Access Rights

DUME, III: grounds for exclusion (right of access)

Scope of requirements:

In accordance with section 66 of the Act, the contracting authority must verify that the tender comes from a tenderer who is not excluded from market access on the basis of Articles 67 to 70 of the law and who meets the criteria for quality selection

In accordance with Article 60 of the awarding authority, the contracting authority may review the selection of a tenderer at any stage of the procurement procedure, if its situation in the light of the reasons for the award. exclusion or compliance with the applicable selection criterion (s) no longer meets the requirements.

II.6.1.1) Mandatory grounds for exclusion

DUME, III, A: grounds relating to-Penal convictions

By the mere fact of submitting an offer, the tenderer certifies that he is not in any of the situations referred to in the exclusion clauses in Article 67 (1) and (2) of the Law. Article 61 of the awarding authority and not be concerned by the cases of incompatibility provided by Articles 6 and 52 of the Law.

The exclusion of the tenderer also applies when the person sentenced by final judgment is a member of the court. administrative, management or supervisory body-of the tenderer, or has a power of representation, decision or control within it.

Grounds for exclusion relating to tax and social debts

DUME, III, B: reasons relating to the payment of taxes and contributions or contributions social security

This procedure excludes tenderers who do not fulfill their obligations to pay tax debts and contributions-of social security.
