The subject of the order, hereinafter referred to as the "Investment Task" ist preparation of project documentation for the investment task, consisting in preparation of multi-branch technical documentation for renovation and modernization of a multi-family residential building located in Poznań at ul. Szamarzewskiego 21. The description of the subject of the contract includes a functional and utility program (Annex 8 to the ToR) available in electronic version on the Purchase platformand Important contractual provisions constituting Annex 7 to the ToR.

The subject of the order hereinafter referred to as the "Investment task" is the development of project documentation for the investment task, consisting in the development of multi-branch technical documentation for the renovation and modernization of a multi-family residential building located in Poznań at Sza streetmarzewskiego 21 ".

The description of the subject of the contract contains the functional and utility program (Annex 8 to the ToR) available in electronic version on the Purchaser`s purchasing platform and Important contractual provisions constituting Annex 7 to the ToR.

3.1. The subject of the contract includes the preparation of project documentation in building renovation and modernization.

The contractor as part of the contractenia, in particular is obliged to:

1) develop project documentation for building modernization (including preparation of investor cost estimates, program of conservation works, take-offs, STWiORB, BIOZ);

2) develop technical expertise along with assessment of technical condition and visualization of the building after modernization works carried out;

3) obtaining all necessary permitsz o. a deposit, before the closing date for the submission of tenders, in the amount of PLN 2, 000.00. The bid bond may be lodged in specific formsin art. 45 of the Act. The bid bond deposited in money will be payable to the interest-free account of the Ordering Party: ING Bank Śląski 07105015201000002349508511. In the event of a bid bond in the form of a surety or guarantee, the Ordering Party requires the submission of an electronic document via the purchasing platform on the terms set out in point 18.9 of the Terms of Reference, subject to the fact that it will be signed qualifiedelectronic signature by the guarantor, i.e. the guarantee / surety issuer.

2) The Employer does not envisage awarding the Contractor the orders referred to in art. 67 section 1 point 6 of the Act consisting in the repetition of similar works subject to this contract.

3) The Purchaser does not envisage the conclusion of a framework agreement or the establishment of a dynamic purchasing system.

4) Employer notleads electronic auction.

5) The Employer provides for the exclusion of Contractors on the basis of art. 24 paragraph 5 points 1 and 8 of the Act.

6) According to art. 25a section 1 and 2 Public Procurement Law to the offer The Contractor attaches a current statement as at the day of submitting the offers to the extent indicated by the Employer in the contract notice or in the ToR in the form of a uniform European order document (JEDZ Attachment No. 2 to the ToRFROM). The contractor prepares an electronic document by completing the EAT with the help of the ESPD tool or other available tools or software. The contractor is obliged to submit the EAT in electronic form with a qualified electronic signature. EAT with instructions on how to complete it will be available on the Purchaser`s purchasing platform at: https: // platformazakupowa.pl/pn/zkzl_poznan. In the event of joint application for the contract by the Contractors, a single document shall be submitted by each of the Contractors jointly applying for the contract.

7) Required deadline for the contract: 24 weeks from the date of the contract.

8) The contracting authority shall set as security for the proper performance of the contract 3% of the price bid. Security for the due performance of the contract may be lodgede in the forms specified in art. 148 section 1 point 1 5 of the Act for the benefit of the Employer.

1) List of statements or documents confirming no grounds for exclusion:

a) pursuant to art. 24 paragraph 11 of the Act, each Contractor, within 3 days from the date of posting on the purchasing platform information from the opening of tenders, referred to in Art. 86 section 5 of the Act, provides the Employer with a declaration of belongingbelonging or not belonging to the same capital group (Annex 3 to the ToR). Along with submitting the statement, the Contractor may provide evidence that links with another Contractor do not lead to a distortion of competition in the procurement procedure;

b) a current excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate provisions requireits entry in the register or register in order to demonstrate the lack of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 of the Act;

c) current certificate of the competent head of the tax office confirming that the Contractor is not in arrears with tax payments, or any other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding repayment of these receivables together withnatural interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments as provided for by law, or withholding in full the execution of the decision of the competent authority issued not earlier than 3 months before the deadline for submitting bids;

d) current certificate of the relevant branch of the Insurance Company Social Insurance Fund or Agricultural Insurance Funda social or other document confirming that the Contractor is not in arrears with payment of health and social insurance contributions, or another document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of these claims together with any interest or fines in particular that he has obtained the exemption provided for by law, deferment or

installment distribution fromof any outstanding payments or withholding in full the decision of the competent authority issued not earlier than 3 months before the deadline for submission of bids;

e) the Contractor`s statement that he has not been subjected to a preventive measure against him from applying for public procurement Annex No. 6 to the ToR.

2) In the case of entities appearing together, the Contractor is obliged to submit dthe documents referred to in points 14.2, 14.6, 14.7, 14.8, 14.9 of the ToR, and documents regarding belonging or not to the capital group (Annex 3 to the ToR) for each of the entities specified in the agreement regulating the cooperation of entities.

3) If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents specified in items 14.6, 14.7, 14.8, the ToR shall submita document issued in the country in which he has his registered office or place of residence, confirming accordingly that:

a) its liquidation has not been opened or bankruptcy has been declared, issued not earlier than 6 months before the expiry of the time limit for submission of tenders;

b) is not in arrears with the payment of taxes, fees, social security and health insurance contributions or has entered into an agreement with the competent authority regardingat these receivables, together with any interest or fines, in particular that he obtained the exemption provided for by law, deferring or spreading in installments of overdue payments or withholding in full the decision of the competent authority, issued not earlier than 3 months before the deadline for submission of tenders. If in the country in which the Contractor has its registered office or place of residence or placethe person to whom the document relates is resident, the documents referred to in items 14.6,

14.7 and 14.8 of the Terms of Reference do not appear, they are replaced by a document containing the Contractor`s statement indicating the person or persons to be represented or the statement of the person to whom the document was to be submitted, before a notary public or before a competent judicial, administrative or professional self-government bodyor business competent for the registered office or place of residence of the Contractor or that person.
