The bidders, the supporting third parties and the subcontractors must not find themselves in the situations provided by art. 164, 165, 167 of the Law no. 98/2016. The way in which the requirement can be demonstrated: the DUAE will be completed by all economic operators participating in the award procedure, with information relevant to their situation.Testers demonstrating the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, according to art. 196 of Law no. 98/2016 only by the tenderers placed on the first 5 places in the intermediate rankings drawn up during the evaluation of the tenders.

1) Finding certificates regarding the lack of overdue debts(2) The judicial record of the economic operator and of the members of the administrative, management or supervisory body of the respective operator economic or those with powers of representation, decision-making or control within it, as it resultsof the certifying certificate issued by the ONRC / constitutive act; 3) Declaration on own responsibility regarding the observance of the provisions of art. 58 of the Law no. 98 / 2016.
If the bidder falls within any of the situations provided for in art. 58 of the Law no. 98/2016 his offer will be rejected as unacceptable.

1) Economic operators submitting the tenderhas to prove a form of registration under the law of the country of residence, to make sure that the economic operator is legally constituted, that he is not in any of the situations of cancellation of the establishment, and that he has the professional capacity to carry out the activities that do subject of the contract. The DUAE will be filled in by the economic operators participating in the procedure dis attribution with the information related to their situation. The supporting documents proving the fulfillment of the assumed ones by completing the DUAE, respectively the certifying certificate issued by the ONRC or in the case of the foreign tenderers, equivalent documents issued in the country of residence, shall be presented at the request of the contracting authority only by the tenderers placed on the first 5 places in customs(2) Foreign legal / natural persons: evidencing documents proving a form of registration as a legal entity or professional registration / attestation in accordance with the legal provisions of the country where the bidder is resident. Legal / physical persons: certificate constatator issued by ONRC din carethe object of the economic operator's activity.
