The subject of the order is the performance of the investor`s and archaeological supervision over the construction worksas part of the project entitled Sewage Construction in the Wieliczka Commune Stage IV, Task No. 1 "Construction of sanitary sewage system Siercza, Grabowki, Sygneczow, Podstolice, Koźmice Wielkie in the Wieliczka Commune" co-financed from the Operational Program Infrastructure and Environment 2014-2020 Measure 2.3 "Water and sewage management in agglomerations" priority II "Environmental protection, including adaptation to changes klimatu "

Main Site: Siercza, Grabowki, Sygneczow, Podstolice, Koźmice Wielkie in the Commune of Wieliczka

1. The scope of construction works subject to investment and archaeological supervision service:

1.1) The contract includes the construction of an external sewerage network serving the residents of: Siercza, Sygneczow and Koźmice Great, and inclusion in ul. Drużbacka through a designed collector sain the town of Golkowice for the villages of Podstolice and Grabowki.

1.2) A gravitational sanitary sewage system was designed of PVC pipes with diameters Dn315 mm, Dn250 mm, Dn200 mm and Dn160 mm and pressure pipes made of PE100 SDR11 with diameters Dn90 mm, Dn110 mm, Dn125 mm, Dn160 mm and Dn200 mm. Minimum slope on the -1 / d network, where d the diameter of the sanitary duct. The minimum decrease on the sections whereit is planned to make 1.5% connections. Inspection chambers are designed of plastics with diameter Dn400 mm non-reactive for inspection from ground level. To enable inspection from the bottom of the well, concrete inspection chambers with a diameter of DN 1000 mm will be used.

1.3) The subject of the order is also the construction of 7 tank pumping station for watercourses enabling transport of watercourses fromterrain level to the main sanitary collectors and overcoming terrain obstacles that cause the depression of the network (watercourses). Designed pumping stations do not require a protection zone.

1 . Contractors who are not subject to exclusion pursuant to art. 24 sec. 1 item 12-23 and para. 5 points 1 and 3 uPzp;.

2. Together with the offer, each contractor must submit a current one at the date of submitting offersEAT within the scope indicated by the Ordering Party

2.1) In the case of joint application for contractors, JEDZ submits each of the contractors jointly applying for the order.

2.2) Contractor who intends to entrust the execution of a part of the orders to subcontractors not being the entities referred to in Article . 22a uPzp, is obliged to conclude in the E-mail appropriate information on the(2.3) The contractor, who relies on the resources of other entities, in order to demonstrate the absence of grounds for exclusion and compliance with them, in so far as it relies on their resources, the conditions for participation in the proceedings also include EJ on these entities. 3. The ordering party, prior to the order being awarded, will call the contractor whose offer has been rated the most, to submit to the desig(not shorter than 10 days), the current date as of the day of submitting declarations or documents confirming the lack of grounds for exclusion, i.e.: 3.1) Information from the National Criminal Register in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Public Procurement Act issued not earlier than 6 months before the deadline for submitting bids;

3.2) A copy from the relevant register or from central records and informationof economic activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Art. 24 sec. 5 pt 1 uPzp;

3.3) Contractor`s statements about the lack of issuing a final court judgment or final administrative decision on default of payment of taxes, fees or social security or health insurance premiumsne or in the event of issuing such a verdict or decision documents confirming payment of these receivables with possible interest or fines or conclusion of a binding agreement on repayment of these debts (prepared according to the form constituting Annexe 5a to the ToR);

3.4) Contractor`s statements about the lack of a decision to him as the preventive measure of Zakto apply for public orders (drawn up according to the form attached as Appendix 5b to the ToR);

4. Each of the Contractors jointly applying for the award of a contract is obliged to present at the request of the ordering party mentioned in point III.1.1) item 3 of the declarations and documents referred to in point III.1.1) items 3.1) -3.4). 5. Contractor who relies on the ability or situationother entities under the terms of art.22auPzp is obliged to present on the request of the ordering party mentioned in point III.1.1) item 3 with reference to these entities of documents listed in item III.1.1) items 3.1) -3.4).

