The subject of the order is delivery, assembly and implementation of equipment and software creating a coherent solution of monitoring system of environmental parameters for server rooms (Data Processing Centers) of the Ordering Party (hereinafter referred to as a system or solution) along with the Contractor`s training for the Ordering Party and providing technical support servicesego.

Delivery, assembly and implementation of equipment and software creating a coherent solution of environmental parameters monitoring system for server rooms (Data Processing Centers) of the Ordering Party (hereinafter referred to as a system or solution) together with training by the Contractor for the Ordering Party and providing technical support services

- in accordance with the description of the object orderedand included in Annex No. 1 to the ToR - Description of the subject of the order and in accordance with the scope and terms of contract implementation, which are set out in Annex 8 to the Terms of Reference - Essential to the parties of the provisions of the contract condition fulfilled if the Contractor demonstrates that he has: a) an at least third level industrial safety certificate confirming the ability to protecty classified information with at least "Secret" clause in accordance with the Act of 5 August 2010 on the protection of classified information (Journal of Laws of 2019, item 742) and executive acts issued on the basis of it,

b) ICT system enabling the processing of classified information with at least "Restricted" clause meeting the requirements specified in the Act of 5.8.2010 on protection of informationji classified (Journal of Laws of 2019 item 742) and the Regulation of the Prime Minister of 20.7.2011 on basic ICT security requirements (Journal of Laws 2011 No. 159, item 948).

1. The contracting authority provides for the procedure referred to in art. 24aa of Public Procurement Law

2. The Employer is the administrator of personal data within the meaning of the Regulation of the European Parliament andCouncil (EU) 2016/679 of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (hereinafter: "RODO").

3. The contractor submitting an offer in the procedure is required to submit a declaration required from the contractor to fulfill the information obligations provided for in Article 13 orVol. 14 GROSS

4. Communication between the Employer and Contractors is carried out using means of electronic communication using the MiniPortal of the Public Procurement Office and the Procurement Portal of the Information Resource Center:

1) in the scope of sending correspondence - through the Ordering Party`s Public Portal http://zamowienia-czi.wp.mil. com /. A dedication is assigned to each procedurecorrespondence form;

2) in the scope of submitting, changing and withdrawing offers - via miniPortal https://miniportal.uzp.gov.pl/ and ePUAP https://epuap.gov.pl/wps/portalPublic key necessary to encode the offer by the Contractor is available to contractors on the miniPortal and constitutes an attachment to the ToR.

5. Contractor in accordance with art. 24 sec. 11 of the PZP Act within 3 days from the day ofinformation on the website of the information referred to in art. 86 par. 5 will provide the Ordering Party with a declaration of belonging or non-affiliation to the same capital group as the submitted offers. In the case of affiliation to a capital group, the Contractor may submit documents or information confirming that connections with other Contractors does not lead to distortion of competition. Wykfrom statements or documents confirming fulfillment of the conditions for participation in the proceedings and no grounds for exclusion:

1) as regards confirmation of compliance by the Contractor with the conditions of participation in the proceedings, the Contracting Authority will demand in accordance with art. 26 par. 1 of the Public Procurement Law Act, the following documents: a) a copy of the current Industrial Safety Certificate at least third degree, confirming the capacityContractor to protect classified information of at least "Secret" clause, in accordance with the Act of 5 August 2010 on the protection of classified information (Journal of Laws of 2019, item 742, as amended) - in accordance with requirements specified in clause 5.1 point 1) letter a) of the ToR;

b) Declaration on the ability to protect classified information and its processing in the scope of IT security requirements confirmingsubsidence of the ICT system enabling the processing of classified information at least "Disclaimer" in accordance with the requirements set out in clause 5.1 point 1) letter b) of the ToR,

c) a list of persons referred by the Contractor to perform the subject matter of the order. with the list of persons should submit:

- copies of the current personal security certificate entitling toaccess to classified information marked with a clause, at least "Secret", - copies of current certificates of training in the protection of classified information, including international (NATO and European Union) - copies of documents stating professional qualifications; - 2) in the absence of grounds to exclude the Ordering Party will demand according to Article 26 of the Public Procurement Law and Article 24 of the Public Procurement Lawdocuments:

a) declarations and documents referred to in par. 5 points 1-6 and 9 of the Regulation on documents;

b) statements referred to in par. 5 point 10 of the Regulation on documents;

c) documents and statements referred to in par. 7 and 8 of the Regulation on documents and, where applicable, also from par. 9 of the Regulation on documents
