2.1.5 Guarantees

The Letters of Guarantee in paragraphs 2.2.2 and 4.1. are issued acredit institutions legally operating in the Member States of the Union or the European Economic Area or in the GPA member states and have this right in accordance with the applicable provisions. They can also be issued by the ETAA. - TEME or be provided with a depository and Loan Fund bill, with a deposit of the respective amount of money. If set updeposit coupons with Deposits and Loans Fund, coupons or dividends expiring during the guarantee are returned after they have expired to the ProCredit Guarantee.

Letters of Guarantee are issued at the option of the economic operators by one or more publishers of the above paragraph

These guarantees include minimum(a) the date of issue, (b) the issuer, (c) the contracting authority to which it is addressed, (d) the guarantee number, (e) the amount covered by the guarantee, (f) . and the address of the economic operator in favor of which the guarantee is issued (in the case of a union, all the above for each member of the association shall be indicated); (g) the conditions that: (aa)the issuer waives the right to divide and divorce; and bb) in the event of such a denial, the amount of the divestiture shall be subject to the stamp duty in force at that time, h) the details of the relevant declaration and the closing date for submission (i) the date of expiry or the period of validity of the guarantee, (j) the undertaking(k) in the case of performance guarantees, the number and title of the contract in question; (b) the amount of the guarantee to be paid in whole or in part within five (5) days following a simple written notice to the person to whom it is addressed;

The specimens of the letters of guarantee to be deposited shall be in accordance with ANNEX III Letter of Guarantee• The contracting authority communicates with the issuers of the letters of guarantee in order to verify their validity

2.2.2 Participation guarantee

2.2.2.1. For a valid participation in the process of concluding this contract, a Participation Letter of 2% of the net value of the Sub-Fund is deposited by the participating economic operators (tenderers)who wish to take part. In the case of an association of economic operators, the participation guarantee also includes the condition that the guarantee covers the obligations of all economic operators participating in the association.

The participation guarantee must be valid for at least thirty (30) days after the end of the term of validity of the offer of Article 2.4.5 hereof, otherwise the offer is rejected. The athe contracting authority may, before the expiry of the tender, ask the tenderer to extend the duration of the tender and of the participation guarantee before expiry. The guarantee of participation is returned to the contractor on presentation of the performance guarantee which is deposited before or at the time of signing the relevant contract.in accordance with the specific provisions of Article 72 of Law 4412/2016.

2.2.2.3. The participation guarantee is forfeited if the offeror withdraws his offer during this period of validity, provides the false information or information referred to in Articles 2.2.3 to 2.2.8, fails to provide the documents provided for in this document in time or does not come in time for signature of the contract.

Performance guarantee

For the signing of the contract, a performance guarantee is required pursuant to Article 72 (1) (b) of Law 4412/2016, amounting to 5% of the value of the contract, except VAT, and is deposited prior to or at the time of signing the contract and will be valid for two (2) months from the date of expiry of the contract.in order to be accepted, it must at least include those mentioned in paragraph 2.1.5. details of the present and the required elements of article 72 par. 4 of law 4412/2016 and in addition the number and title of the relevant contract. Its content is in accordance with the model contained in Annex III of the Declaration and the provisions of Article 72 of Law 4412 / 2016. The performance guarantee for the contract shall cover in full and in a non-discriminatory manner the application of all the terms of the contract and any claim by the contracting authority to the contractor, including any amount equal to the advance., which entails an increase in the contract value, the contractor is obliged to depositin the event of a breach of the terms of the contract, as specified by the Contractor, in advance of the modification, a supplementary guarantee amounting to 5% of the amount of the increase, excluding VAT. in proportion to the value attributable to the part of the portion of the materials finally received after thequantitative and qualitative reception of the subject of the contract and is replaced by a guarantee of good functioning. If the final qualitative and quantitative receipt protocol contains observations or there is a delayed delivery, the return of the above guarantees is made after the observations and delays have been dealt with.

Guarantee of Good Operation

This corresponds to 2.5%of the conventional value of the items without VAT This letter of guarantee will cover the entire period of the guarantee of the good functioning of the items.

Financing of the contract

The financing body of this contract is the Public Investment Program of the General Public Administration. with Ref. SAE546. The cost for this contract is borne by the OEM: 9345a related credit of the Agency's PDB budget.

2.2.4 Quality Assurance Standards and Environmental Management Standards

Economic operators for this contract award procedure must be in possession of the necessary quality certificates in force, issued by official quality control offices or competent services of recognized competence, to certify compliance the contractor implementing quality management systems(For each part of this notice, to which the economic operator wishes to submit a tender, it must also have the corresponding quality certificates.)
