Updated 907/2016. The contracting authority will respond clearly and completely to all clarification requests / additional information on the 11th day before the deadline set for the submission of tenders, as requestedthe Member States shall address at least 20 days before the deadline set for the submission of tenders. Clarifications submitted after this term will no longer be considered.

Main Site: The Passover of the Lovers near Children's Park - Timisoara and, as the case may be, at the headquarters of the contracting authority or at the headquarters of the provider.

Based on the contract, elaboration services will be provided and doc(a) Feasibility study elaboration, b) Elaboration of the technical project, specifications, execution details (including documentation for the obtaining of opinions) and technical assistance from the designer during the execution of the works . All services will be delivered in accordance with the requirements of the design theme-and of the conceptual note

Timisoara shall exclude any economic operator who is in one of the situations provided for in art. 60, 164, 165 and 167 of Law 98/2016, with the latest additions and modifications, regarding public procurement.

Exclusion reasons will also be applied to associates / subcontractors / third partiesIf the bid is rejected as unacceptable, each economic operator participating in the awarding procedure (tenderer, affiliate tenderer, subcontractor, third party, as the case may be) will present, together with the offer, the completed DUAE with information about their situation.

In addition, they will be presented both on their own responsibilityregarding non-compliance with the provisions of art. 60 of Law no. 98/2016, with the latest additions and modifications, as well as, if necessary, the firm commitment of the third party, accompanied by documents showing the actual manner in which its sustainability, subcontracting agreement and / or association agreement will materialize.

The supporting documents proving the fulfillment of those assumed bycompletion of the DUAE is to be submitted, only at the request of the contracting authority, by the tenderer first placed after applying the award criterion for the admissible tenders.

The supporting documents may be:

1) certificates regarding the lack of debts, regarding the payment of taxes or contributions to the consolidated general budget (local budget, state budget) 2) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of the persons having the power of representation, decision or control within it, so as evidenced by the certifying certificate issued by the ONRC / constitutive act, 3) as the case may be, documents demonstratingthat the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/2016, with the latest additions and modifications, regarding the public acquisitions, 4) other editorial documents, as the case may be

The requested documents will be presented in Romanian language / language in which they were issued, accompanied by the translation into Romanian, as the case may be.

1) In cthe documents attached to the participation announcement, DUAE is made available to economic operators interested in editable format, in order to complete it by the bidders. The participating economic operators will fill in this document with the information / answers related to the inclusion / non-compliance for the reasons for exclusion, respectively the fulfillment of the qualification criteria requested by theto the contracting authority that has a correspondent at the level of the acquisition data sheet (where it is explicitly stated) and will not have the right to intervene on the DUAE format, respectively on the requirements imposed by the contracting authority, 2) For the visualization of the attached documents, the economic operators must has a program required to view the electronically signed files;

3) Operatoeconomic entities have the right to submit the offer (complete DUAE, declaration on non-compliance with the provisions of Article 60 of Law No. 98/2016, with the latest amendments and completions, the Technical Proposal, the Financial Proposal, the document proving the participation guarantee and, if is the case, the Third Party Support Commitment, the Association Agreements and / or the Subcontracting Agreementsonly in electronic format, signed with extended electronic signature and only until the deadline and deadline set for the submission of tenders in the tender notice; 4) Requests for clarification regarding this tender documentation will be addressed exclusively in SEAP in the award procedure conducted by electronic means, the contracting authority shall follow-do not respond to requests addressed by another means of communication than the one established. Any interested economic operator has the right to request clarification or additional information in relation to the awarding documentation, in compliance with the deadline specified by the contracting authority in chapter II.1.4) of this document, not later than 20 days before youthe limit set for receipt of tenders. Clarifications submitted after this deadline will no longer be taken into account. According to art. 160 161 of Law 98/2016, with the latest additions and modifications, the contracting authority will respond in a clear and complete way to all clarification requests / additional information on the 11th day before the deadline set for the receipt of theto the extent that they will be addressed at least 20 days before the deadline set for receipt of tenders. The answers to the requested clarifications will be published in the SEAP within the tender notice; 5) If the contracting authority requests the submission of certain clarifications / completions for the purpose of checking the compliance of the offer with the required requirements, both the request and the bidder's response are transmitted in SEAP, only in electronic format, signed with the extended electronic signature. If the bidder's response is posted in SEAP without the extended electronic signature, its offer will be assimilated to the provisions of Art. 137 par. (2) lit. j) from H.G. 395/2016, with the latest additions and modifications being rejected as unacceptable; 6) Yesas a result of applying the "lowest price" award criterion, it is found that two or more first-ranked offers contain equal prices, excluding VAT, new financial proposals will be required through SEAP. If this is not feasible for reasons attributable to the operator SEAP, a new off-line financial proposal will be requested from bidders.
