1) The bidders, third parties, associations and subcontractors should not be found in the situations provided for in art. 59-60 of the Law no. 98/2016. To this end, it will be completed by all DUAE economic operators, by the deadline for the submission of tenders.

Bidders, third parties and subcontractors should not find themselves in the situations provided for in art. 164, 165, 167 of Law no. 98/2016 pmaking public procurement. The way in which the fulfillment of the requirement can be demonstrated is the completion of the DUAE by the economic operators participating in the award procedure with the information related to their situation under the sanction of exclusion of the economic operator according to Art. 169 of Law no. 98/2016 on public procurement.

The supporting documents proving the fulfillment of the asuby completing the DUAE, shall be submitted, at the request of the contracting authority, only by the tenderer ranked first in the ranking drawn up at the completion of the evaluation of the tenders. These documents may be:

- founding certificates regarding the lack of overdue debts regarding the payment of taxes, duties or contributions to the consolidated budget (local budget, state budget etc.) at the time of submission / filing,

the criminal record of the economic operator and of the members of the management, management or supervisory body of the economic operator or those having the power of decision or control representation within it, so as evidenced by the certifying certificate issued by the ONRC / constitutive document,

- as the case may be, documents demonstratingthat the economic operator may benefit from the derogations provided in art. 166 par. (2) as amended, art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016, - other editorial documents, as the case may be; 2) Foreign legal persons may submit a declaration on their own responsibility or, if in the respective country there are no legal provisions regarding declaredon its own responsibility, an authentic declaration made before a notary, an administrative or judicial authority or a professional association having competence in this respect for the situations described in Art. 164, 165 and 167 of Law no. 98/2016 on public procurement.

Note:

The requirement must also be fulfilled by associates, third-party supporters and subcontractors in the case of needlesknew there was. The economic operator participating in the procedure will be complemented directly by SEAA after authentication and downloaded in PDF format and signed with the extended electronic signature. DUAE will be loaded into the SEAP qualification section. This document confirms that the qualification requirements as requested in the atr documentation are metibuire. The tenderer has the obligation to present / complete the certificates / supporting documents proving / confirming the fulfillment of the qualification requirements, when he receives a request from the contracting authority within the deadline stipulated in the respective request

Updated supporting documents shall be presented in accordance with art. 196 par. (2) of the Law no. 98/2016 on public procurement.

In order to verify the information contained in the DUAE, according to art. 196 of Law no. 98/2016, the contracting authority has the right to request, and the tenderer has the obligation to submit supporting documents proving the fulfillment of the undertaken by completing the DUAE, such as: for the Romanian economic operator: certificate issued by the Registryof the Commerce of the Territorial Competent Tribunal. Annual general turnover. As provided in Art. 175 par. (1) of the Law no. 98/2016, the economic operators submitting tenders must submit the following documents regarding the economic and financial capacity: 1 supporting document showing the annual turnover for the last 3 years (2016, 2017, 2018) and that is minimal: 1 000 000 RON / year without VAT, thus demonstrating that the bidder had a volume ofbusiness roughly similar to the estimated value of the future contract
