For internal and external surface cleaning services for the District Court in Lublin and functional courts

The subject of the contract are cleaning services for internal and external surfaces for the District Courtin Lublin (including the Judicial Specialist Teams in Lublin, Chełm and Biała Podlaska) and the internal or external surfaces of the functional courts subordinate to it: District Courts: in Włodawa, Ryki, Opole Lubelskie, Kraśnik and Lubart-w.

Main Site: Court Okręgowy in Lublin in locations: at ul. Krakowskie Przedmieście 43, Krakowskie Przedmieście 47, Cz. Squareechowicza 1 and ul. Chopina 14.

Task I includes cleaning internal and external surfaces (including maintenance of green areas) in the buildings of the District Court in Lublin in the following locations: ul. Krakowskie Przedmieście 43, Krakowskie Przedmieście 47, plac Czechowicza 1 and ul. Chopin 14.

A. internal space - premises of the District Court in Lublin in the building at ul. Cracowskie Przedmieście 43 (pylon A, B, historical part) with a total area of 6529.13 m,

B. internal space - premises of the District Court in Lublin in the building at ul. Krakowskie Przedmieście 47 in Lublin with a total office space of 1740.40 m,

C. internal space - rooms of the District Court in Lublin, building at Pl. Czechowicza 1 in Lublin with a total area of aboutoffice supplies 3258, 60 m,

D. internal space - rooms rented by the District Court in Lublin in the building at ul. Chopina 14 in Lublin for the Opinion Team of Court Specialists in Lublin with a total area of office rooms 274.00m,

E. external surface - walkway and stairs in front of the building (2 m from the building wall) from ul. Krakowskie Przedmieście 43, areaat the car park located on the side of the building at ul. Krakowskie Przedmieście 43 (entrance from ul. Krakowskie Przedmieście), the parking lot located at ul. Krakowskie Przedmieście 43 (entrance from ul. Żdzielrzy Niepodała), stairs leading to the building from ul. Evangelical and green areas of the property in Lublin with a total area of 3080.00m (cube area - 2052m, green area- 1028m).

F. external surface - pavement in front of the building (2 m from the building wall) and a car park located at the back of the building at ul. Krakowskie Przedmieście 47 in Lublin with a total area of 410.00m,

G. external surface - pavement in front of the building and a car park located on the side of the building at Pl. Czechowicza 1 in Lublin with an area of 501.66 sq m.

Detailed description of the subject of the order inbelieves in Annex No. 1.1 to the ToR.

The cleaning service will also be carried out using equipment for maintaining cleanliness, which the Employer has (Annex No. 1 to Annex No. 1.1 to the ToR) made available to the Contractor for the duration of the service / contract, provided that the Contractor the fact that they are made available by the Employer, calculating the price of the offer.

Contractor who:

1) are not subject to exclusion in the circumstances referred to in art. 24 paragraph 1 of the Act,

2) meet the conditions for participation in the proceedings regarding: technical and professional ability - the Awarding Entity shall specify in the manner indicated in section III.1.3 Technical and professional capacity of this Announcement.

I. To confirm compliance with the conditions for participation in the proceedings regardingawarding the contract and demonstrating the absence of grounds for exclusion, the Employer requests that each Contractor submit together with the offer the following documents and statements:

1) current as at the date of submitting the offers, a statement in the form of a single European order document (EED) to the extent indicated in Annex 4 to the Terms of Reference. The information contained in the statement will constitute preliminary confirmation that youthe contractor is not subject to exclusion from the procedure and meets the conditions for participation in the procedure (attached specimen form for possible use - Annexes 4 to the ToR);

2) in the case of joint application for the Contractors by the Contractors, the declaration referred to in item 1 submits each of the Contractors jointly applying for the contract. The statement referred to in item 1 has confirmationfulfillment of the conditions for participation in the proceedings and no grounds for exclusion.

3) Contractor who relies on the resources of other entities in order to demonstrate the absence of grounds for exclusion and compliance with them - to the extent that their conditions of participation in proceedings, also submits the declaration (EAT) referred to in item 1 regarding these entities.

