The bidders, the third parties and the subcontractors must not find themselves in the situations provided for in Articles 59, 60, 164, 165 and 167 of Law 98/2016. The way in which the fulfillment of the requirement can be demonstrated: the DUAE will be filled in by the economic operatorsbut the participants in the award procedure with the information related to their situation.The supporting documents proving the fulfillment of the assumed by the DUAE are to be presented, at the request of the contracting authority, by the economic operators ranked on the 1st, 2nd and 3rd place in the intermediate rankings drawn up at the completion of the evaluation tenders, as the contracting authority wishesto conclude a framework agreement with three economic operators.

These documents are:

1. • Certain certificates regarding the lack of overdue debts regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at • the criminal record of the economic operator and the members of the management, management orsupervision of the respective economic operator, or those who have the power of representation, decision or control within it, as it results from the certifying certificate issued by the ONRC / constitutive act,

3. • as appropriate, documents proving the fact that the economic operator may benefit from the derogations provided for in art. 166 par. (2), art. 167 par. (2), art. 171 of Law 98/ 2016 on public procurement; 4. • other editing documents, as appropriate. Representative of A.C. Mrs. Florentina Ionita Radu.

The decision-makers of the contracting authority, regarding the organization, carrying out and finalization of the award procedure, are: Ioniţă Radu Florentina, Bazga Ionuţ, Jinga Mariana; Duica Mirel, Dumitrescu Gheorghe; Georgescu George;miss Gabriela; Boboc Daniela; Amaria Ligia; Oc-lak Cristina, Mirea Carmen, Bacioi Florin, Eftimie Ioana, Cucu Gabriela, Mihalcea Mariana.

The DUAE will be completed and presented in accordance with art.193 paragraph 1 of Law 98 / 2016.

Note 1: The contracting authority excludes from the award procedure any economic operator that falls within any of the provisions of Articles 59, 60, 164, 165 and 167 of Law no.98 / 2006.

Note 2: In case of association, the qualification criteria for the personal situation will be met by each associate. The legal form to be taken by the group of economic operators to whom the contract has been awarded; the contracting authority reserves the right to require the legalization of the joint venture if the joint bid is declared winner.each document will be signed by the legal representative of the bidder. Documents issued in a language other than Romanian will be accompanied by an authorized translation in Romanian. All documents will have, besides the signature, clearly mentioned the name, surname and function of the signatorythe technical and professional / economic or financial aptitude of the economic operator participating in the procedure as well as the subcontractor are obliged to submit the documents listed above. Considering that the contracting authority will sign the agreement- frame only with the economic operators located on the 1st, 2nd and 3rd places, as the case may be, the way of defining tenders with equal pricesto do so: 1.1 If the commission finds that more than 2 admissible tenders with equal prices have been deposited / introduced in the SEAP, the contracting authority will send to SEAP a request for clarification regarding the submission of new improved financial proposals (with 2 decimal places), and economic operators will send their response usingthe facilities offered by SEAP, in which case the contract will be awarded to the first three bidders who have the lowest price;

1.1.1 In the case of maintaining equality and after requesting clarifications regarding the submission of new financial proposals improved in SEAP, the contracting authority will request a maximum of 2 clarifications to improve the bid price. If, after thattheir requests for clarification regarding the submission of a new financial proposal, the request for re-casting is made until the first placement of the bidders;

1.1.2 The new financial proposal will be submitted / entered into SEAP, signed with the extended electronic signature. Deadlines / dates for submission of financial proposals will be communicated in the SEAP request by the1.2 If the commission finds that more than 2 admissible tenders have been submitted in SEAP with equal prices to second rank bidders, the way they will be awarded will be by requesting a new proposal in SEAP (2 decimal places), and economic operators will send their response using the facilities offered by SEAP, soranked first is not affected, ie the new financial proposal is not equal to or less than the ranked first place bid

1.2.1 If the new improved financial proposal submitted to SEAP as a result of the request of the contracting authority received through the SEAP, will influence the rankings of the higher seats, this will not be taken into account, keepingthe initial fertilizer filed in the SEAP at the procedure;

1.3 If the commission finds that more than two admissible tenders have been submitted with equal prices to the third-placed bidders, the way of their classification will be made by requesting in SEAP, a new improved financial proposal (with 2 decimals), and economic operators will send their answer using the facilities offeredis SEAP so that the first and second-placed bidders are not affected, ie the new financial proposal will not be equal to or lower than the second-ranked bid,

1.3.1 If the new improved financial proposal submitted in SEAP, following the request of the contracting authority received through SEAP, will influence the rankings of I and II, it will not betaking into account the initial offer submitted in the SEAP, to the procedure. The winner will be designated by applying the lowest cost criterion.
