The information requested for non-compliance with the provisions of art. 58 63 of the Law no. 98/2016 are requested by the subcontractor and the supporting third party, as the case may be.

According to the provisions of art. 193 of Law 98/2016, the contracting authority will accept in the offers of the DUAE (Single European Procurement Document), in place of the requested documents for demonization• Prior to the award of the contract, the contracting authority shall, after applying the award criterion, request the successful tenderer to submit the updated supporting documents demonstrating the fulfillment of all the qualification criteria, including the eligibility criteria, according to the information withcaught in DUAE. DUAE will be filed, as appropriate, by the third party and the subcontractor. In the case of foreign economic operators, equivalent documents issued in accordance with the applicable legislation in the country of residence will be presented; 5) Fiscal Attestation Certificate issued by the Financial Administration, stipulating that the tenderer / candidate has no debts to the consolidated state budgett, outstanding at the time of presentation. Therefore, proof of payment of the fees will be made by presenting the standard forms issued by the competent bodies - by the bidder ranked first, respectively the place in the intermediate rankings; 6) Fiscal Attestation Certificate. legal persons on local taxes and fees and other local budget revenues - issued by the City Hall, stipulatingthat the bidder / candidate has no overdue debts at the time of presentation. Therefore, proof of payment of the fees will be made by presenting the standard forms issued by the competent bodies - by the tenderer ranked first in the interim ranking.

Foreign bidders will present any editorial documents issued by the competent authorities of their country of residence.which proves the fulfillment of the outstanding obligations to pay the taxes to the state budget and the local budget, according to the legislation of the country of residence. Documents will be accompanied by their certified translation into Romanian.

As proof of non-compliance in exclusion situations, the authority will require, besides tax certificates, the following documents:- the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the economic operator or of those having the power of representation, decision or control within the economic operator as it results from the certifying certificate issued by ONRC / the constitutive act, - as the case may be, documents demonstrating that the econo operatorsmall can benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of Public Procurement Act 98/2016, - other editing documents, as appropriate. Note: The certificates required in this section may be presented in any of the following forms: original / legalized copy / legible copy with the words "according to the original"

Considering that the contracting authority will sign the framework agreement with the economic operators-(1) Where the commission finds that more than two admissible offers have been submitted / entered in the SICAP, they are placed on the 1st, 2nd and 3rd place, as the case may be, the way of bidding with equal prices will be as follows: equal to the first-ranked bidders, the contracting authority will send a clarification request to the SICAP / Questions section on the submission of someimproved financial proposals, and economic operators will send the answer via SICAP, in which case the contract will be awarded to the top 3 bidders who have the lowest price. In the case of maintaining equality and after requesting clarification regarding the submission of new financial proposals improved in SICAP, the award procedure for the respective lot is canceleda. The new financial proposal will be submitted / entered into the SICAP. Deadlines / dates for submission of financial proposals will be communicated in the request sent to the SICAP by the contracting authority; 2) If the commission finds that more than two admissible tenders with equal prices have been submitted by the second rank bidders, the way of their separation will be through the groundthe SICAP will have a new financial proposal and the economic operators will send the answer through the SICAP so that the bidder ranked first is not affected, ie the new financial proposal will not be equal to or less than the ranked bid I; 3) If the commission finds that more than 2 admissible tenders have been submitted at equal pricesby the third-ranked bidders, the way they will be allocated will be by requesting a new financial proposal in the SICAP and the economic operators will send the answer through the SICAP, so that the bidders placed on the 1st and 2nd place not to be affected, ie the new financial proposal is not equal to or less than the ranked placement-II. It is admitted, within the re-listing, unit prices with 3 (three) decimal places. All documents that are part of the candidates' offer will necessarily carry the extended electronic signature, according to art. 60 par. (4) of H.G. no. 395/2016
