The scope of the contract is the provision of complete services: ) through pallet trucks, warehouse goods, mainly paper and educational books, within the(b) picking and re-packaging the teaching books to be distributed in the school year 2019 - 2020 in the schools of the country or will be made available to foreign schools or to non-supervisors of the Ministry of Education, etc., who are entitled to educational books, as well as toTrade

14.3.1 The economic operators concerned are required to carry out a professional activity related to the subject of the services to be provided, namely to provide warehousing and sorting and re-packaging services and to have demonstrated abilities in the execution of the contract(if it is a single natural or legal person) or one of its members (if it is a syndicate), it is excluded from participation in the current tendering process (tendering procedure) of an economic operator shape) for one or more of the following reasons:

13.1 Where there is an amateur(a) participation in a criminal organization as defined in Article 2 of Council Framework Decision 2008/841 / JHA of 24 October 2008 on the fight against organized crime (OJ L 300, p. 13.2 Where the offeror has breached his obligations regarding the payment of taxes or social security contributionsand this has been established by a judicial or administrative decision of final and binding force, in accordance with the provisions of the country in which it is established or national legislation and / or where the contracting authority can demonstrate by appropriate means that the tenderer has breached his obligations with regard to the payment of taxes or social security contributions. Also, when the Contracting Authority is aware(aa) three (3) fines by the competent auditing authorities of the Member State of affiliation, or by the appropriate means to prove that they have been imposed against the economic operator within two years before the closing date for the submission of a bid: bodies of the Labor Inspectorate for violations of labor law that are classified, in accordance with Ministerial Decision(b) two (2) fines imposed by the competent Audit Institutions of the Audit Body (B 266) as applicable or as a matter of gravity, resulting cumulatively from three (3) Labor for labor law offenses related to undeclared work, which arise cumulatively from two (2) checks carried out. Those under aa-and bb sanctions must have acquired a final and binding force.

If the tenderer is a Greek citizen or has his place of residence in Greece, his obligations regarding social security contributions cover both the principal and the supplementary insurance. the tenderer who has fulfilled his obligations either by paying the taxes or what he has to paythe social security contributions payable, including, where applicable, accrued interest or fines, whether subject to a binding settlement for payment.

Exceptionally, the tenderer is not excluded when the exclusion would be clearly disproportionate, small amounts of taxes or social security contributions have not been paid or when the economic operator-he was informed about the exact amount due for failing to pay his taxes or social security contributions at a time when he was unable to take measures in accordance with the last sentence of paragraph 2 of Article 73 of Law 4412 / 2016, before expiry of the deadline for submitting a bid.

13.3 Excluded from participation in the procedure(a) if it has failed to fulfill the obligations laid down in paragraph 2 of Article 18 of Law 4412/2016; (b) if it is bankrupt or has become insolvent; has been the subject of a reorganization or special liquidation procedure or is being sued by a liquidator or by the court or has been put on trialor has suspended business activities or is in any analogous situation arising from a similar procedure provided for in national law. The contracting authority may not exclude an economic operator in one of the situations referred to in that case, provided that it proves that the(c) if it has demonstrated a serious or repeated irregularity in the execution of an essential claim under a prior public contract, a prior agreement with a contracting entity or previous concession contract resulting in the-(d) if it has been found guilty of serious misrepresentation in supplying the information necessary to ascertain the absence of grounds for exclusion or the fulfillment of the selection criteria, or if it has disguised (e) if it attempted to unfairly influence the decision-making processof the contracting authority to obtain confidential information which may give him an undue advantage in the contract award procedure or to provide misleading information that may materially affect decisions concerning exclusion, selection or award; serious professional misconduct, which casts doubt on the integrityfor which a penalty has been imposed which deprives him of the right to participate in a public works contract and takes over the specific procedure.

The contracting authority may not exclude an economic operator who is in one of the situations referred to in (b), provided that it is proved that the entity in question is able to perform thecontract, taking into account the provisions in force and the measures for the continuation of its business operation.

To the preliminary proof that the bidders are not in one of the aforementioned statements of par. 13.1, 13.2 and 13.3, they submit at the submission of the of their bid in the Document for the submission of a Technical Offer as a supporting documentthe European Convention for the Protection of Human Rights and Fundamental Freedoms (EEAS), as provided for in Article 79 (1) and (3) of Law 4412/2016, in accordance with the annexed Annex VI, which is an up-to-date statement with the consequences of Law 1599 / 1986. The EUSR shall be drawn up on the basis of the standard form set out in Annex 2 to Regulation (EC) 2016/7 and supplemented by the tenderersin accordance with the instructions in Annex 1.
