Maintenance of the Electricity Quality Monitoring System (SMCENEL)

C.N.T.E.E. Transelectrica S.A. owns the Electricity Quality Monitoring System (SMCENEL), an integrated system that uses complex software applications dedicated to the acquisition, storage, takeover, validation and publishingof the electricity quality data.

C.N.T.E.E. Transelectrica S.A. wishes to initiate an acquisition procedure for the purchase of services for the "Maintenance of the Electricity Quality Monitoring System (SMCENEL)", in order to ensure the functionality of the system as a whole and the equipment that compose it, under the conditions- Requirement 1: The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 177, 178, 180 of Law no. 99/2016. The way in which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. docuthe supporting documents proving the fulfillment of the assumed by completing the DUAE shall be presented, at the request of the contracting entity, only by the bidder placed on the first place in the interim ranking made at the completion of the evaluation of the tenders. These documents may:

1) establish certificates of absence of overdue debts in respect of the payment of taxes, (2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator or those having the power of representation, decision or control within it, as evidenced by the certificate issued by the ONRC / constitutive act; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 179 par. (2), art. 180 par. (2), art. 184 of the Public Procurement Act 99/2016; 4) other editorial documents, as the case may be.

Requirement 2: Statement regarding non-compliance with the provisions of art. 73 according to Law 99/2016. The requirement will be filled inin the DUAE form in the awarding documentation. The decision-makers of the contracting entity involved in the public procurement procedure are:

The economic operators submitting the tender must prove a form of registration in accordance with the law of the country of residence, that the economic operator is legally constituted, that it is not in any way of the situations of cancellation of the establishment and the fact that it has the professional capacity to carry out the activities that are the object of contractionTAD. Mode of accomplishment: Completion of DUAE in accordance with art. 202 204 of Law 99/2016 and ANAP Notification 240/2016, and the supporting document, namely ONRC or, for foreign tenderers, the equivalent documents issued in the country of residence shall be submitted at the request of the contracting entity only by the bidder ranked first in intermediate rankings, complete it(1) When signing the contract, the winning tenderer will present, in full, without any omissions or omissions, the subcontracting contracts. If the subcontractors proposed in the tender request that the payment be made directly to them, the incident clauses in the contract model will be modified accordingly.

3) Mandatory contractual clauses are : 2, 3, 4, 8, 9, 10, 24. Mandatory contractual clauses must be considered as such by tenderers and can not be changed. Any change to the mandatory contractual clauses will lead youwhat about declaring the offer as non-compliant. Mandatory contractual clauses must be given as such by bidders and can not be modified. Any modification of the mandatory contractual clauses will lead to the declaration of the offer as non-conforming; 4) According to art. 54 par. (3) of H.G. no. 394/2016, the economic operator has the obligation to include in the offer a list of affiliated enterprises5) If, in order to verify the conformity of the technical proposal with the requirements of the specification or in order to verify the financial proposal, the contracting entity requests the submission of certain clarifications / completions, both the request and the answer of the tenderer are transmitted in SEAP in electronic format, signed with the electronic signature egtinsa, based on a qualified certificate, issued by a certification service provider accredited under the law. If the answers are found to be unclear or incomplete, the evaluation commission is not obliged to repeat the request for clarification and may apply the provisions of art. 140 para. (4) of GD no. 394/2016
