Requirement no. 1: the bidders, the third-party supporters and the subcontractors must not find themselves in the situations provided in art. 164, 165 and 167 of Law no. 98 / 2016.
The way in which the requirement can be demonstrated: the DUAE will be completed by the bidders with the related information.
The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request of the contracting authority, only by the tenderer ranked first in the intermediate ranking prepared at the end of the evaluation of the offers.
These documents can be:
(a ) certifying certificates regarding the lack of outstanding debts regarding the tax paymenttaxes, contributions or contributions to the general consolidated budget (state budget, local budget, etc.) at the time of presentation,
(b) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of the respective economic operator or of those which have power of representation, decision or control within it, as it results from the certificatethe finding issued by the ONRC / the constitutive act,
(c) as the case may be, the documents proving that the economic operator can benefit from the derogations provided in art. 166 para. (2), art. 167 para. (2), art. 171 of Law no. 98/2016,
(d) other edifying documents, as the case may be.
The documents are presented including by the associated bidder, subcontractor and third party supporter.
Requirement no. 2: oFertilizers, third party supporters, subcontractors must comply with the rules for avoiding the conflict of interests provided for in art. 60 of Law no. 98/2016 regarding public procurement.
The way in which the requirement can be demonstrated: The bidders, the third party supporters, the subcontractors will present the declaration according to art. 60 of the law no. 98/2016 regarding public procurement, once cu DUAE submission.

Failure to comply with the above requirements constitutes reasons for the exclusion of the bidders. The commitment of the third party supporter will be presented with the DUAE submission. The supporting documents proving the fulfillment of those assumed by completing the DUAE will be presented, at the request ofthe contracting authority, only by the bidder ranked first in the intermediate ranking drawn up at the end of the evaluation of the offers.
Requirement no. 1. The bidders must prove a form of registration according to the law of the country of residence, to prove that they are legally constituted, that they are not in any of the situations of cancellation of the constitution and that they have the capacity to register.professional to carry out the activities that are the subject of the contract.
The way in which the requirement can be demonstrated: the DUAE will be filled in by the bidders with the information related to their situation. ONRC, or in the case of foreign offers, documents echivalents issued in the country of residence, will be presented, at the request of the contracting authority, only by the tenderer ranked first in the intermediate ranking drawn up at the end of the evaluation of the offers.
The documents requested in this section can be submitted / present in any of the forms: original / certified copy / legible copy with the mention "in accordance with the original" / electronica.
1) According to the notification of ANAP of 8.4.2019 (http://anap.gov.ro/web/notification- regarding- utilization-duae-in-proceduriledesfasurate-exclusiv-prin-mijloace-electronice/), the Single Document of The European Procurement (DUAE) was integrated into the Electronic Public Procurement System (SEAP).
Thus, the DUAE was configured by the contracting authority directly in the SEAP when defining the attribution documentation.re and will be completed by the economic operators participating in the SEAP procedure directly, after system authentication. For the cases in which the tenderer is an association of economic operators or for the cases in which the tenderer has subcontractors or third parties, each economic operator shall authenticate in the system and shall access the award procedure in order to complete it.DUAE in the quality in which it was included in the procedure (associate, subcontractor, third party supporter);
2) The bidders will submit in SEAP the following documents, signed with the extended electronic signature:
- the power of attorney (if applicable), accompanied by a copy after BUT or passport, completed according to the form F.13, dated, signed and stamped for authenticity,
- the proof of the guarantee guarantee de participation,
- the declaration according to art. 60 of L. 98/2016,
- the association agreement (if applicable),
- the subcontracting agreement (if applicable),
- the commitment of the third party supporter (if applicable).
3) If 2 or several offers are ranked first, with equal scores, the division will be done taking into account the score obtained on the evaluation factors in descending orderof their shares. In case the equality is maintained, the contracting authority will request new financial proposals, and the winning bid will be designated the one with the smallest financial proposal. If after the re-offering the bidders cannot be separated, the provisions of art. 211 lit. b) of Law 98/2016, being impossible to conclude the contract;
4) Based on the provisionsart. 10 of H.G. no. 445/2003, until the subsequent contracts are signed, the economic operators declared the winners have the obligation to obtain the NATO code of economic agent (NCAGE Code, granted by the National Coding Office or the NCAGE Code assigned by NSPA NATO Maintenance and Supply Agency depending on the state in which the economic operator is registered). After signing the contractSubsequent to this, the contractor will pick up from the National Coding Office of Romania the form of the Identification Project for completing the coding data of the endowment article.
