Bulldozer delivery according to the requirements of the specifications.

Main Site: A.B.A.D.L., Bulevardul Mamaia nr. 300, Constanta, Constanta county.

Delivery 1 buc. bulldozer, as required by the specifications.

Bidders, third parties and subcontractors should not find themselves in the situations referred to in art. 164, 165, 167 of Law no. 98 / 2016.

The manner by which the fulfillment of the requirement can be demonstrated: It will be completed by the economic operators participating in the award procedure with information related to their situation. Dthe supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted at the request of the contracting authority, only by the bidder placed on the first place in the interim ranking made at the completion of the tender evaluation. These documents may be:

1) certificates of absence of overdue debts in respect of the payment of taxes, duties or-(2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of those having the power representation, decision-making or control within it, as evidenced by the certifying certificate-issued by the ONRC / constitutive act; 3) as the case may be, documents demonstrating that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Law 98/2016

4) Other editing documents, as appropriate

Avoidance of conflict of interests

The tenderer / the associated tenderer / the subcontractor / the supporting party mustnot to be in a situation of conflict of interest and / or unfair competition.

The manner of fulfillment and applicability in the procedure:

- The Tenderer / Tenderer / Subcontractor / Tenderer will present the AUAE confirming that the economic operator is not in none of the situations provided in art. 59 and 60 of Law no. 98/2006 on public procurement. If the offer is submitted by an association, each associate will submit the above mentioned documents. Also, these documents must also be submitted by each of the subcontractors / third-party supporters declared by the tender.

In case the economic operator (bidder / affiliate / subcontractor / third party) is in one of the situations stipulated in art. 60 of Law no. 98 /2016 on public procurement, it will be excluded from the awarding procedure, the offer being rejected.

The economic operators submitting the tender must prove a form of registration under the law of the country of residence, from which it appears that the economic operator is legally established, that he is not in any of the situations of cancellation of establishment and that he has a capacityshe is professional to carry out the activities that are the subject of the contract

How to demonstrate the fulfillment of the requirement:

The DUAE will be filled by the economic operators participating in the award procedure with the information related to their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certificate issued by ONRC or, in the case of foreign tenderers, equivalent documents issued in the country of residence, [...] details on www.e-licitatie.ro.

Any answers to the clarifications will be attached to the contract notice. These responses will be part of the awarding documentation, and it is imperative that the offer be considered. If the first place in the price list are bidders withequal pricing will require clarification on SEAP new financial offers that may be equal to or lower than initial ones.

These bidders will upload the documents containing new financial proposals to SEAP. Several economic operators have the right to associate with the purpose of submitting the joint offer, having the obligation to formally legalize them asoonly if the joint tender will be declared winner. When a group of economic operators submits the joint offer, the technical and professional capacity is demonstrated by taking into account the resources of all the members of the group.