6 . Contractor within 3 days from the date of posting on the website information referred to in Article 86 para. 5 uPzp, (point 13.4 of the SIWZ) is obligedtransfer (in the manner specified in point 8.1 of the Terms of Reference) to the awarding entity a declaration on belonging to or lack of belonging to the same capital group (drawn up according to the form constituting Annex 2 to the Terms of Reference), referred to in art. 24 sec. 1 point 23 of the Public Procurement Law. Along with the submission of the declaration, the contractor will provide evidence that links with another contractor do not distort competition inproceedings for the order. In the case of joint application for a contract, each of the Contractors jointly applying for the order is obliged to submit the above-mentioned document. For technical reasons (limited number of characters in the advertisement form) a list of documents confirming the lack of grounds for exclusion submitted by Contractors established or clce of residence outside the territory of the Republic of Poland is found in item III.1.2) of the ninth announcement of the - C.d. from item III.1.1)

List of documents confirming no grounds for exclusion submitted by Contractors having their registered office or place of residence outside the territory of the Republic of Poland:

If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, documents referred to in:

1. point III.1.1), item 3.1), provides information from the relevant register or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative body of the country in which the contractor has its registered office or place of residence is the person concerned or a document, to the extent specified in art. 24 sec. 1points 13, 14 and 21 of the PPL,

2. item III.1.1) item 3.2) submits a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that its liquidation has not been opened and that bankruptcy has not been announced. Documents referred to in point III.1.2) items 1 and 2. should be issued not earlier than six months before the deadline for submission of tenders. If inthe country in which the contractor has its registered office or the place of residence or the place of residence is the person concerned, documents referred to in point III.1.2) sub-point 1 and point 2. are not issued with a document containing a statement by the contractor, with an indication of the person or persons authorized to represent it, or a statement of the person to whom the document was to apply, depositbefore a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the place of residence or place of residence of the contractor or place of residence of that person. The provision of point III.1.2) subpoint 3. applies.

5. In the event of any doubts as to the content of the document submitted by the contractor, the contracting authority may contact the relevant competent authoritiesand about the country in which the contractor has its registered office or place of residence or the place of residence of the person whose document is concerned, for providing the necessary information regarding this document.

6. Contractor established in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, which is covered by the document specified in point III.1.1) point 3.1) shall submit the document referred to in point III.1.2) sub-point 1, within the scope specified in Article 24 (1) (14) and 21 (21) of the Regulation. If in a country where the person concerned has a place of residence, the document does not appear to be such, it is replaced by a document containing a statement of that person made before a notary or before a judicial, administrative or self-governmental bodyprofessionally or economically appropriate for the place of residence of that person. The provision of point III.1.2) subpoint 3. applies.

1. The Contractor, under pain of rejection of the offer, shall pay a deposit: in the amount of PLN 8, 000.00 (in words: eight thousand zlotys 00/100) not later than until 20/08/2019 until 9:00. The bid bond must cover the whole period of being bound by the offer.

2. The contracting authority provides for the use of the circle procedureeated in art. 24aa uPzp.

3. The Contracting Authority does not provide for the conclusion of a framework contract.

4. The ordering party does not anticipate a dynamic purchasing system.

5. The Contracting Authority does not plan to conduct an electronic auction.

6. The Contractor is obliged to submit the following documents together with the offer (see item 8.2 of the Terms of Reference):

6.1) The offer form completed and signed with a qualified electro signaturetronic. The offer form should be prepared on the basis of the template form constituting Annex No. 1 to the ToR.

6.2) Obligation of the entity to place the necessary resources for the order`s execution In order to assess whether the contractor relying on the capacities or situation of other entities under the principles set out in Article. 22a uPzp (point 5.4 SIWZ), will have the necessary resources inenabling the proper performance of the public contract and assessment of whether the relationship between the contractor and these entities guarantees effective access to their resources, the contracting authority requests the submission of documents along with the offer (in particular, obligations) which in particular specify: - scope of resources of another entity available to the Contractor,

- how to use the resources of another entitywith the Contractor when performing the public order, - scope and period of participation of another entity in the performance of the public order, - whether the entity, on the capacities of which the contractor relies on the conditions for participation in education proceedings, professional qualifications or experience, performs construction works or services, which indicated abilities apply.

6.3) Relevant measuresłnomocnictwo / a or other document confirming the authorization to sign the offer in the event that the authorization to sign the offer does not result directly from the offer of the document (the original or a copy certified notarially for compliance with the original). In the case of contractors jointly applying for the award of a document establishing a proxy to represent them in the proceedings forordering.

7. The proceedings are conducted in an unlimited tender procedure.

8. The Contractor submits the offer via the Form for submitting, changing, withdrawing the offer or application available on ePUAP and also made available on the miniPortal. The public key necessary to encode the offer by the Contractor is available to contractors on the miniPortal. Contractor`s offer formis obliged to provide the ePUAP mailbox address, on which correspondence related to the proceedings will be kept. The offer should be prepared in Polish, while maintaining the electronic form in the .doc data format; .docx; .odt; .pdf; and signed with a qualified electronic signature. The method of submitting the offer, including its encryption, is described in the Regulations for the use of miniPortal. ofThe erta should be submitted in the original. The Employer allows submission of an offer in the form of a paper scan of a document (eg a scan to a file in .pdf format), provided that the scan will be accompanied by a qualified electronic signature. In this case, the Employer suggests not to submit any handwritten signatures on the paper document before scanning.
