Subject of bythe covered procedure is the selection of a public contractor for "Preparation of assessments for the conformity of investment projects with the essential requirements for the construction works and exercising construction supervision in performing major repairs and changing the designation of 2 sites in connection with the establishment of a functioning" Center for support for people with disabilities, including severe multiple disabilitiesin the Municipality of Varna under Project No. BG05M9OP001-2.008-0004 "Center for Support of Persons with Disabilities, Including Severe Multiple Disabilities" under Procedure BG05M9OP001-2.008 "Support for Persons with Disabilities", Priority Axis 2 "Poverty Reduction and promoting social inclusion "under Operational Program" Human Resources Development 2014-2020 ".

Main Site: Varna City, the offices / offices ofthe contractor and the objects.

When executing the contract the following should be performed:

1. Conformity assessments (including conformity assessment of the part "Constructive", according to Article 142, paragraph 10 of the LTA) - as a comprehensive report on compliance with the essential requirements under Article 169, Para 1, items 1-5 of the LTA, subject to the requirements of Article 142, paragraph 5 of the Spatial Planning Act when performing engineering (design, withtrinity and copyright supervision) for major repair and change of purpose of the following 2 independent sites:

- Independent site with identifier 10135.5502.119.3.7 (for other purposes) and an adjoining cellar, in a building with identifier 10135.5502.119.3, at: gr Varna, Asparuhovo District, Druzhba quarter, bl. 11, inc. A, floor 1, building 1, 2, with a total area of 287, 81 sq.m, for the opening of theand support for people with disabilities, including severe multiple disabilities ", at: Asparuhovo District, Varna, Varna. Druzhba Blvd 11, Entrance A, floor 1, building 1, 2 with a total area of 287, 81 sq.m,

- Apartment with ID 10135.5502.108.2.2, in a building with ID 10135.5502.108.2 on address: Varna, Asparuhovo District, zh.k. "Druzhba", bl. 17, ent. B, fl. 1, ap. 11, with area 102, 36 m, for revealingnot at Replacement Care at the Center for Support of Persons with Disabilities, including Severe Multiple Disabilities, at: Varna, Asparuhovo District, Druzhba, bl. 17, inc. B, fl. 1, ap. 11.

2. Exercise construction supervision: the selected contractor is responsible for his activities and obligations as a participant in the investment process, regulated in Art. 166 and Art. 168 of the SPA, and hand those arising from Art. 178 of the SPA, as well as other applicable provisions of the current legislation. The construction supervision is carried out within the mandatory scope, in accordance with the requirements of the Spatial Planning Act, the requirements of Ordinance No. 3 of July 31, 2003 for drawing up acts and protocols during the construction, taking into account the requirements of the Ordinance on the essential requirements for the construction works and evaluatingthe construction products and all laws and regulations in the field of construction in BULGARIA

. 166, para. 1, item 1 of the SPA, and for foreign persons - in similar registers, according to the legislation of the Member State in which they are established.legal entity, compliance with the requirement is evidenced by those members of the association who, in accordance with the distribution of the participation of the persons in the performance of the activities stipulated in the agreement for the establishment of the association, are engaged in the performance of the construction supervision / conformity assessment of the investment project. Where the tenderer provides for subcontracting, the requirement is doccalls for those subcontractors who, according to the type and proportion of the contract they are awarded, will perform the construction supervision / conformity assessment of the investment project.

The participant declares in Part IV, letter "A" of the Single European Procurement Document ) compliance with the specified selection criteria.

In the cases of Article 67, paragraph 5 of the Public Procurement Act, the following shall be submitted: certificate / licensefor carrying out the activities under Art. 166, para. 1, item 1 of the Spatial Planning Act or a certificate of the right to exercise the activities under Art. 166, para. 1, item 1 of the Spatial Planning Act of the persons under Art. 166, para. 7 of the SPA, accompanied by the list of competent natural persons, which forms an integral part of it - (certified copy). In case the validity of the certificate / license of a participant in the procedure expires before the deadline of the contractThe participant should also submit a declaration (free text) stating that in the event of being selected as a contractor, he is obliged to renew his certificate or to obtain one in accordance with the terms of the contract.

When the participant is foreign a person should submit a copy of a document certifying the right to carry out such activity, issued by a competent authorityand a Member State of the European Union, or of any other State party to the Agreement on the European Economic Area, in accordance with Art. 166 of the SPA, or submit a declaration or certificate of such registration by the competent authorities in accordance with the relevant national law. When for the performance of the relevant service (construction supervision), under the law of the stateAt which the participant is established, a special permit or membership in a particular organization is required, the contracting authority requires him to prove the existence of such a permit or membership. The assignor shall remove from the procedure a participant for whom the grounds under Art. 54, para. 1 and Art. 55, para. 1, item 1 of the PPA, which occurred before or during the procedure, as well as in the cases of a participant in the procedure, which is a merger and there are some circumstances under Art. 54, para. 1 and Art. 55, para. 1, item 1 of the Public Procurement Act for natural and / or legal persons - member of the association. Information on the absence or existence of grounds for removal shall be declared in the EDES Part III.

2. Specific nationalgrounds for exclusion to be declared in Part III of the OEDOP:

1. The participant shall declare the absence or presence of a conviction for a crime under Art. 194-208, Art. 213a-217, Art. 219-252, Art. 254a-255a or Art. 256-260 of the Criminal Code; 2. The participant shall not be related to other participants in the present procedure, in accordance with Art. 101, para. 11 of the Public Procurement Act;

3. The participant should nothas been established by a penal decree or court decision, violation of Art. 61, para. 1, Art. 62, para. 1 or 3, Art. 63, para. 1 or 2, Art. 228, para. 3 of the Labor Code or similar obligations established by an act of a competent authority under the law of the country in which the participant is established;

4. No violation of Art. 13, para. 1 of the Law onand labor migration and labor mobility;

5. The circumstances under Art. 69 of the Anti-Corruption and Forfeiture of Illegal Acquisition Act;

6. The participant shall meet the requirements of Art. 3, item 8 and art. 4 of the Law on Economic and Financial Relations with Companies Registered in Preferential Tax Jurisdictionsthe entities controlled by them and their actual owners by a participant / subcontractor, such as:

- is not registered in a preferential tax jurisdiction,

- is not controlled by a company registered in a preferential tax jurisdiction. If no specific national grounds for exclusion apply to the participant, it is sufficient to indicate the option "No" in Part III, Section D of EEADD

3. The contracting authority shall exclude from participation in the contract a tenderer who does not meet the selection criteria or fails to fulfill another condition specified in the contract notice or in the documentation or who has submitted a tender which does not meet the pre-announced conditions for fulfilling the contract, or does not meet the rules and requirements related to environmental protectionand the environment, social and labor law, applicable collective agreements and / or provisions of international environmental, social and labor law, or failed to submit a justification under Art. 72, para. 1 of the PPA, or whose offer was not accepted in accordance with Art. 72, para. 3-5 of the PPA, or who has submitted an offer that does not qualify for submission, including form, method and time limit, as well as the participants whoo are related parties.

4. The guarantees for performance of this public procurement shall be presented in one of the forms in accordance with Art. 111, para. 5 of the PPL. Pursuant to Art. 111, para. 2 of the Public Procurement Act, the contracting authority sets a performance guarantee of 2% of the contract value to be paid by the successful bidder to the client`s account or to provide a bank guarantee or withhas provided insurance that guarantees performance by covering the contractor`s liability prior to signing the contract.
