The subject of the Order is: Metrological control and service of analyzers for O2 and CO amounts in exhaust gases at PGE EC S.A. Wybrzeże branch described in detail in the Description of the Object of the Order Annex 1.

The mission objective is withEnsuring the correct quality of O2 and CO (oxygen and carbon monoxide content) measurements in the spliners installed on the flue gas ducts of power and peak boilers at the Gdańsk and Gdynia Heat and Power Plants, by performing periodic service inspections, calibration and metrological control as well as carrying out ordered repairs of the measuring apparatus.

Analyzers covered by the contract are forbuilt on flue gas ducts of BC-50 heating block units and peak boilers at the Gdańsk and Gdynia CHP plants. Oxygen analyzers are installed inside the boiler room building, while the CO analyzers are located outside and are installed in the exhaust gas ducts behind the electrostatic precipitators. Access to the analyzers is provided from permanent maintenance platforms.

Information from the analyzers about currentthe percentage of oxygen and carbon monoxide in the exhaust gas is transmitted continuously, using a standard 4-20 mA current signal, to PROCONTROL, Symphony Plus, and MASTER process control systems. The measurement value is visualized at the operator stations of the blocks and control panels of the peak water boilers. Signals from the control systems are transmitted to the company`s pArchiving and distribution of PGiM data.

Oxygen measurement is not involved in technological blockades and safeguards, it is used to regulate and control the combustion process and is used for billing energy certificates.

The analyzers are powered by 230V. Electrical protections for power supply circuits are located in cabinets and racks of the lok`s cable roomsin the vicinity of the settings of a given boiler.

The analyzers are operational, subject to reviews and periodic metrological control.

In 2016, in EC Gdańsk on boilers OP 230 No. 7, 9 and 10, two oxygen analyzers type AZ20 manufactured by ABB were installed. At EC Gdynia on two VKK boilers type SKG No. 8 and 9, two LT2 oxygen analyzers with LS2 sensors manufactured by LAMTEC have been installed.service review of the abovementioned analyzers with replacement of fast-wearing parts and calibration with metrological control (in the scope of issuing and providing the Ordering Party with certificates and reports). The service inspection will be carried out once a year. In addition to periodic inspections in the scope of work, there is also repairs of damaged apparatus reported by the Employer.

1. Oh uContractors who are not subject to exclusion and who meet the conditions for participation in the procedure may apply for splitting orders.

2. The Contractor is excluded from the contract award procedure in relation to which any of the circumstances referred to in Article 24 para. 1 items 12-23 of the Public Procurement Law and Article 24 para. 5 item 1, 2, 4, 8 of the Public Procurement Law, excluding art. .24 section 1 item 13 letter d of PPL, and in the case for whichm referred to in art. 24 section 1 item 14 of the Public Procurement Law, if the person referred to in this provision has been convicted of an offense listed in Art. 24 section 1 item 13 letter d Pzp

3. To the offer, the Contractor is obliged to attach a current statement as at the date of submitting the offers constituting a preliminary confirmation that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure.

4. The statement referred to in pkt.3 The Contractor is obliged to submit in the form of a document drawn up in accordance with the template of the standard form set out in the Implementing Regulation of the European Commission issued on the basis of Article 59 (2) of Directive 2014/24 / EU, hereinafter referred to as "EAT".

5. Employer before granting of the contract, I will call the contractor whose bid was highest rated to be submitted in the designated, not shorter than10 days, valid as at the date of submitting statements or supporting documents, including no grounds for excluding the contractor from participating in the proceedings, including:

1) information from the National Criminal Record in the scope specified in Article 24 paragraph 1 item 13.14 and 21 of the Public Procurement Law, issued not earlier than 6 months before the deadline for submitting bids;

2 ) certificate of the competent head of the tax officeconfirming that the contractor is not in arrears with payment of taxes, issued not earlier than 3 months before the deadline for submitting bids or other document confirming that the contractor has entered into an agreement with the competent tax authority on the repayment of these receivables along with any interest or fines, in particular obtained by law, release, deferment or spread overinstallments of overdue payments or withholding in full of the decision of the competent authority

