Comprehensive maintenance services for cleanliness of traction units (combustion and electric) at the following stations: Lębork, Wejherowo, Gdynia Cisowa, Gdańsk Środmieście, Gdańsk Wrzeszcz, Kościerzyna

1. The Employer does not specify any condition in this respect.

2. Contractors should demonstrate no grounds for exclusionfrom art. 24 paragraph 1 and paragraph 5 points 1, 2 and 4 of the PZP Act by submitting:

A) to the offer:

- Single European Order Document (EAT). Instructions for completing can be found at the following internet address: https://www.uzp.gov.pl/__data/assets/pdf_file/0015/32415/InSTRUCTION-wypelENIA-JEDZ-ESPD.pdf.) On the request referred to in Chapter . VI point 12 of the Terms of Reference - information from the National Criminal Register in the scope of definitionsin art. 24 paragraph 1 point 13, 14 and 21 of the PZP Act and, regarding conviction for an offense against imprisonment, to the extent specified by the Employer pursuant to Art. 24 paragraph 5 points 5 and 6 of the PZP Act, issued not earlier than 6 months before the deadline for submitting bids;

- certificate of the competent head of the tax office confirming that the Contractor is not in arrears with payment of taxes, innot earlier than 3 months before the deadline for submission of bids or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in fulldecision of the competent authority,

- certificate of the competent organizational unit of the Social Insurance Institution or the Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with payment of social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other documentconfirming that the Contractor has concluded an agreement with the competent authority on the repayment of these claims together with any interest or fines, in particular, he obtained the exemption provided for by law, deferment or installment of overdue payments or withholding in full the decision of the competent authority,

issue a final court judgment against himor a final administrative decision on arrears in the payment of taxes, fees or social security or health insurance contributions, or - in the event of such a judgment or decision - documents confirming the payment of these receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of these debts,

- excerpt from the relevant register lor from the Central Register and Information on Economic Activity, if separate provisions require an entry in the register or the register, in order to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 item 1 of the PZP Act,

- the Contractor`s statement regarding art. 24 paragraph 5 point 2 of the PZP Act,

- the Contractor`s statement regarding art. 24 paragraph 5 point 4 of the PZP Act,

- the Contractor`s statement on the lack of a judgmentas a precautionary measure the prohibition of applying for public contracts,

- the Contractor`s statement on belonging or not belonging to the same capital group; in the case of belonging to the same capital group, the Contractor may submit together with a declaration documents or information confirming that links with another Contractor do not lead to distortion of competition inproceedings.

c.d. in part VI.3) - additional information

In terms of economic or financial situation, the Contractor must demonstrate that:

Has financial resources or creditworthiness in the amount of not less than PLN 500, 000 (five hundred thousand zlotys) and has current civil liability insurance in the scope business activity related to the subject of the contractfor a guarantee sum of not less than PLN 1, 000, 000 (one million zlotys). The Contractor is required to have a policy of the above value during the term of the contract.

In the case of Contractors submitting a joint bid, the conditions set out in points 1) and 2) may be met jointly.

I. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the dockment referred to in -5

Regulations:

1) within the scope of - 5 item 1 of the Regulation - submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence or place of residence has a person whose information or document relates to the extentspecified in art. 24 paragraph 1 item 13, 14 and 21 of the PZP Act;

2) within the scope of - 5 items 2-4 of the Regulation - submits a document or documents issued in the country in which the Contractor has its registered office or place of residence, confirming respectively that:

a) no is in arrears with the payment of taxes, fees, social security or health contributions, or that he has entered into an agreement with the competent authority regarding the repayment of thesereceivables, together with any interest or fines, in particular, obtained by law exemption, deferment or distribution in installments of overdue payments or withholding in full the execution of the decision of the competent authority,

b) its liquidation has not been opened or bankruptcy has been declared.

3) Documents about which referred to above in item 1; point 2 lit. b), should be issued not earlier than 6 monthsęcy before the submission deadline. The document referred to in item 2 (a) above should be issued not earlier than 3 months before the expiry of that period.

4) If in the country in which the Contractor has its registered office or place of residence or domicile, the person to whom the document relates, no documents referred to in para. 1 shall be replaced by a document containingrespectively the Contractor`s statement, indicating the person or persons authorized to represent it, or the statement of the person to whom the document was to relate, made before a notary public or before a judicial, administrative or professional or economic self-government body competent for the seat or place of residence of the Contractor or place of residence this person. The provision of para. 2 Rthe regulations apply.

5) In the event of doubts as to the content of a document submitted by the Contractor, the Employer may contact the competent authorities of the country in which the Contractor has its registered office or place of residence or the place of residence of the person to whom the document relates, for providing necessary information regarding this document,

6) Contractor based in the territory of the Republic of Polandof the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in -5 point 1 of the Regulation applies, shall submit the document referred to in - 7 para. 1 point 1 of the Regulation, to the extent specified in art. 24 paragraph 1 item 14 and 21 of the PPL Act.

If in the country in which the person to whom the document was to reside has a place of residence, not insuch documents are added, it is replaced with a document containing the person`s statement submitted before a notary public or before a judicial, administrative or professional or economic self-government body competent for the place of residence of that person. The provision of -7 para. 2, first sentence shall apply.

7) In case of doubts as to the content of the document submitted by the Contractor, Zamathe believer may request the competent authorities of the country in which the person to whom the document resides, to provide the necessary information regarding that document. II. The Employer, in terms of documents submitted to assess the non-exclusion and fulfillment of the conditions for participation in the proceedings by the Contractor, may first evaluate the offers and then examine whether thethe applicant whose offer has been assessed as the most favorable, is not subject to exclusion and meets the conditions for participation in the proceedings.
