Framework Agreement for the provision of medicines (67 batches) according to the data sheet and the specifications. According to art. 161 of Law 98/2016. Day Numberup to which clarifications may be requested before the deadline for submission of tenders / applications: 15. The contracting authority will respond clearly and fully to all clarification requests / additional information on the 10th day before the deadline set for submission of the tenders in the tender notice.

CI. The suppliers, third parties and subcontractors must not find themselves in the situations stipulated in art. 164, 165, and 167 of the Law No. 98/2016.

The way in which the fulfillment of the requirement can be demonstrated initially: will be completed by the Unique Acquisition Document - European (DUAE) conf.art.193 of Law no.98 / 2016, by the operaeconomic agents participating in the award procedure, with the information related to their situation. The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively equivalent documents, issued in the country of residence, for the foreign tenderers, are to be presented at the request of the Authority only by the bidder ranked I in the rankingsThe following documents may be:

1.-certificates showing the lack of overdue debts regarding the payment of taxes, taxes or contributions to the

Consolidated general budget (local budget, state budget, etc.) at the end of the evaluation of the tenders. 2. the criminal record of the economic operator and the members of the management, management oris the oversight of the respective economic operator or of those who have the power of representation, decision or control within it, as follows from the on-going certificate issued by the ONRC / constitutive act; 3.-as the case may be, documents by which demonstrates that the economic operator may benefit from the derogations provided for in Article 166 (2), Article 167 paragraph (2), Article 171 of Law 98/2016on public acquisitions

The participating economic operators have the obligation to complete and transmit on-line coin accordance with the above requests, DUAE, by which

Demonstrate that they meet the requirements regarding personal situation. The DUAE is available through the Dedicated on-line service, made available free of charge by the European Commission available at https://ec.europa.eu/growth/toolsdatabases/espd/filter.

All documents, namely the DUAE, the Non-compliance Statement in the provisions of art.60-of Law 98/2016, the documents of the Technical Proposal, the financial proposal and the document attesting the constitution of the participation guarantee shall be submitted to the SICAP, signed with the electronic signature. - The economic operators submitting the tender must prove a registration according to the law of the country of residence, from which it appears that the economic operator is legally constituted, as not-is in any of the situations of cancellation of the establishment and the fact that it has the professional capacity to perform the activities that are subject to the contract.Modality of accomplishment: completion of the DUAE, following the supporting document, respectively the Certificate issued by the ONRC or for the foreign tenderers, document equivalent in the country of residence, be submitted at the requestcontracting authority only by the tenderer ranked first in the interim ranking, drawn up at the end of the evaluation of the tenders. The document will be presented in the original / legalized copy / legible copy with the mention "according to the original". The information in the Founder's Certificate must be current / actual at the time of filing the document.

The framework agreement will end with mex. 5 economic operators submitting admissible tenders. For 1st place: if the first ranked tenders are found to have equal prices, the contracting authority will request re-listing in SEAP, in order to divide the bids. Tenders will be loaded into the SEAP by a clearly defined deadline (and communicated to tenderers) by the contracting authority. The bidder with the pricelower will be designated winner. If and after re-offerment, the bid prices are equal, then the contracting authority will request a new price offer in the SEAP until the tie can be made. In the situation when bidders ranked second will have equal price offers, they will be asked for new price offers. the bidder placed on the 1st place (place superior) being unaffected in any form, as the striking demand is firmly and unequivocally mentioned in the second place for which they reffert. The contracting authority reserves the right to terminate the framework agreement unilaterally before the termn if the Ministry of Health will conclude, under GEO 71/2012, framework agreements on the products of the present proceeding.