3) certificate of the competent organizational unit of the Social Insurance Institution or Kasa Rolniczego Ubezpieczenia Społecznego or other document confirming that the contractor is not in arrears with payment of social security or health insurance contributions issued no earlier than 3 months beforethe deadline for submitting bids or other document confirming that the contractor has entered into an agreement with the competent authority regarding the repayment of these receivables together with any interest or fines, in particular, he obtained the exemption, deferral or installment of overdue payments provided for by law or withholding in full the decision of the competent authority,

4 ) an excerpt from the relevant register or a centeconomic records and information on business activities, if separate provisions require an entry in the register or records, in order to demonstrate the lack of grounds for exclusion under Article 24 (5) point 1 of the Act

5) the contractor`s statement that he has not issued a final court judgment or the final administrative decision on arrears with taxes, fees or social security contributionsor health or - in the event of such a judgment or decision - documents confirming the payment of these receivables together with any interest or fines or the conclusion of a binding agreement on the repayment of these receivables (in connection with Article 24 (1) point 15 of the Public Procurement Law)

6) as a precautionary measure prohibiting not seeking orders ppublic in connection with Article 24 paragraph 1 item 22 of the PPL)

7) the contractor`s declaration of not being in default of payment of local taxes and fees, referred to in the Act of 12 January 1991 on local taxes and fees (Journal of Laws of 2016 item 716).

6. The Employer does not impose specific requirements regarding the condition regarding the conduct of specific professional activities.

1) they have a liability insurancecivil operations in the field of business for an insurance sum of not less than PLN 500, 000.00 (in words: five hundred thousand zlotys).

1. The procedure is conducted in an open tender pursuant to art. 39 in relation Article 134.1 of the Act of 29.1.2004, Public Procurement Law (i.e., Journal of Laws of 2017, item 1579, as amended), hereinafter referred to as "Pzp".

2. PGE Energia Ciepła S.A., isan entity authorized to prepare and conduct the procedure for awarding the Order on behalf of and for the Employer.

3. The awarding entity envisages application in accordance with art. 24 aa Pzp, so-called reverse procedure (i.e. in the first place it will evaluate the bids and then examine whether the Contractor whose bid was assessed as the most favorable is not subject to exclusion and meets the conditionsand participate in the Proceedings).

5. The Employer allows the possibility of amending the Contract on public procurement on the principles set out in the Contract template in the ToR.

6. The Employer informs that in a situation where the Contractor has its registered office or place of residence outsidethe territory of the Republic of Poland, instead of the documents referred to in:

1) section III.1.1 point 5.1. submits information from the relevant register or, in the absence of such a register, another equivalent document issued by a competent judicial or administrative authority of the country in which the Contractor has its registered office or place of residence or the place of residence of the person to whom the information or document relates, to the extent specified in art. 24 paragraph 1 point 13, 14 and 21 of the Pzp,

2) section III.1.1 points 5.2.-5.4. submits a document or documents issued in the country in which the contractor has a mass or place of residence, confirming accordingly that:

a) he is not in arrears with the payment of taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of such receivablestogether with any interest or fines, in particular, he obtained the exemption, deferment or spreading into fixed payments or suspension of the execution of the competent authority`s decision in full, provided for by law;

b) its liquidation has not been opened or bankruptcy has been declared;

7. Documents referred to in item 6 item 1) and 6 item 2) item b), should be issued not earlier than 6 months beforethe bid submission deadline. The document referred to in item 6 point 2) lit. a), should be issued not earlier than 3 months before the expiry of that period.

8. To the extent not specified in points 6-7 above and to the extent of documents (and their forms) confirming the fulfillment of the conditions for participation in the procedure, the provisions of the Regulation of the Minister of Development of 26.7.2016 ontypes of documents that the contracting authority may request from the Contractor for the award of the contract (Journal of Laws item 1126).

9. For values indicated by the Contractor in a currency other than the Polish zloty (PLN), the Employer adopts a calculator according to the average exchange rate of the National Bank of Poland (NBP) from the date of publication of the Order Notice in the Official Journal of the European Union.

10. Employer in accordance with artVol. 13 para. 1 and 2 and art. 14 (1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation) (Journal of Laws EU L 119 of 04/05/2016, p. 1), hereinafter "GDPR", informs that detaile provisions in this regard are included in the model Agreement in the Terms of Reference and on the website https://pgeenergiaciepla.pl/Ochrona-Danych-Osobowych/Informacja-w-sprawie-przetwarzania-danych-osobowych-dla-naszych-partnerow2.
