Delivery, assembly and commissioning of EDS equipment Norms III with adaptation of necessary infrastructure:

Main Site: Poznań-Ławica Airport. Sp. z o.o.

Przedmiota of orders is delivery, assembly and commissioning of EDS Normy III devices along with the adaptation of the necessary infrastructure at the Poznań Ławica Airport. z o.o. (hereinafter: Task):

a) delivery including installation, configuration and commissioning of devices for X-ray checked baggage of standard III (hereinafter: EDS Scanners) providing 3D spatial image generation;

b) dlast together with the assembly, configuration and start-up of workstations (hereinafter: Work Stations or Analysis Stations), used to service EDS Scanners;

c) delivery together with assembly, configuration and start-up of the server (hereinafter: Server) together with a rack cabinet for servicing EDS Scanners and Workstations connected with it, together with software enabling displaying images on Stac monitorsji Working (indicated above devices, having the function of projection of virtual threat images, as well as with 2 (two) management consoles;

d) design, delivery, installation and start-up of the Management System (hereinafter: System), including the connection of EDS Scanners to it, Server, Administrative Stations and Workstations;

e) design, delivery, configuration and commissioningie LAN networks of EDS Scanners, Server, Administrative Stations and Workstations (LAN installation within the scope of the Employer based on the design and materials and equipment provided by the Contractor); f) Design, delivery with assembly, configuration and start-up of baggage conveyors (conveyors) necessary to complete the functionality of the BHS system described in SOPZ, along withsupporting structures necessary for the proper functioning of conveyors;

g) dismantling with dismantling or disassembly with transfer, reassembly and configuration of existing RTG Scanners;

h) training at the Employer's premises for the persons indicated in the scope of ongoing service, maintenance and administration indicated by the Employer EDS Scanners, Workstations andServer with management consoles;

i) design and implementation / or design and adjustment of power supply to the assembly sites of all new devices, including in particular EDS Scanners, Server, Workstations, in accordance with the requirements set by the equipment manufacturers and the Employer's guidelines included in SOPZ.

j) design, delivery including assembly andair conditioning systems in the server room and air conditioning systems dedicated to EDS Scanners if the installation of these installations will be necessary for the proper functioning of the above mentioned devices, in accordance with the requirements set by the equipment manufacturers., statesAnnex No. 6 to the Terms of Reference and to the SOPZ constituting Appendix No. 7 to the ToR.

The Employer will exclude the Contractor, in relation to which any of the circumstances referred to in Art. 24 sec. 1 point 12 of the Public Procurement Law Acts

In addition to the proceedings for the award of the contract, the Contracting Authority will exclude the Contractor, in relation to which the circumstances set out below appear, the measures provided for in Article. 24paragraph. 5 of the Public Procurement Law, ie: -2.1. Art. 24 sec. 5 point 1) of the Public Procurement Law,

2.2. Art. 24 sec. 5 point 2) of the Public Procurement Law,

2.3. Art. 24 sec. 5 point 4) of the Public Procurement Law,

2.4. Art. 24 sec. 5 point 5) of the Public Procurement Law,

2.5. Art. 24 sec. 5 point 6) of the Public Procurement Law,

2.6. Art. 24 sec. 5 point 7) of the Public Procurement Law,

2.7. Art. 24 sec. 5, point 8) of the Public Procurement Law. - For the preliminary confirmation of the lack of grounds for exclusion and compliance with the conditions for participation in progressspecified by the Ordering Party in Chapter VIII of the Terms of Reference:

a) The contractor will submit with the offer, valid as of the day of submitting bids, a declaration of non-subject to exclusion and fulfillment of the conditions for participation in the proceedings submitted in the form of a Single European Order Document (hereinafter referred to as EED), in accordance with the specimen in Commission Implementing Regulation (EU) 2016/7 of 5 January2016 in the form of a standard form of a single European order document.

