Supply of antiseptic for timber - D.S. Argeş

Acquisition of a biocide (antisepticant) for the treatment of timber in accordance with the provisions of the Specification. Note: In accordance with art. 160 par. (2) of Law 98/2016, amended by O.U.G. 107/2017, the contracting authority will clearly and completely answer all the soclarification bids / additional information within (deadline) 10 days before the closing date for submission of bids. Number of days to which clarifications may be requested before the deadline for submission of tenders / applications: 15.

Minimum - maximum estimated quantities who will do itsubject to: - - Frame Agreement: minimum 1 kg - maximum 12 000 kg antiseptic for timber, - - The largest subsequent contract to be awarded during the framework agreement: minimum 1 kg - maximum 3 000 kg antisepticant for timber.
Requirement 1. Declaration on non-compliance with the provisions of art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement.
Mode of accomplishment: the DUAE will be presented (prepared according to the standard form approved by the European Commission at URL: https://ec.europa.eu/growth/tools-databases/espd/filter).Those suppliers have the obligation to complete and initial submission of DUAE - by bidders / candidates (including associates / subcontractors / thirds supporters), as the first proof of non-compliance with theexclusion and capacity requirements (refer to the DUAE User Guide, developed by ANAP, available at www.anap.gov.ro)

(a) In the case of submitting an offer in association, each associate has the obligation to demonstrate the fulfillment of the requirement. This statement is requiredand any subcontractors. In the case of submission of an individual / joint offer technically-professionally supported by third / third supporters, each supporter has the obligation to prove the fulfillment of the requirement. Confirmation papers of associates / subcontractors / third-party supporters will be submitted, at the request of the contracting authority, by the bidder ranked firstin the interim ranking,
(b) Incorporation into one or more of the situations referred to in art. 164, art. 165 and art. 167 of Law no. 98/2016 on public procurement entails the exclusion of the tenderer from the procedure for awarding the contract, (c) The bidder ranked first after the application of the award criterion on the admissible tenders proves the non-compliance in theincluding, as a rule, the following information and documents at the request of the AC:
- establishing certificates regarding the lack of debts, regarding the payment of taxes, duties or contributions to the general consolidated budget (local budget, state budget, etc.) at the time of presentation,
the criminal record of the economic operator and the members of the management body, surveillance or surveillance of the economic operator or of those who have the power of representation, decision or control within it, as follows from the certifying certificate issued by the ONRC / constitutive act, - as the case may be, documents proving the fact that the economic operator may benefit from the derogations provided in art. 166 par. (2), art. 167 par. (2), art. 171 of LPublic Procurement Act 98/2016

In the case where in the country of origin or in the country where the economic operator is established no documents of the requested type are issued or they do not cover all the situations covered to art. 164, art. 165 and art. 167, any document deemed to be edifying, issued by the competent authorities of that country, shall be acceptedIn the case of foreign legal / natural persons, the documents will be transmitted in the language in which they were issued, in a certified copy "according to the original", signed and stamped by the legal representative, accompanied by a certified translation in Romanian .
Requirement 2. The bidder, the associated offeror, the subcontractor, the third party and the members of the administration / management bodysupervision / with power of representation, decision or control within the tenderer / associated offeror / third party / subcontractor shall not be in the situations provided for in art. 60 of Law 98 / 2016.
