3.3. The contracting authority requires the implementation of the subject of the contract on the terms set out in the contracts, which form attachments to the ToR.

3.4. According to art. 13 para. 1 and 2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council ofia

5.1 The contractors who are:

1) can not be excluded,

2) meet the conditionsu in the proceedings, if they have been specified by the ordering party - In the contract notice or in the invitation to confirm interest.

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject toand exclusion based on art. 24 sec. 1 points 13 and 14 and 16-20 Pzp,

Art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove the remedy for damage caused by a crime or fiscal offense, financial compensation for the harm suffered or remedy the damage, explaining the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The Ordering Party will investigate whether the Contractor whose offerdaluated as the most advantageous, it is not subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Employer defines the following conditions for participation in the proceedings:

1) the condition of competences or entitlements to conduct a specific professional activity, if it results from separate regulations, i.e.: Ordering no particularsrequires the participation in the proceedings in this respect. - Contractors jointly applying for the award of the contract, referred to in art. 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 1 of the PzP.

Each contractor is obliged to enclose with the offer:

1 The Contractor's statement (Uniform European Order Document) as at the day of submitting the offers.

- prepared according to the formulait is attached to the ToR,

- submitted in electronic form, with a qualified electronic signature.

The information contained in the declaration will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the proceedings.

Statements of entities submitting a joint bid and entities making the potential available on the EAT form in the form of a dockshould be signed with a qualified electronic signature by each of them to the extent that they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. An equivalent requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 point 1 of the Public Procurement Law - In the case of Contractors jointly applying for the award of a document, this documentwill give each of the Contractors jointly applying for the order or on their behalf a plenipotentiary of the Contractor submits, - the Contractor who intends to entrust the execution of a part of the contract to subcontractors, in order to demonstrate the lack of existence of grounds for exclusion from participation in the proceedings submits the statement referred to in this specification point, for each subcontractor.

5.1 Contract award may be applied by contractors who:

1) are not subject to exclusion,

2) meet the conditions for participation in the procedure, if specified by the ordering party

5.1.1. Contractors applying for the subject of the order may not be subject to exclusion from the proceedings for-granting a public order pursuant to art. 24 sec. 1, art. 24 sec. 5 point 1 and art. 24 sec. 5 point 8 PzP. - Contractor who is subject to exclusion pursuant to art. 24 sec. 1 points 13 and 14 and 16-20 Pzp,

Art. 24 section 5 point 1 or art. 24 sec. 5 point 8 may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove-damage caused by a crime or tax offense, financial compensation for damage suffered or repairing the damage, exhaustive explanation of the facts and cooperation with law enforcement agencies and taking specific technical, organizational and human resources that are appropriate to prevent further offenses or fiscal offenses or incorrect possescontractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying for the order and the period of validity of the ban has not expired. None of the Contractors jointly applying for the award of the order referred to in art. 23 Pzp, can not be excludedu based on art. 24 sec. 1 Pzp, art. 24 sec. 5 point 1 Pzp

I art. 24 sec. 5 point 8 of the Public Procurement Law.

The Contracting Authority will examine whether the Contractor whose tender has been rated as the most advantageous is not subject to exclusion, based on the required documents and statements and information contained therein.

5.1.2. Based on Article. 22 ust. 1b Pzp. The Employer determines the following conditions for participation in the proceedings:

1) condition conditioneconomic or financial, ie: the Ordering Party does not specify the condition of participation in the proceedings in this respect. Contractors jointly applying for granting orders, referred to in art. 23 PPL, must jointly meet the condition specified in art. 22 ust. 1b point 2 of the PzP.

Each contractor is obliged to attach to the offer:

1 The Contractor's declaration (Uniform Euro) as of the day of submitting the offers(Polish Document Order).

- - prepared in accordance with the template attached to the SIWZ, - - submitted in electronic form, with a qualified electronic signature.

The information contained in the declaration will constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure. Statements of entities submitting the offer jointly and entities will make availableCapitalizing on the form JEDZ in the form of an electronic document, should be signed with a qualified electronic signature by each of them in the scope in which they confirm the circumstances referred to in art. 22 ust. 1 of the Public Procurement Law. An equivalent requirement applies to EAT submitted by a subcontractor, pursuant to art. 25a para. 5 point 1 of the Public Procurement Law - In the case of Contractors, not applying for the order, this document is submitted by each of the Contractors jointly applying for the order or on behalf of the Contractor - the Contractor who intends to entrust the execution of a part of the contract to subcontractors in order to demonstrate the absence of grounds for exclusion from them in the proceedings, submit the statement referred to in the letterThis contractor, which refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and fulfillment to them in so far as it relies on their resources, the condition of participation in the proceedings also submits a declaration on referred to in this point of the specification relating to these entities

6.2. According to art.-24aa paragraph 1 Pzp. The Awarding Entity will first evaluate the offers and then examine whether the contractor whose tender has been rated as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.

6.3. The contracting party, prior to the order being awarded, will call the contractor whose offer has been rated the highest, to submit within the prescribed period, not shorter than 10 days, valid at the timeday of making the following statements or documents:

List of statements or documents confirming no grounds for exclusion of the Contractor from participation in the proceedings - 1. Current excerpt from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to demonstrate the absence of grounds for exclusion based on art. 24 sec. 5 point 1 of the Act, - submitted in the form of an original or a copy certified as a true copy by the Contractor.

2. Current information from the National Criminal Record in the scope specified in art. 24 sec. 1 point 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders, - - submitted in the form of the original or a copy certified for compliance with the originalwith the Contractor.

3. Current certificate of the competent head of the tax office confirming that the contractor is not in arrears with paying tax, or a certificate that he obtained the exemption, postponement or spreading overdue payments in installments or suspending in full the decision of the competent authority - issued not earlier than 3 months before the deadline submission ofert;

- submitted in the form of an original or a copy certified as a true copy by the Contractor.

4. Current certificate from the relevant branch of the Social Insurance Institution or the Agricultural Social Insurance Fund confirming that the contractor is not in arrears with payment of social and health insurance premiums, or confirmation that he has obtained the exemption granted by law, postponementor spreading overdue payments into installments or suspending in full the implementation of the decision of the competent authority - issued not earlier than 3 months before the deadline for submitting offers;

- submitted in the form of the original or a copy certified for compliance with the original by the Contractor

List of declarations or documents confirming that offered deliveries meet the requirements specified by the order

Purchaser does not plan to provide similar contracts referred to in art. 67 sec. 1 point 6 of the Public Procurement Law - the Employer does not provide for additional orders for supplies referred to in art. 67 sec. 1 point 7 PzP.

If the Contractor submits an offer for more than one Task, the Ordering Party will consider that this document, submitted to confirm that the Contractor is not subject to exclusion from the proceedings for-ordering is part of the offer referring to all Tasks;
