Selection of a consultant within the meaning of the Territorial Planning Act for exercising construction supervisionor in carrying out construction and assembly works for the site: "Reconstruction and rehabilitation of the municipal road Karlovo - Dabene village - Voyniagovo village" The following activities are envisaged: execution of construction supervision, including responsibility for its activities and obligations as a participant in the investment process, regulated in Articles 166 and 168 of the Territorial Planning Act, as well as those resulting from Art.178 of the TDA, as well as other relevant provisions of the legislation in force
The participants must hold a valid license issued by the Minister of Regional Development and Public Works (according to the requirements of the Territorial Planning Act, in SG 82 / 26.10.2012) or valid construction supervision certificate issued by the head of the National Construction Contracts DirectorateRoll (DNKK) according to the requirements of Ordinance № RD-02-20-25 of 3.12.2012 on the conditions and procedure for issuance of a certificate for entry in the Register of the consultants for the assessment of the compliance of the investment projects and / or the exercise of construction supervision or the equivalent for foreign participants

When the contract with the selected contractor is concludeda certified copy of valid licenses / certificates. Where the tenderer is a non-resident, he shall provide a copy of a document attesting to the right to perform such activity, issued by a competent authority of a Member State of the European Union or of another State party to the Agreement on the European Economic Area, 166, para. 2 and para. 7 of the TDA. In the event that ythe private person has a document whose term of validity expires during the performance of the contract, he / she should initiate a procedure for the renewal of the document within the statutory time-limit in a timely manner.
If the participant is a consortium / consortium, of the consortium / consortium that will undertake construction supervision. The requirement also applies to subcontractors.
The participant (respectively a member of a consortium who will carry out construction supervision activities) should have a valid "Professional Liability Insurance" under Article 171, Paragraph 1 of the TDA for persons registered in the territory of the Republic of Bulgaria or equivalent for non-residents, in accordance with the legislation of the country in which they are established.
Authentication: when submitting a tenderand the fact is declared in EEDOP. For participants, the grounds for removal of Art. 54, para. 1, Art. 55, para. 1 of the Public Procurement Act, and Art. 3, item 8 of ЗИФОДЮПРСТСТТДДС and art. 101, para. 11 of the Public Procurement Act. Pursuant to Art. 69, para. 1 and para. 2 of the Law on Counteracting Corruption and for Removal of the Acquired Property, "a person holding a high public position, which in the last one-year of the performance of his or her duties or obligations in the course of the performance of public procurement procedures or procedures relating to the allocation of funds belonging to the EU or granted by the EU to the Bulgarian State shall not be entitled for one year from his / her exemption from being a member of, or representing a natural or legal person in, such procedures before the institution in which he held the post or a legal person controlled by him. "3 The contractor, who is designated as contractor at the signing of the contract, submits a performance guarantee amounting to 3% of the value of the public procurement contract. 4. The Contracting Authority pays the Contractor the price of this Contract as follows:
1. An advance payment of 50% (fiftyof the bid price of the designated contractor, according to the concluded contract, payable within 15 (fifteen) days after the conclusion of the contract and after receipt by the assignor of an advance payment of the project, subject to contract № 16/07/2/0 / 00398 of 13.11.2017, by the State Agriculture Fund, and upon presentation of an original invoice, equal to the value of the advance, withVAT;
2. Final payment at the amount of the remaining part of the agreed remuneration, payable within 30 (thirty) days after the acceptance of the sites in accordance with the Territory Planning Act and issuance of a permit for use and issuance by the contractor and submission to the assignor of an invoice for the amount due.
