Note:
The deadline for economic operators to request clarifications or additional information in relation to the awarding documentation is 15 days before the deadline for submission of tenders.
The contracting authority will respond clearly and fully to all requests-clarification: on the 10th day before the deadline set in the tender notice.
1) The level of the participation guarantee is calculated by reference to the estimated value of the framework agreement for each lot, as follows:
- Lot 1 - 4 400 RON,
- Lot 2 - 230 RON,
- Lot 3 - 6 700 RON;
2) Form of incorporation:ituie, on behalf of the tenderer, in accordance with the provisions of art. 36 par. (1) of GD no. 395/2016, respectively, will be constituted by a guarantee instrument issued under the law by a banking company or an insurance company, which is not in special situations regarding authorization or supervision, according to the law (Form 1 ). 3) The term of validity of the participation guarantee shall be at least equal to the period of validity of the offer 4) The guarantee of participation must be irrevocable 5) The guarantee of participation must be pre-explicitly declares that the payment will be executed unconditionally, namely at the first request of the beneficiary based on his / her statement regarding the guilty of the guarantor, and shall be presented in scanned SEAP, by the deadline for submitting the offers, signed with an extended electronic signature, based on a qualified certificate, issued by an accredited certification service provider. In case of warranty-participating in another currency, the equivalent shall be made at the NBR exchange rate displayed on the date of publication of the SEAP participation notice. The Authority will retain / refund the participation guarantee under the conditions of Art. 37 38 of GD no. 395/2016. 5% of the accepted contract value, excluding VAT of each subsequent contract. The guarantee of good execution shall be constituted by any means provided by art.39 and art. 40 of GD no. 395/2016 and will be formed within 5 working days from the signing of the subsequent contract. The contracting authority shall issue / refund the performance guarantee in accordance with the provisions of art. 42 of GD no. 395 / 2016.
Own Revenues.
To demonstrate the fulfillment of the qualification criteria / requirements:
I. Single bidder / affiliate / subcontractorthe suspect / third party must prove that it does not comply with the provisions of art. 164 of Law no. 98/2016. In this respect, the sole bidder / associated offeror / subcontractor / third party will complete the DUAE - Part III "Exclusion Reasons", Section A "Reasons for criminal convictions", subsections:
- "Participation in a criminal organization" "Corruption, " - "Fraud, " - "Interrorist factions or offenses related to terrorist activities,
"Money laundering or terrorist financing, " - "Child labor exploitation and other forms of trafficking in human beings."
The tenderer ranked first after applying the award criterion, on the tenders admissible before awarding the contract, shall present, at the request of the contracting authority, the following documentsedificatory statements proving / confirming non-compliance in the situations provided by art. 164 above, both for the sole tenderer / associated bidder and for the subcontractor / third party stated in the offer:
- the criminal record of the economic operator and the members of the management, management or supervisory body of the respective economic operator or those who have power-representation, decision or control within it, as evidenced by the certifying certificate issued by the ONRC, - other editorial documents, as the case may be, II. The sole tenderer / associated offeror / subcontractor / third party must prove that they do not comply with the provisions of art. 165 of Law no. 98/2016. In this respect, the sole tenderer / associated offeror / subcthe supporter / third party shall complete the DUAE - Part III "Exclusion Reasons", Section B "Reasons for Paying Taxes or Social Security Contributions", subsections:

Also, the tenderer ranked first after application of the award criterion, on the tenders admissible before awarding the contract, will-present at the request of the contracting authority, the following editorial documents proving / confirming non-compliance with the situations stipulated in art. 165 above, both for the sole tenderer / associated offeror and for the subcontractor / third party stated in the offer:
(a) Romanian legal persons must submit: - a certificate of fiscal attestation regarding the fulfillment of the obligation(b) Foreign legal persons shall present any editorial documents issued by the authorized institutions of the country of origin (for the purpose of submitting this certificate, tax accreditation certificates, criminal records, other equivalent documents, etc.) prin order to prove that he has fulfilled his obligations to pay taxes, duties or contributions to the general consolidated budget in accordance with the national law of the country of residence of the sole tenderer / associated contractor / subcontractor / third party or the country in which the sole tenderer / associated bidder / subcontractor / third party is established. (1) lit. a), d) and e) of the Law no. 98/2016 on public procurement. The relevant Form in the "Forms" section of the awarding documentation, which is stamped and signed by the legal representative of the tenderer, will be filled in and submitted by the sole tenderer / associated tenderer / subcontractor / sponsor, along with the DUAE. For the purposes of the provisions of art.60 par. Note 1: The contracting authority does not exclude from the award procedure an economic operator against whom it isskis the general insolvency procedure when, on the basis of the information and / or documents submitted by the economic operator in question, establishes that he has the capacity to execute the public procurement contract. This implies that the economic operator is either in the observation phase and has taken the necessary steps to draw up a feasible reorganization plan, the sustainability of the current activity, either in the judicial reorganization phase, and fully complies with the implementation plan of the plan.

Note 2: In case of an association, documents will be submitted to each of the members of the association. In order to meet the requirement, it is sufficient for the activity of each member to be in accordance with the part of the contract that he / she will undertake. Note 3: According to the provisions of art. 196 par.
