Applicant must qualify for personal status according to - 32 par. 1 Act No. 343/2015 Coll. on Public Procurement and on the Amendment of Some Outcomes, as amended(hereinafter referred to as the "Public Procurement Conclusion") and to prove their fulfillment by submitting original documents or their certified copies according to - 32 par. 2, respectively. ods. respectively. ods. 4 and / or para. 5 of the Public Procurement Act. If it comes into consideration, the contracting authority will proceed in accordance with - 152 (4) of the Act on Public Procurement. 91/2016 Coll.on the criminal liability of legal persons and on the amendment of certain conclusions (hereinafter only the criminal liability of legal persons). The Act on Criminal Liability of Legal Persons was amended by Act no. 330/2007 Coll. on the Criminal Register and on the amendment of certain conclusions (hereinafter referred to as the Criminal Register). This amendment to the Criminal Records Act modified, among other thingsissuing an extract from the criminal record for legal persons. As a result of this legislation, economic entities with legal person status were established for the purpose of proving their personal status pursuant to - 32 para. 1 pism. a) Act no. 343/2015 Coll. on Public Procurement and on the Amendment of Some Outcomes, as amended, the obligation to submit an extract from the criminal justice register

The economic entity entered in the list of economic entities can demonstrate fulfillment of the above-mentioned condition of participation

- by submitting an extract from the criminal record of a legal person not older than 3 months in the process of public procurement directly to the contracting authority, or by adding this information to the list of economic operatorsin the form of a notice of change in the data, which the Office for Public Procurement (hereinafter referred to as the Office) publishes on its website, accompanied by an extract from the criminal record. . e) by an extract from the Commercial Register of the Slovak Republic or an extract from the Trade Register Slof the Republic of Republic, the candidate / tenderer is not obliged under - 32 par. 3 prohibits the submission of these documents to the contracting authority on the grounds of the use of data from public administration information systems.
