Tenderers submitting tenders will show mandatory evidence in SEAPof the guarantee for participation, scanned up to the closing date and time of submission of tenders, in accordance with art. 42 para. (7) of GD 394/2016.

The period of validity of the guarantee for participation: 90 days from the deadline for submission of tenders.

How to set up the guarantee for participation:

1) The participation guarantee is expressed in lei, will be compulsorily uploaded to SEAPup to the closing date and time limit for the submission of tenders and may be set up as follows:

- bank transfer or OP on the account RO08RNCB0231019525330001 opened at BCR Mediaş,

- by a guarantee instrument issued under the law of a banking company or a company 2) The guarantee must be irrevocable; 3) The guarantee instrument must stipulate that the payment-the guarantee will be executed unconditionally, ie at the first request of the beneficiary, on the basis of his / her statement regarding the guilt of the person to whom the guarantee is based. the bidder is in one of the situations provided by art. 43 par. (1) of-HG 394 / 2016.

The guarantee is returned according to art. 44 of GG 394 / 2016.

The amount of the performance guarantee shall be 10% of the value of the subsequent contract, VAT excluded. The period of validity of the performance guarantee is equal to the duration of the subsequent contract.

The guarantee of the good execution of the supply contract is constituted according to art. 46 of H.G. 394/2016, after withm follows:

- The guarantee of good execution is constituted by a guarantee instrument issued under the law by a bank or an insurance company, according to art. 46 par. (1) of GD 394/2016 or by successive deductions from the amounts due for partial invoices, under the conditions stipulated in art. 46 par. (3) of GD 394 / 2016.

If the guarantee of good execution is made upby successive deductions from the amounts due for partial invoices, the contractor has the obligation to open to the State Treasury unit within the competent fiscal body to manage a separate disposable account at the disposal of the contracting entity. Initial amount to be deposited by the vendor in the available account thus opened under Art. 46 par. (4) and (5)-of GD 394/2016, shall not be less than 0.5% of the contract price, exclusive of VAT. During the fulfillment of the contract, the contracting entity shall feed the available account provided in art. 46 par. (4) and (5) of GD 394/2016 by successive deductions from the amounts owed and due to the supplier up to the amount set as a guarantee of good execution in the contract and vto notify the supplier of the payment made and of its destination.

The contracting entity has the obligation to return the performance guarantee in no more than 14 days from the date of fulfillment by the contractor of the obligations assumed under the subsequent contract, if it has not lifted up to that date claims on it.

- In the case of prior notification or appeal, as the case may be-will apply the provisions of Law no. 101/2016,

- Requests for clarification of potential bidders will exclusively address SEAP in the "Questions" section of the award procedure by electronic means and the responses to them will be published in the SEAP, in the "Documentation and Clarification" section "of the contract notice, the contracting entity following the contractdoes not respond to requests addressed by means of communication other than that established in accordance with the provisions of art. 78 par. (1) of the Law no. 99/2016 for post-submission submissions. The evaluation committee will submit requests for clarification of the submitted offers in the SEAP in the "Questions" section.