4) If Wthe contractor intends to entrust the performance of part of the contract to Subcontractors in order to demonstrate the absence of grounds for exclusion from their participation in the proceedings, submits the declaration (EAT) referred to in point 1 regarding these subcontractors.

5) Contractor who to confirm compliance with the conditions for participation in proceedings, where appropriate, and in relation to a specific contract, orits part consists in the technical or professional abilities of other entities, irrespective of the legal nature of the legal relations between it and it, it is obliged to submit with the offer an undertaking of these entities to provide it with the necessary resources at the disposal of the needs of the order.

Rules for making statements in the form Single European Order Document (EAT), referred to in point I item 1) 4), specifies -7 section 2 of the ToR. 24 paragraph 1 point 13) 23) or has not demonstrated the absence of grounds for exclusion referred to in art. 24 paragraph 5 points 1), 5) - 8) of the Act.

The Awarding Entity, before awarding the order, will call the Contractor whose tender has been rated the highest to submit, within a designated period, not shorter than 10 days, valid as at the date of submission, the following statements and documents confirming the circumstances referred to in art. 24 section 1 items 13) -22) and section 5 items 1), 5) 8) of the Act with respect to the Contractor, any subcontractors and the entityow, whose abilities or situation relate to the Contractor, and described by the Employer in - 6 para. 3-7 SIWZ.

The Employer does not specify a detailed condition in this respect;

Information on the processing and protection of personal data for participants of the public procurement procedure, the Employer specifies in accordance with the documents of the order in - 20. SIWZ.

NOTE: The Employer informs thate pursuant to art. 24 aa paragraph 1 of the Act, will first evaluate the offers and then examine whether the Contractor whose offer has been assessed as the most advantageous, is not subject to exclusion and meets the conditions for participation in the procedure. The Employer will award a public contract to the Contractor whose offer during the evaluation of the offers will not be rejected and will be considered the most advantageous, i.e. it will receive the largestwrong number of points on the basis of criteria described in for a given Task in - 13, -13 and SIWZ respectively. However, if the Contractor referred to in sentence 2 evades concluding the contract or fails to provide the required security for the contract, the Employer may examine whether it is not subject to exclusion and whether it meets the conditions for participation in the procedure. The Contractor who submitted the highest-rated offer among the othersoffers in order to conclude a contract with him. The Employer indicates that by the phrase "has submitted the highest rated offer among the other offers", it means the next offer in the ranking, and declares that in the situation referred to in sentence 3 the Employer does not position the offers again.

If the contractor has its seat or place living outside the territory of the Republic of Poland may submit a documentin accordance with the provisions of - 6 para. 4 - 7 of the SETC. 22 - 1 of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2019, item 1040, as amended), then the Employer requires that these activities be performed by persons employed by the Contractor (Subcontractor) on the basis of a contract for work.

Activebones referred to in art. 22 - 1 of the Code of Civil Procedure The Employer considers in particular daily cleaning activities, i.e. cleaning services, which, according to the description of the subject of the order, should be performed at least every day working for the Employer. Consequently, the Employer requires that the abovementioned persons carrying out cleaning activities directly were employed under a contract of employment by prsquint the entire duration of the contract. Thus, this requirement applies to persons who perform activities directly related to the implementation of the subject of the contract in the number of persons necessary to implement the subject of the contract if the performance of these activities involves the performance of work within the meaning of the provisions of the Labor Code, unless these activities are not performed by a person as part of probusiness failure.

II.For the Contractor or subcontractor`s failure to meet the employment requirement under the employment contract for persons performing the activities specified in item I, the Employer provides for a sanction in the form of the Contractor`s obligation to pay a contractual penalty in the amount specified in the provisions contained in the model contracts, constituting the relevant Annex No. 6.1, 6.2, 6.3, 6.4to the ToR. Failure by the Contractor to submit the evidence requested by the Employer within the time limit set by the Employer in order to confirm that the Contractor or the subcontractor has met the employment requirement under the employment contract will be treated as the failure by the Contractor or the subcontractor to employ under the employment contract persons performing the activities specified in point I.