In the form: in electronic form with a qualified electronic signature, the Contractor signs the statement by the qualified electronic signature, issued by the qualified trust service provider who is the entity providing certification services, the electronic signature meetssecurity requirements specified in the Act of 5/09/2016 on trust services and electronic identification (Journal of Laws of 2019, item 162 with later amendments)

b) Contractor who refers to the resources of other entities, in order to demonstrate the absence of grounds for exclusion and fulfillment in respect of them - insofar as they refer to their resources - the conditions for participation in the proceedings are alsoEither filled out and provided with a qualified electronic signature by these entities. C) The Contractor, which relies on the abilities or situation of other entities, must prove to the Ordering Party that while fulfilling the order, he will have the necessary resources of these entities, in particular presenting the commitment of these entities to give him the disposal of the necessary resources for the needs ofand orders. The draft liability is attached as Annex 3 to the ToR.

D) At the request of the Contracting Party, the Contractor, which relies on the abilities or situation of other entities under the terms specified in art. 22a of the Public Procurement Law, is obliged to present in relation to these entities the documents listed in para. 2 lit. b) chapter nin

e) In order to assess whether the Contractor, relying on the abilities or sother entities on the terms set out in Article 22a of the Public Procurement Law, it will have the necessary resources to the extent that it is possible to properly execute the public order and assess whether the relationship between the Contractor and these entities guarantees real access to their resources, the Employer may request documents, which in particular specify: - Scope of available resourcesotu;

Method of using the resources of another entity, by the Contractor, while performing public order;

Scope and period of participation of another entity when performing public order;

Is the entity, on the capacities of which the Contractor relies in terms of participation in education proceedings, professional qualifications or experience, carry out construction works or serviceswhose indicated abilities apply.

The Contractor will demonstrate that:

a) he has funds or creditworthiness in the amount not lower than PLN 5, 000, 000.00 (in words: five million zlotys) and

b) he has liability insurance in the scope of conducted activity related to the subject of the order for a guarantee sum not lower than PLN 6, 000, 000 (in words: six million zlotysh).

In the case of Contractors jointly applying for the award of a contract, fulfillment of the aforementioned condition of the Contractor may show a total.

I. The Awarding Entity will call the Contractor whose tender has been rated the most, to submit the following declarations and documents confirming: - a) fulfillment of the conditions for participation in the proceedings specified in the ToR, ie: Information confirming the amount ofrequired financial resources or creditworthiness;

In accordance with the requirements of Chapter X, point 2 a) SIWZ, indents from first to fourth;

b) no grounds for exclusion, i.e .: from KRK

US Certificate - Social Insurance Institution's ZUS or other document - Copy from the relevant register or central records and information about economic activityto confirm the absence of grounds for exclusion under Article 24 sec. 5 point 1 of the Public Procurement Law - Statements about the absence of a verdict or administrative decision on being in arrears with tax payments, fees or social security or health insurance premiums or - in the event of issuing such a verdict or decision - documents confirming the payment of these receivables together with any interest lfines or conclusion of a binding agreement regarding repayment of such claims - Statements about the lack of a ban on applying for public orders - Statements about the lack of a sentence for a restriction of liberty or a fine to the extent specified by the awarding entity under Art. 24 sec. 5 points 5 and 6 of the Public Procurement Law Act - statements on the absence of an administrative decision on violation of obligations ariseprovisions of labor law, environment protection law or social security regulations to the extent specified by the awarding entity on the basis of art. 24 sec. 5 point 7 of the Public Procurement Law - Declarations of non-payment of taxes and local fees

In accordance with the requirements of Chapter X, point 2 b), SIWZ, first to ninth indent - II. Criteria for offer evaluation

1) Offer price - weight 60%

2) Guarantee periodEDS Scanners - 30% weight

3) Transportation Security Administration (TSA) Certificate for EDS Scanners - 5% weight

4) Upgrading EDS Scanner software to 3.3-weight level 5%

The method of awarding points within the criteria is specified in Chapter XIX of the Terms of Reference.

III. The ordering party will apply the provisions of art. 24aa of the Public Procurement Law. In connection with the above, the Ordering Party, in accordance with art. 24aa of the P actzp, will first evaluate the offers, and then examine whether the Contractor, whose offer has been evaluated as the most advantageous, is not subject to exclusion and meets the conditions for participation in the proceedings.
