The subject of the order is the execution of an investment task named "Construction of a selective point withMunicipal waste collection (PSZOK) in ZUO in Krosno (at Białobrzeska Street in Krosno) ", the task carried out in accordance with the Functional and Functional Program (PFU) and this SIWZ based on the FIDIC Contract Conditions" Yellow Book "(Contract Terms for Equipment and Design and Construction for electrical and mechanical devices and construction works designed by the contractor, 4th editione english unchanged 2008 with errata, translation 1 issue 1999).

Main Site: Zakład Unieszkodliwiania Odpadow in Krosno, ul. Białobrzeska 108, 38-400 Krosno.

1. The scope of works covered by the subject of the orders includes design and execution of PSZOK in accordance with the requirements of PFU along with complete equipment (unless exceptions are clearly indicated in PFU), infrastructureaccompanying (including necessary connections and connections with external facilities and entry from a public or factory road) and land development.

2. The Employer is in possession of the Existing Construction Project for the Construction of the Selective Collection Point of Waste in Krosno at ul. Białobrzeska. The PFU requirements are in essence consistent with the content of the Existing Construction Project.At the same time, the Employer informs that at the stage of preparation by the Contractor of the Design Documentation, the requirements of the Ordering Party should be taken into account in relation to the solutions provided for in the Existing Construction Project. In view of the above, the existing Building Project is information and support material, on the basis of which the Contractor should develop the Construction Design and obtainconstruction permit. The contracting authority does not have a building permit, the application for a building permit is the responsibility of the Contractor.

3. In the content of PFU, the Employer indicates the requirements for the vast majority included in the Existing Construction Project as well as additional requirements. The Contractor, at his discretion, may base his work on the Existing Construction Project, no less in this casehe must verify the correctness of the Existing Construction Project. The existing Construction Design constitutes an Annex to the ToR.

4. All descriptions, material names, manufacturers' names or standards used in PFU or design documentation should not be considered as imposed or suggested by the Employer, should be understood as definitions of standards. When ordering for zgoThe Ordering Party is allowed to use another material (meeting the requirements specified in the tender documentation) material or device.

5. The ordering party requires a 24-month warranty period for the entire subject of the order.

6. An integral part of the description of the subject of the order are attachments, i.e .: Function and Utility Program (PFU). And shared available for use (hasinformative and auxiliary area).

7. Employment clause based on an employment contract art. 29 para. 3a of the Public Procurement Law - the Employer pursuant to art. 29 paragraph 3a in conjunction from art. 36 par. 2 point 8a of the Public Procurement Law requires employment by the Contractor or a subcontractor based on a contract of employment for persons performing the tasks indicated by Zwho are interested in the following orders:

a. employees of lower technical supervision, eg brigadiers, masters in the field of supervision and implementation of construction works (supervision over conducted construction works and their implementation),

b. manual workers performing directly construction works (physical workers on the construction site performing in particular works: earthworks, betonindustry, reinforcement, masonry, plastering, flooring, roofing, paving and installation, electrical, automation and sanitary)

The grounds for exclusion:

1. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings, the Employer (based on the Regulation of the Minister of Development from 26.7.2016 on the type of documents that the Employer may request from the Contractor in the postfor further ordering "Proc. MR ") demands the following documents: 1) information from the NQF in the scope specified in Article 24 (1) (13.14) and 21 PPL, 2) the Contractor's statement that he has not been the subject of a final court decision or a final administrative decision on resignation from payment of taxes, fees or social security or health insurance premiums or in the event of release-such a judgment or decision on documents confirming the payment of these claims together with any interest or fines or the conclusion of a binding agreement regarding the repayment of such debts; 3) the Contractor's statement about the lack of a ruling against him as a preventive measure of the prohibition against applying for public orders; 4) statements of the Contractor about the affiliation or absence of przynato the same capital group as referred to in art. 24 par. 1 p.23 PPL and if belonging to the same capital group, the Contractor may submit together with the statement documents or information confirming that connections with another Contractor do not lead to distortion of competition in the proceedings. The Contractor submits this declaration to the Ordering Party within 3 days of placing pby the Employer on the website of the information referred to in art. 86 par. 5 PPL. 5) If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in sub-item 1) The Contractor shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in whichThe Contractor has the seat or place of residence or place of residence has a person who is concerned with information or a document, to the extent specified in art. 24 sec. 1 points 13, 14 and 21 PZP

2. If in the country in which the Contractor has his registered office or place of residence or place of residence has the person to whom the document relates, no documents referred to in item 1 are issued, they are replaced by a document-containing a statement from the Contractor, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to be submitted, filed before a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the seat or place of residence of the Contractor or place residence of that person. In pIn case of any doubts as to the content of the document submitted by the Contractor, the Employer may apply to the competent authorities of the country in which the Contractor has his registered office or place of residence or place of residence of the person concerned by the document to provide the necessary information regarding this document. 3. The Contractor having its registered office in the territory of the Republic of Poland, in relation to the person havingplace of residence outside the territory of the Republic of Poland, to which the document referred to in - 5 p. 1. MR, submits the document referred to in - 7 para. 1 point 1. MR, to the extent specified in art. 24 sec. 1 point 14 and 21 Public Procurement Law. If in the country in which the place of has a person to whom the document was to relate, no such documents are issued, it is replaced by a document containing a statement of that personbefore a notary or before a judicial, administrative or self-regulatory body or company competent for the place of residence of this person, Documents, above should be issued not earlier than 6 months before the deadline for submission of offers. 4. The Ordering Party requests from the Contractor, which relies on the abilities or situation of other entities under the terms specified in art.-22a of the PPL, submission in respect of these entities of the documents listed in item 1 point 1 3.

