1. possessing competences or entitlements to conduct a specific professional activity, if this obligation results from a separateh regulations. Not applicable.

1.2 are not subject to exclusion pursuant to art. 24 sec. 1 point 12-23 of the Act on Public Procurement Law (Journal of Laws of 2017, item 1579, as amended) hereinafter referred to as the "Act" or "PPL" (from Article 133 paragraph 4 of the PPL) and based on art. . 24 sec. 5 points 1, 4-8 Pzp.

2. Assessment of compliance with the conditions for participation in the proceedings (according to the formula "meets - does not meet") and no grounds for exclusioncompleted on the basis of: - a) the initial statement of the Contractor contained in the single European order document "EAT" - in relation to all Contractors who submitted bids, and - b) documents and statements confirming the fulfillment of conditions for participation in the proceedings and no grounds for exclusion regarding the Contractor, whose offer will be the highest rated.

3. The ordering party demandssubmitting:

3.1a) At the stage of submitting bids from all Contractors:

a) Uniform / European order document (s) in accordance with item 6.1a) IDW;

b) Documents referred to in item 6.5 of the IDW;

c ) Description of the experience of persons appointed by the Contractor to implement the order (if applicable - in accordance with point 10.5 of the IDW), in accordance with Annex No. 4 to IDW

d) Other statements and documents for whichit is included in the SIWZ that they should be attached to the offer.

3.1 b) Ordering prior to the order being awarded, it will call the Contractor whose offer will be evaluated as the most advantageous, to submit within the prescribed, not shorter than 10 days, the current date as of the day of submitting statements or documents confirming the circumstances referred to in art. 25 para. 1 Pzp, ie documents referred to in point 6.1b) and 6.1d) IDW.

3.1 c) Each Contractor, in accordance with art. 24 sec. 11 PPL, is obliged to submit within 3 days from the date of posting on the website of the Employer information referred to in art. 86 par. 5 Pzp, i.e. the document referred to in item 6.1.c) IDW.

3.1 d) Contractor established in the territory of the Republic of Poland, in relation to persons who reside outside the territory of the Republic of Poland, to whomz document specified in item 6.1b) sub-paragraph a) of IDW, shall submit relevant documents in accordance with the guidelines contained in IDW.

4. In order to confirm the fulfillment of the condition referred to in point 1 item 1.1, the Contractor whose tender will be evaluated as the most advantageous will present: Not applicable.

5. The Contracting Authority will assess (if applicable) whether technical or professional capacity is made available to the Contractor by other entitiesor their financial or economic situation, allow the Contractor to demonstrate fulfillment of the conditions for participation in the proceedings and examine whether there are any grounds for exclusion referred to in art. 24 sec. 1 point 13 22 of the Act (subject to Article 133 paragraph 4 of the Act) and art. 24 sec. 5 points 1, 4-8 of the Act. The Awarding Entity shall request a relevant representation for these entitiestheir documents referred to in item 6.1.b) IDW.

1. If, for a justified reason, the Contractor can not submit documents required by the Awarding Entity in point III.1.3 subsection 2 of the notice, the Contracting Authority allows the Contractor to submit other relevant documents to confirm that the conditions for participation in the procedure set out in point III 1.3 1.1 of the notice have been met. Applies respectively toIII.1.3): The Contractor may, in order to confirm compliance with the conditions of participation in the proceedings, in relevant situations and in relation to the order or parts thereof, rely on the technical or professional capacity or financial or economic situation of other entities, regardless of the legal nature of the merger with him legal relations, according to the rules set out in the IDW (point6.5 IDW, including the obligation to submit documents indicated therein).

3. If the Contractor has his registered office or place of residence outside the territory of the Republic of Poland, he shall submit an appropriate document or documents in accordance with the principles set out in item 6.6. IDW.

4. The period of binding the offer: 60 days.

5. The offer should be made in Polish. Documents in a foreign language should be submitted together with a translation into Polishki.

6. The offer, along with the required documents, should be prepared and submitted in accordance with the rules specified in the announcement, IDW and applicable law, including the Regulation of the Minister of Development of 26.7.2016 on the type of documents that the Employer may request from the Contractor in proceedings for ordering and Pzp.

8. Required deadline for order processing: • The Contracting Authority foresees that the subject of the Agreement will be implemented within a maximum of 58 months from the date of conclusion of the Agreement, including: a) Timing of the Contract for Works: 30.6.2023

b) Period of Reporting Defects up to expiry 3 months from the date of issue of the Taking-Over Certificate for the lastego Section, in accordance with the Contract for Works. c) Carrying out all Contracts required for Prob Works and Final Acceptance. d) Time for elaboration and delivery of the Final Report within a maximum of 30 days from the date of issuing the Final Payment Certificate for the Works Contract by the Engineer .

The engineer will perform his duties until development and (if required) approveAll documents required by the Engineer and fulfillment of other obligations under the Contract shall be accepted by the Employer.

9. This order is part of a larger order given in parts. Each part is the subject of a separate proceeding as part of the order awarded in parts (Article 32 paragraph 4 of the Act). The estimated value of the part does not exceed the amount specified in the regulationon the basis of Article 11 para. 8 of the Act. The estimated value of the whole order exceeds the amount specified in the regulations issued on the basis of art. 11 para. 8 of the Act

10. The contracting authority provides for the award of contracts, referred to in Article 134 sec. 6 point 3) of the Public Procurement Law. The OPZ describes the scope of the aforementioned orders and the conditions under which they will be granted.
