It will elaborate the technical design documentation for the technical project phases and execution details, the technical studies necessary to define the solution / the layout, technical verification, technical assistance and will be executedyour works designed according to the requirements of the Tender Book for each lot. Technical studies required to define technical solutions / layout schemes / technical design: topo-bathymetric; geotechnical; geological sedimentological; geomorphological; seismic; climate;
Numerical coastal hydrodynamic modeling near the shoreline; Physical modeling; They will execute(Lot 2, Lot 4 and Lot 5) and demolition / construction / rehabilitation works for coastal structures (for all lots), in detail, as follows:
Lot 1, lot design and the execution of the layout schemes and the replacement of the component equipment for 2 complex hydrotechnical structures with a aperture of about 80 m at Stavilar-Edighiol and about 400 m to Stavilar Periboina:
Breeding defense works; Construction of hydrotechnical structures; Rehabilitation, by replacing the components of the hydrotechnical structures (replacement with the purpose of reaching the object, namely the commissioning of the hydrotechnical structures and the achievement of the purpose for which they were built);
Demolition of existing coastal structures;
Lot 2, lot-which involves the design and execution of the objects in the arrangement scheme on a seashore length of about 6 950 m: Demolition of existing coastal structures; Expansion / building of existing coastal structures; Behavior of the beach;
Lot 3, lot which involves the design and execution of the objects in the arrangement scheme on a seacoast length of approximately 790 m:
Demolition of existing coastal structures; coneStructure of new coastal structures / shore defense; Lot 4, projecting and executing objects in the planning scheme on a seashore length of approximately 1 200 m: Demolition of existing coastal structures; Construction of new coastal structures; Beginning works of the beach
Lot 5, lot involving the design and execution of the objects in the arrangement scheme on a seacoast length of about 5 750 m:
Demolition of existing coastal structures; Construction of new coastal structures; Beginning of the beach
The amount of the participation guarantee for each lot is detailed in Annex B. Form No. 1 will be filled in.
The participation guarantee will be made in accordance with the provisions of art. 36 of the Methodological Norms for the application of the provisions regarding the award of the contract-public acquisition of Law no. 98/2016 regarding the public acquisitions from 2.6.2016, approved by the Decision no. 395/2016, through a guarantee instrument (letter of guarantee) issued under the law by a bank or an insurance company.
If the bidder opts for the guarantee of participation by bank transfer, the guarantee must be paid to the RO account98TREZ2315005X006429, opened at Constanta Treasury, CUI 23877359
Proof of the guarantee of participation will be obligatory also in SEAP (scanned until the deadline for submitting bids) signed with extended electronic signature according to art. 60 par. 4 of GD no. 395/2016. The guarantee must be irrevocable.
In the case of submitting bids in association, the guarantee for participation must beon behalf of the association, and to mention that it covers all members of the group of economic operators jointly. The participation guarantee issued in a language other than Romanian will be accompanied by an authorized translation into Romanian. For a participation guarantee deposited in a currency other than the RON, the equivalent will be made at the NBR exchange rate from the date before the deadline for the submission of bids with5 days.
Validity of the guarantee for participation: 190 days from the deadline for the submission of tenders.
The amount of the performance guarantee is 10% of the value of the contract without VAT and is constituted according to art. 40 of the Methodological Norms for the application of the provisions regarding the award of the public procurement contract under Law no. 98/2016 on public procurement din 2.6.2016, approved by the Decision no. 395/2016, through a guarantee instrument (letter of guarantee) issued under the law by a bank or an insurance company. The performance guarantee is made within 5 working days from the date of signing the public procurement contract (Article 39 paragraph 3 of the Methodological Norms for the application of theconcerning the awarding of the public procurement contract, of Law no. 98/2016 regarding the public acquisitions from 2.6.2016, approved by the Decision no. 395/2016)

The tenderers, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, 165, 167 of Law no. 98 / 2016.
The way it can be demonstratedfulfillment of the requirement: it will be completed by the economic operators participating in the award procedure with the information related to their situation.
The supporting documents demonstrating the fulfillment of the undertaken by completing the DUAE are to be presented at the request of the contracting authority, only by the first ranked bidder in the intermediate rankings finalizedarea for evaluation. These documents include:
1.certificate Ascertaining the lack of debt outstanding on the payment of taxes or contributions to the general consolidated budget (local budgets, budget, etc.) at the time of presentation;
2. criminal record of economic operators and members of the administrative, management or supervisory respthe economic operator, or those who have the power to represent, decide or control within him, as it results from the certifying certificate issued by the ONRC / constitutive act;
3. as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016 on acquisitionspublic authorities; other editing documents, as the case may be
Avoidance of conflict of interests
The tenderer / the associated tenderer / the subcontractor / the supporting party must not be in a situation of conflict of interest and / or unfair competition
The manner of fulfillment and applicability in the procedure:
- The Tenderer / Associated Offeror / Subcontractor / Supporter will present the DUAEfirm that the economic operator is not in any of the situations provided by art. 59 and art. 60 of the Law no. 98/2006 on public procurement.

In case the economic operator (bidder / affiliate / subcontractor / third party) is in one of the situations provided by art. 60 of Law no. 98/2016 on public procurement, it will be excluded from the atribuire, bid being rejected. The economic operators submitting the tender must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legally constituted, that he is not in any of the situations of cancellation of establishment and that he has the professional capacity to perform the activities that are the object of the contractconfirmation summaries:
- DUAE will be filled in by the economic operators participating in the award procedure with the information related to their situation.
The supporting documents proving the fulfillment of the assumed by completing the DUAE, respectively the Certificate issued by the ONRC, in the field of activity, the activities subject to the present contract (CAEN Codes), or in the case of foreign tenderers, equivalent documents issued in the country of residence proving a form of registration / attestation or professional belonging, from which it appears that the tenderer has in the field of activity, the activities that do the object of the present contract (CAEN codes) is to be presented at the request of the contracting authority only-by the bidder placed on the first place in the ranking drawn up at the completion of the tender evaluation. The information in the certificate must be valid / valid on the date of its submission.
Documents issued in another language must be accompanied by an authorized translation into Romanian.
