Catering, accommodation and rental of transport vehicles for persons with a driver will aim to facilitate the smooth running of the CVT courses of the employees from the relevant areas of the center region within the project "First - Performance and innovation in manPUBLIC PROJECTS IN THE FIELD OF FINANCING CONTRACT.

Purchase of food for 1 010 participants in 54 of events, including 2 coffee breaks and a lunch, which will aim to facilitate the smooth running of the 30 events in the awareness campaignto the beneficiaries regarding the importance and necessity of continuous professional training and the 18 intensive specialization events in the field of strategic management and of the 6 events (workshops, seminars, conferences and other events) on the topic of human resources management in the Center Region within the project "Prim - Performance and Innovation in Management" according to cu Requirements 1: The bidders, the supporting third parties and the subcontractors must not find themselves in the situations stipulated in art. 164, art. 165, art. 167 of Law no. 98 / 2016.

The way of demonstrating the fulfillment of the requirement:

Initially to be completed and presented by the economic operators participating in the award procedure with the relevant informationto their situation (including associates / subcontractors / thirds supporters) as evidence of non-compliance in the situations referred to in art. 164, art. 165, art. 167 of Law no. 98 / 2016.

The supporting documents demonstrating the fulfillment those assumed by-the completion of the DUAE is to be submitted, at the request of the contracting authority, only by the tenderers with whom the contract will be concluded at the completion of the evaluation of the tenders, respectively those placed first.

These documents may be:

(a) certificate regarding the lack of overdue debts to pay taxes, duties or contributions to the consolidated general budget (local budget, stat the date of presentation of the document, (b) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016,

(c) other documents, as appropriate.

The information presented must be actual / current at the time of submission.

(s), the association agreement and the subcontracting agreement, and the supporting documents for them must be submitted at the request of the evaluation committee only by the tenderers ranked first. Note 1: For foreign legal entities, the economic operator will present enforceable documents (certificates, criminal records)e, other equivalent documents) to prove that he has fulfilled his outstanding payment obligations regarding the payment of taxes, duties and contributions to the consolidated general budget (local budget, state budget, etc.) at the moment of their submission. Documents will be submitted by authorized translation in Romanian. Note 2: If in the country of origin or in the country where it is-the established tenderer has no legal provisions regarding the declaration on his / her own responsibility, an authentic declaration is accepted in front of a notary, an administrative or judicial authority or a professional association with competence in this respect. Note 3: Natural or legal persons foreigners and novels carrying out activities abroad must submit documentsas evidencing the eligibility and obligations to pay the taxes and duties to the State in accordance with the requirements requested by the contracting authority. The following will be accepted: Certificates - or equivalent, legal record - or equivalent, statements made on your own responsibility in front of a notary, administrative or judicial authorities or professional associations.non-resident economic agents (foreigners) have the right to present any editorial documents issued by the authorities of the country of origin (certificates, criminal records, other editorial documents) to prove their membership / registration with the authorities of the country concerned and to prove the fulfillment of the payment obligations of taxes, duties and contributions to the state budget

Regarding the legally exigible term of debts to the state budget, foreign tenderers will prove the fulfillment of their payment obligations in accordance with the legislation of the country of residence. 2) The technical and / or professional capacity can be proven by supporting, according to the provisions of art. 182 par. (1) of Law 98/2016. If the tenderer demonstrates his technical and professional capacity by invoking the support given by another person, then he has the obligation to prove his / her supportby presenting a firm commitment of that person. The engagement must be explicit, written and unconditional, specifying unequivocally the requirement for which the third party understands to give support, as well as the concrete way of granting the support, in accordance with the law. With the commitment to support, the bidder has the obligation to submit documents sent to him by the third party(s) supporting the actual manner in which the third party / supporter / supporter will ensure the fulfillment of his / her own support commitment, documents that will be annexed to the engagement. The firm commitment presented by the bidder must state what resources are being sustained and highlight that the redundancieswill be made unconditionally depending on the needs that arise during the fulfillment of the contract in question, under the terms and conditions thereof. When the bidder demonstrates that the qualification requirement related to technical and / or professional capacity has been met by invoking the support given by one or more third parties, his / her capacity will be cumulated with that ofof the tenderer with respect to the respective requirements.

The person who ensures the technical and professional support must not be in the situation that leads to exclusion from the award procedure according to the provisions of art. 164, art. 165 and 167 of Law 98 / 2016.

- The DUAE will be filled in by the economic operators participating in the award procedure (including any third parties) with infothe rhythms associated with their situation. Along with the DUAE, the commitment of the third party, along with the documents, will be attached to the engagement, forwarded to them by the third party / supporter, which will show the actual manner in which the support will be materialized - Form no. 5;

3) Information on Associations (if applicable): Offer submitted by an association of economic operators-must meet the following requirements: - The tender must include an Association Agreement, - - The structure of the association will not be altered during the execution of the contract, except with the prior approval of the contracting authority.

If the winning bid is declared by a group (association) of several economic operators, they will legalize their association before-signature of the contract

In the case of an association, each associate will submit the required documents in section III.2.1) Personal situation of the economic operators, including requirements related to enrollment in the trade or profession register
