For each lot. 1. Bidders, supporting third parties and subcontractors shall not be in the situations referred to in art. 164, 165, 167 of Law no. 98 / 2016.

Mode of accomplishment: DUAE will be completed in accordance with Art. 193par. (1) of the Law no. 98 / 2016.

The supporting documents proving the fulfillment of the ones assumed by completing the DUAE and to be submitted, at the request of the contracting authority / entity, only by the tenderer ranked first in the intermediate rankings drawn up at the completion of the evaluation of the tenders are: Finding on the lack of overdue debts with regard topayment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of submission, - the criminal record of the economic operator and the members of the administrative, management or supervisory body of that economic operator those who have power of representation, decision-making or control within it, as it turns outn the certifying certificate issued by the ONRC / instrument of incorporation, - if necessary, documents proving that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on public procurement, - other editorial documents, as appropriate.

If in the country of origin or the country in which the tenderer is establishedthe supporter / subcontractor does not issue documents of the nature mentioned above or the documents do not cover all the situations stipulated in art. 164, 165 and 167, the contracting authority / entity is required to accept a declaration on its own responsibility or, if there are no legal provisions on the declaration on its own responsibility, an authentic declarationthat is given to a notary, an administrative or judicial authority or a professional association with competence in this respect. 2.

Means of performance: the bidder / third party / subcontractor will fill out thecomplying with the provisions of art. 59 and 60 of Law no. 98/2016 on public procurement; the economic operator (leader, associate, third party, subcontractor) will present the DUAE form in the awarding documentation. The framing of the situation stipulated in art. 60 of Law no. 98/2016 on public procurement, results in the exclusion of the tenderer from the procedure applied for the award of the contractof public procurement.

The way of ranking the first ranked offers with equal prices for lots 2, 4, 5 and 6: in case which finds that the admissible tenders ranked first, have equal prices, the contracting entity will request re-payment in SEAP, in order to divide the bids.

How to divide the bids with equal scores (for lots 1 and 3). If, following the evaluation of the tenders, two or more offers are ranked first, having the same total score, the winning bid will be that of the bidder who obtained the highest score for the bid price. the case in utwo or more offers are classified in the first place, having the same total score, respectively the same score for the "Price of the bid" and the same score for the evaluation factors related to the technical proposal, then the contracting authority will request only those bidders recharge the SEAP for a new price offer until it is separatedhate offer.

Warning.

Requests for clarification shall be filled exclusively SEAP section "Questions" and answers to them will be also published in SEAP. For any request for clarification about the tender documentation, operators must register in SEAP www.elicitatie.ro as economic operator and as participants in the award procedure.• The economic operators will submit the answers to the clarification and any documents requested in SEAP in electronic format, signed with the extended electronic signature, according to the provisions of Law no. 455/2001 on Electronic Signature.

Any participating economic operator will prove his /of his legal representative on the basis of a document attesting to such quality (eg constitutive act, extract / certificate issued by the Trade Registry or other evidence issued by a competent authority). If the tender and the qualification documents are signed by a person other than the legal representative, besides the above-mentioned documents attesting qualifyingher legal representative shall present a special power of attorney given by the legal representative for that person, in the original. In case of association, the requirement must be fulfilled by each associate. In order to fulfill the obligation regarding the mode of transmission of UAAE by the economic operators participating in the award procedure, they will directly fill in SEAP, in the dedicated sectionof the procedure, the DUAE has already been set up by the contracting authority.
