Framework Agreement for charter air services

The scope of the framework agreement consists in the provision of charter air transport services (CPV code: 60423000-9) necessary for the transport of the official delegations of the Council of the European Union during the period of the Presidency of the Council of the European Union by Romania iin the year 2019, as well as other delegations.

Main Site: Bucharest.

Estimations of the minimum and maximum quantities of charter air services covered by the framework agreement:

- Charter route Brussels - Bucharest - Brussels, min . 1 pc. - max. 5 pieces

Estimate of the quantities subject to the largest subsequent contract:

- Charter charter on route Brussels - Bucharest --Bruxelles, min. 1 pc. - max. 3 units

Estimated value of the largest subsea contract:

- Min. 353 052 RON - max. 1 059 156 RON

Frequency of subsequent contracts:

- Minimum 1 contract, maximum 5 contracts.

The tenderer, third parties and subcontractors must not be present in any of the hypotheses covered by the provisions of art. 164, 165 and art. 167 of Law no. 98/2016 viewsnd public procurement. The way to demonstrate that the requirement is met: It will be completed by the economic operators participating in the award procedure with information related to their situation. Also, along with the DUAE form, the Declaration on non-compliance with the provisions of art. 60 par. (1) of the Law no. 98/2016 on public procurement (Formno. 4) The supporting documents proving the fulfillment of the assumed by completing the DUAE are to be submitted to the SICAP at the request of the contracting authority, only by the tenderer placed on the first place in the intermediate rankings drawn up during the evaluation of the tenders. on the lack of overdue debts in respect of the payment of taxesand the taxes or contributions to the consolidated state budget (local budget, state budget) at the moment of presentation, - the criminal record of the economic operator and the members of the administrative, management or supervisory body of the economic operator or those having power of representation, decision-making or control within it, as evidenced by certificate con-line issued by the ONRC / instrument of incorporation, - where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Art. 166 par. (2), art. 167 par. (2), art. 171 of Law no. 98/2016 on Public Procurement, - any other documents that come to prove the fulfillment of the assumed by the DUAE.

Foreign natural / legal persons mayfurnish equivalent supporting documents from the country in which the tenderer has its registered office / business domicile or affiliation. These documents will be accompanied by authorized translation into the Romanian language.

The tenderer / candidate / the associated tenderer / subcontractor / third party who is a member of the board of directors / management or supervisory body and / or has shareholders or associates of persons who are spouse, relatives or cousins up to the second degree includedv who is in commercial relations with decision-makers within the contracting authority, as provided in art. 60 lit. d) of Law no. 98/2016 on public procurement, is excluded from the award procedure.

Documents issued in a language other than Romanian will be submitted accompanied by a certified translation in Romanian.economic entities with overdue debts, not paid to the state budget or to the local budget, except for those stipulated in art. 166 par. (2) of the Law no. 98/2016 on public procurement will be rejected. You will be asked to obtain the Certificate of Attestation issued by the Trade Registry Office (the information contained in the certificate must be actual / current at the moment) of which the tenderer has the main or secondary activity to provide services similar to those which are the subject of the acquisition.

Foreign physical / juridical persons: Legally binding documents proving a form of registration in accordance with the legal provisions of the the country in which the tenderer has its registered office / place of residence or affiliationprofessionally, specifying the full name, headquarters, authorized persons / administrators, fields of activity. The overall turnover for the last 3 financial years ended: 2015, 2016, 2017 must be at least equal to the amount by:

- Lot nr. 1: 2 200 000 RON,

- Lot no. 2: 2, 000-RON 000.

Values will be denominated in RON and in Euro. The RON / EUR equivalence will be achieved at the annual average rate communicated by the National Bank of Romania for the respective years. Tenderers who have to convert currencies other than the EURO in RON will use the annual average exchange rates set by the National Bank of Romania for those years.

The way of ranking the first-ranked bids with equal scores: the contracting authority will ask tenderers for a new financial proposal through SICAP and the contract will beassigned to the tenderer whose new score is the highest.
