More detailed specification can be found in the tender documents. 1 of the Public Procurement Act Tenderer proves fulfillment of conditions of participation concerning personalposition according to - 32 par. 1 of the Public Procurement Act, documents pursuant to - 32 par. 2 of the Public Procurement Act, resp. according to - 32 par.

The economic operator may provisionally replace the documents proving the fulfillment of the conditions of participation in JED pursuant to - 39 para. 1 of the Act on Public Procurement or Affidavit. Demonstration of participation conditions is against the publicthe contracting authority shall also do so according to - 152 para.

The tenderer registered in the list of economic entities pursuant to the Public Procurement Act is not obliged to submit documents pursuant to - 32 para. 2 of the Public Procurement Act. The contracting authority shall recognize an equivalent entry as entered in the list of economic operators under theor a certificate of registration issued to the competent authorities of another Member State, by which the tenderer proves that the conditions for participation in the tendering procedure have been fulfilled. The contracting authority shall also accept other equivalent documents submitted by the tenderer.i. In the case of a tenderer consisting of a group of suppliers participating in a public procurement procedure, it is required to show compliance with the conditions for participation in respect of personal status for each member of the group separately. Fulfillment of participation requirement according to - 32 par. 1 pism. (e) the public procurement act shall be shown by a member of the group only in respect of that part of the subject-matter of the contract which it is intended to secure.if the applicant fails to prove that the conditions for participation in accordance with - 152 para. 4 of the Public Procurement Act, but submits documents pursuant to - 32 para. 2 of the Public Procurement Act, the contracting authority draws attention to the fact that the tenderer is not obliged to submit documents pursuant to - 32 para. 2. pism. a) and pism. (e) the Public Procurement Act, as the contracting authority is entitled to use the data from the infoof public administration systems. If the applicant fails to submit a document pursuant to - 32 para. 2 pism. a) of the Public Procurement Act, it is obliged to prove the conditions according to - 32 par. 1 pism. (a) a public procurement law to provide the contracting authority with the data necessary to request an extract from the criminal record. The condition referred to in - 32 para. 2 pism. a) the Public Procurement Act does not apply to r- 2.1 of - 33 para. 1 pism. a) the law: statements of a bank or branch of a foreign bank

2.2. The applicant can prove financial and economic positionto use another person`s financial resources, regardless of their true relationship. In such a case, the tenderer must prove to the contracting authority that, in performing the contract, he will actually use the resources of the person whose position he is using to prove his financial and economic position. According to the second sentence, the applicant proves the fact by a written contract concluded with the person whose sources he intends to prove his finfinancial and economic position. The written contract must give rise to an obligation on the part of the person to provide performance for the entire duration of the contractual relationship. The person whose resources are to be used to prove financial and economic status must demonstrate compliance with the conditions for participation in relation to personal status, with the exception of - 32 para. 1 pism. e) and there must be no grounds for exclusion pursuant to - 40 para. 6 pism. a)to h) and para. 7.

03.02 If, for objective reasons, the tenderer is unable to provide a document intended to prove financial and economic standing to the contracting authority, he may prove his financial and economic position by submitting another document which the contracting authority considers appropriate. In this case, the contracting authority recommends the use of an explanatory institute. The applicant, who is a groupproves that the conditions for participation in public procurement concerning the financial and economic position together are fulfilled. The applicant may pre-replace the documents proving the fulfillment of the conditions of participation by means of JED pursuant to - 39 par. 1 Public Procurement Act

1. Communication and exchange of information in public procurement is carried out in writing, by electronic means within the meaning of - 20 of Act 343/2015 ZVO. Communication including delivery for the purposes of this public procurement will be carried out in the manner determined by the functionality of the electronic tool eZakazky on the portal www.ezakazky.sk. I will register the competition documents for everyoneto the interested person available on the electronic communication portal www.ezakazky.sk without limitation. Method of requesting and providing the tender documents:

a) the economic operator enters into the internet search engine the electronic address www.ezakazky.sk,

b) clicks on the name of the contract,

c) clicks on the application / tender documents,

d) logs in into the system in the following way:

d1) if it already managesIn case of forgotten login data, the operator has to log in directly with his already provided login data (in case of forgotten login data he / she can choose to send login data electronically to the electronic address;

d2) according to the instructions given for registration in the system directly on the Internetwww.ezakazky.sk. I will open the tender documents and all other documents related to the tender documents to the contracting authority for elaboration of the offer in the electronic system at the address www.ezakazky.sk.All interested parties may ask any interested parties in advance of their explanation directly through the electronic system www.ezakazky.sk

The request for explanation must be delivered via the electronic communication portal www.ezakazky.sk. delivered to the email address of the public procurement contactavatele resp. otherwise. The above procedure shall also apply if the economic operator obtains the tender documents from the Contracting Authority`s profile or otherwise. The aforementioned mandatory registration procedure shall also apply if the economic operator obtains the tender documents from the Contracting Authority`s profile on the UVO site or in any other way. Within the same principleand the principle of transparency, the contracting authority has determined the above-mentioned means of communication, the other means of communication will not be taken into account by the contracting authority if the contracting authority has not clarified other individual means of communication in the specific case. Further details regarding electronic communication are given in the competition documents. becauseo Operator of the Procurement Journal in the form of invitation to tender / notice of invitation to tender limits the number of characters that can be entered in this form in the field with a text attribute; Detailed definition and designation of service of documents and communication with candidates and tenderersand in the supporting documents. For this reason, only the communication portal was mentioned in the text of the Announcements and the basic rules for requesting documents or requests for explanation. The tenderer shall submit in his tender the fulfillment of the conditions of participation, the declaration of honor, the requirements for the subject of the contract specified in the tender documents and other documents required in the tender documents. Ver. procurer reserveit shall not be entitled to accept a successful tender if the tenderer `s proposed price is higher than the estimated value of the contract. Pursuant to - 66 par. 7 ZVO, the contracting authority decided that the evaluation of the fulfillment of the conditions of participation would be carried out after the evaluation of the tenders.
