mała commune - Stage II" Planned sewerage network sections are designed for gravitation drainage of sanitary sewage from Ligota Piekna. The Employer requires employment by the Contractor or a subcontractor, based on a contract of employment, persons performing basic technical activities or construction works during the implementation of the order, qualified as manual workers, excluding persons performing independent technical functions in construction, application toArt. 12 et seq. During the execution of the order, the Ordering Party is entitled to perform control activities towards the Contractor regarding compliance by the Contractor or subcontractor with the employment requirement under the employment contract for the persons performing the tasks indicated in paragraph. 1 activities. The Ordering Party is entitled in particular to: demand statements and documents in the scope of confirmationfulfillment of the abovementioned requirements and making their assessment, request clarifications in case of doubts regarding confirmation of compliance with the abovementioned Requirements for carrying out on-the-spot inspections.Aparticularly the mode and manner of carrying out the verification described above are governed by the provisions of the Contract's Formula, i.e. Part II of the ToR.

Works should be performed and completed in accordance with the law in force.m in the Republic of Poland, in particular: Construction Law and Environmental Protection Law, and in accordance with the requirements of the Employer. It is recognized that submitting an offer means that the Contractor has read and accepted the terms of the contract established for the implementation of the order and familiarized with all relevant laws and other legal regulations in force in the territorym of the Republic of Poland, which may in any way affect, or concern activities and activities covered by the offer and resulting Contract.

Contractors who are not subject to exclusion and meet the conditions for participation in the proceedings in accordance with Art. 22 ust. 1 of the Public Procurement Law. The Contractors for whom they are involved are excluded from the proceedings-grounds for exclusion indicated in art. 24 sec. 1 point 12) 23) Public Procurement Law (obligatory grounds for exclusion) and grounds for exclusion indicated in art. 24 sec. 5 point 1) of the Public Procurement Law (optional grounds for exclusion established by the Employer).

The condition referred to regarding economic or financial capacity will be fulfilled if the Contractor demonstrates that he has financial resources or hascreditworthiness of at least PLN 300, 000.00 - Evaluation of fulfillment of the condition will be made according to the formula: "does not meet" based on the submitted by the Contractor: - statement on meeting the conditions of participation in the proceedings, - information from the bank or the cooperative savings and credit account, - written commitment of another entity to share resources (financial capacity)-necessary to complete the order (if applicable).

1. The complete offer should include:

a) The Model Offer Form is attached as Annex 1 to the IDW, together with the Appendix to the Model Offer is Annex No. 1A to IDW;

b) the completed Flat Rate Price Chart is attached as Annex 1B to the IDW;

c) list materials and / or equivalence devices of the model is attached as Annex 1C to IDW (if the Contractor ofsuch devices / materials);

d) valid as at the day of submitting bids A statement of fulfillment of the conditions of participation in the proceedings and not subject to exclusion, to the extent indicated by the Employer in Annex 2 to the IDW in the form of a completed European Single Order Form (EED);

e) the entity's written commitment to share resources, template is attachedNo. 6 to this IDW, if the Contractor demonstrating the fulfillment of the condition specified in clause 9.1.2) or 9.1.3) relies on the abilities of other entities under the terms specified in art. 22a of PPL Act;

f) appropriate power of attorney (a) in the case when the authorization to sign the offer does not result directly from an extract from the relevant register submitted in the offer;

g) in the case of Contractors jointly applyfor the order, a document establishing the Proxy to represent them in the proceedings for the award or representation in the proceedings and conclusion of the contract regarding this public order;

h) Document confirming the payment of the bid security.

2. The Ordering Party does not require submitting documents with the offer, to which the contract will be called by the Contractor or the Contractor will obligeIt is required to submit them on its own ie, a) Declaration of affiliation to the capital group of models is attached to IDW No. 7 within 3 days from the information on opening the offers on the website;

b) Information from the National Criminal Register; c) Copy from the relevant register or from the Central Register and Information on Economic Activity;

d) Declarations(e) Declaration of the Contractor about the lack of a final judgment issued by a court against him or a final administrative decision on default in the payment of taxes, fees or social security or health insurance premiums; ) List of construction works with attaching evidence of the model annex nr 4 to IDW;

g) List of persons referred by the Contractor to perform the public order, along with information on their professional qualifications, entitlements, experience and education, together with information on the basis for the disposition of those persons, model attachment No. 5 to IDW;

h) Information from a bank or Cooperative Savings and Credit Union confirming the amount heldfinancial means or the Contractor's creditworthiness - Documents regarding a third party, listed in letter b) -h) above, in order to demonstrate the absence of grounds for exclusion and fulfillment to that entity, to the extent that the Contractor relies on its resources, the condition of participation in the proceedings, if the Contractor relies on the capacity or situation of the third party.
