Framework agreement for the supply of products for clinical use

Framework agreement for the supply of products for clinical use batch 1-14 according to the specifications.

Main Site: Bacau County Emergency Hospital, Str. Spiru Haret no. 2, Bacău.

According to the specification (amount of value).

The bidders, third-party supporters and sub-contractors must notcan be found in the situations provided in art. 164, 165, 167, of Law no. 98 / 2016.

The way in which the requirements can be met: the DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. Once the DUAE is filed, the declaration regarding the non-compliance with the provisions of art. 59-60 of Law 98/2016 own modelu F3.

The contracting authority will ask the tenderer ranked on the first, second, third place in the intermediate ranking drawn up at the end of the evaluation of the offers following the supporting documents proving the fulfillment of those assumed by completing the DUAE:

1) certificate issued by the Local Public Finance Administration within the Agency National Tax Administration. The fiscal certificate with prthe payment of taxes, taxes or contributions to the general consolidated budget must attest to the lack of outstanding debts at the time of its submission. Method of fulfillment and applicability within the procedure: legible copy signed and stamped by the legal representative with the mention "according to the original";

2) certificate issued by the Local Taxes and Taxes Directorate.The fiscal certificate regarding the payment of taxes, taxes or contributions to the budget must attest the lack of outstanding debts at the time of filing it. Modality of fulfillment and applicability in the procedure: legible copy signed and stamped by the legal representative with the mention "according to the original";

3) the criminal record of the economic operator and of the members of the bodyand the administration, management or supervision of the respective economic operator or of those who have power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / the constitutive document. Method of fulfillment and applicability within the procedure: legible copy signed and stamped by the legal representative with the mention "confo"rm with the original ";

4) as the case may be, documents demonstrating that the economic operator can benefit from the derogations provided in Article 166, Article 167, Article 171 of Law 98/2016 on public procurement.

2) Persons who hold decision functions within the contracting authority are:

The declaration regarding the failure to comply with the provisions of art. 59-60 of Law 98/2016 own model F3.

1) The economic operators submitting the offer must prove a form of registration in the conditions of the law of the country of residence, from which it can be seen that the economic operator islegally constituted, that it is not in any of the situations of cancellation of the constitution as well as the fact that it has the professional capacity to carry out the activities that are the object of the contract. The DUAE will be completed by the economic operators participating in the award procedure with the information related to their situation. The contracting authority will request the supporting documents proving itthe fulfillment of those assumed by completing the DUAE, respectively the certifying certificate issued by ONRC, the information contained in the certifying certificate must be real / current at the time of presentation and from which it can be seen that the object of the contract has correspondent in the CAEN code from the certifying certificate for Romanian legal / natural persons ; or in the case of foreign bidders, equivalent documentsissued to you in the country of residence, will be presented, at the request of the contracting authority, only by the tenderer ranked on the first, second, third place in the ranking prepared at the end of the evaluation of the tenders;

For the first place: if it is found as an offerthey are ranked on the first place with equal prices, the contracting authority will request the re-offer in SEAP, in order to split the offers. The bids will be uploaded to the SEAP by a deadline clearly set (and communicated to the bidders) by the contracting authority. The bidder with the lowest price will be designated the winner. If and after the re-offer the prices offered are equal, then the contracting authority will ask for a new price offer, in SEAP, until the separation can be possible. In the situation where the bidders ranked on the second place, they will have equal price offers, they will be asked for new price offers for. separation, the tenderer ranked on the 1st place (upper place) being not affected in any form, since in the request for separation is mentioned firmlyand unequivocally the second place for which they re-offer. 1) The number of days up to which clarifications can be requested before the deadline for submission of tenders / applications is 21 days;

2) The contracting authority will respond in a cbroad and complete to all requests for clarification / additional information that were addressed within the deadline stipulated in the participation notice, on the 10th day before the deadline for submitting offers / applications. The contracting authority is not obliged to respond to requests for further clarifications / information that have not been addressed within the time limit set in the section invoked further.us
