The bidders, third parties and subcontractors must not find themselves in the situations stipulated in art. 59-60, 164, 165, 167 of the Law no.98 / 2016. The way in which the fulfillment of the requirement can be demonstrated: COMPLETE DUAE by the economic operators participating in the procedure-assignment with information related to their situation.

The declaration on non-compliance in situations potentially generating conflicts of interest will be submitted by both bidders and third-party supporters and subcontractors. In case of submitting a joint offer, DUAE will be completed by each economic operator. DEBT DEPOSIT SHOULD BE SUBMITTED TO THE ASSOCIATION AGREEMENT or subcontracted(if applicable). The supporting documents proving the fulfillment of the undertaken by completing the DUAE are to be submitted, at the request of the contracting authority, only by the tenderers placed on the first three lots in the intermediate rankings drawn up at the completion of the tender evaluation.

(2), art. 167 par. (2), art. 171 of the Public Procurement Law 98/2016; d) other editing documents, as appropriate.