1. The Contractor will submit a declaration on fulfillment of the conditions for the participation in the procedure as well as a statement on the absence of grounds for exclusion to the extent indicated by the Employer in the form of a single document ordering the EAT (Article 25a paragraph 1 in connection with section 2 of the PPL)readers regarding this document and the manner of its submission are included in Chapter VIII, point 18, Part I of the SIWZ IDW.

2. The Contractor who refers to the resources of other entities in order to demonstrate the absence of grounds for exclusion (in relation to these entities) and compliance, in so far as it relies on their resources, the conditions for participation in the proceedings will also be submitted to uniform documents regarding these entities andwill include information about these entities in EED (Article 25a paragraph 3 point 1 of the PPL Act).

3. In case of joint application by the Contractors, JEDZ submits each of the Contractors jointly applying for the order. These documents confirm the fulfillment of the conditions for participation in the proceedings and the lack of grounds for exclusion to the extent that each of the Contractors demonstrates fulfillment of the conditions of participation in the-proceedings and no grounds for exclusion.

4. The Contractor is obliged to submit the Single European Order Document (EIN) completed in the scope specified by the Ordering Party in electronic form, i.e. sent to the e-mail address: jedz@mpgk.krosno.pl until the set deadline for submission of tenders.

Instructions:

1) EAT is a self-declaration by Contractors constituting preliminary confirmation:

a) no grounds for exclusion,

b) compliance of the Contractor by conditions participation in the proceedings,

Substitute at the stage of the proceedings for the award of the contract, todocuments and certificates issued by public authorities or third parties, - the Employer does not require completion by the Contractor of the ERO in part IV B Economic and financial situation, lit. C Technical and professional capacity. The Employer requires from the Contractor to complete only section a: General statement regarding all qualification criteria.

2) This statement has beendetermined by way of a standard European Single Order Form (EIN), which is set out in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016 (OJ L 3, 6.1.2016, p. 16) .

3) The Ordering Party informs that it has created an EAT form for the needs of the proceedings at https://ec.europa.eu/tools/espdlang=en), whichy can be imported by Contractors. Attached to SIWZ instructions for importing the form EAT prepared by the Ordering Party

4) Form EAT will be submitted by:

a) Contractors

In the case of Contractors jointly applying for the order, the form EAT is submitted by each of the Contractors (with respect to the conditions for participation in the proceedings completed in the scope in which the Contractor shows them-fulfillment). b) third parties

- EAT a third party shall submit to the Contractor, if it refers to third party resources in order to demonstrate compliance with the conditions of participation in the proceedings, - EAT shall be completed to the extent that the Contractor uses the resources of the third party. EAT should also refer to the verification of the grounds for exclusion,

- It applies to both situations where the third party does not-will be a subcontractor in the course of execution of the order, as well as the situation when such a subcontractor will be.

1.Zamawiający provides the possibility of changes to the provisions of the contract in relation to the content of the offer, based on which the contractor was selected in the scope specified in clause 13 part II SIWZ - Contract.

2. The ordering party specifies the date specified in section IV.2.6 it is 60 days from the date of submissionia offers.

3. The ordering party requires from the Contractors to submit a bid bond in the amount of PLN 100, 000. The bid security should be submitted before the deadline for submitting bids, whereas the payment of the bid bond in bank money will be considered effective only when the bank keeping the account of the Ordering Party confirms that it received such a transfer before the deadline for submission of tenders. ordersspecifies the date of order fulfillment specified in section II.2.7) of the announcement:

• Preparation and handing over to the Employer of the Construction Project together with the necessary documents and arrangements necessary to obtain a building permit: within 4 months from the Contract's entry into force.

• Obtaining on behalf of and for the benefit of the Employer of the Building Permit: within 7 months from the date ofthe execution of the Contract, - • Preparation of Executive Projects: successively, all but not later than within 8 months from the date of entry into force of the Contract. - Completion of the construction together with obtaining on behalf of and ordering the use permit within 18 months from the date of entry into force of the Contract.

5. The orderer does not provide for the possibility of providing a repeat orderconstruction works, as referred to in art. 67 section 1 point 6) Public Procurement Law Acts 6. The orderer demands from the Contractor, which relies on the entities' abilities on the principles set out in art. 22a of the Public Procurement Law, present in respect of these entities the documents listed in point 8 points 1 3 of Chapter VIII of Part I of the SIWZ IDW.

7. The statements referred to in the Regulation of the Minister of Development dated 26.7.2016 on the types of documents that may be requested by the Awarding Entity from the Contractor in the procurement procedure (Journal of Laws of 2016 item 1126) referred to in the Notice regarding the Contractor and other entities on whose capabilities the Contractor relies on the principles set out in art 22a of the Public Procurement Law and concerning subcontractors, are submitted in the original. Other documents, other than statementsreferred to in the first sentence, are submitted in the original or a copy certified for compliance with the original. The attestation of compliance with the original is made by the Contractor, an entity whose capacity is the Contractor, Contractors jointly applying for a public order or a subcontractor, in the scope of documents which concern each of them - 8.
