Total value of participation guarantee (GP): 724.45 RON. For each lot, the value of the participation guarantee is mentioned in section II.2 List of lots.

GP is returned under the conditions provided by article 38 of the Law on Application of Law 98/2016, approved by GD 395/2016. be obliged to provide the guarantee of good execution of the contract, within maximum 5 working days from the signing of the contract, according to article 40 of the Norms for the application of Legy no. 98/2016, approved by H.G. no. 395/2016, in the amount of 5% of the value of the contract, without T.V.A., for the period of performance of the contract. This warranty shall be forfeited in the event of any damage that may be caused to the purchaser by non-observance of the contractual provisions.
The Purchaser undertakes to return the performance guarantee in accordance with Art. 42 para. (1) of the Implementing Rules-Of Law no. 98/2016, approved by H.G. no. 395 / 2016.
The non-constitution of the guarantee of good execution and the failure to submit to the purchaser the bank documents proving it, within 5 working days from the signing of the contract, results in the reservation of the participation guarantee and gives the buyer the right, after giving a notice 5 days to the supplier, to unilaterally terminate contract.
D. S. Hunedoara will reduce the deadline for submission of tenders to 15 days from the date of submission for publication of the contract notice, in accordance with the provisions of art. 74 par. (3) of the Law no. 98/2016. The reduction of the term is motivated by the fact that the purchased products are necessary for the detection and control of tree pests starting with the second decade of April, depending on the altitude zone. Failure to conclude contracts in a timely manner would compromise the campaign, generating significant economic losses. Also, we consider that the 15-day period is sufficient for the elaboration of the offer, the documentation is relatively simple, the forms with the technical and financial offer easy to complete, and the products to be delivered presenta small degree of diversification and a relatively small volume.
The contract will be modified under the conditions of art. 221 of the Law no. 98 / 2016.
The communication of the outcome of the procedure will be transmitted to S.E.P. and by using one of the following communication modalities: fax / e-mail / mail.
Requests for clarifications formulated by the contracting authority's evaluation committee will beIf, for technical reasons exclusively related to the technical performances of the SEAP computer system, it is not possible to transmit the documents electronically through SEAP, they shall be transmitted to the contracting authority within the required time limit: by e -mail (signed electronically)
The contracting authority has the right to request ain exceptional circumstances, before the expiry of the period of validity of the offer, the extension of that period. If the offer extends, the period of validity of the guarantee for participation will be extended accordingly. The tenderer has the obligation to communicate to the contracting authority whether or not he agrees to the extension of the period-validity of the offer. The tenderer who disagrees with the extension of the offer period is deemed to have withdrawn its offer, without this leading to the loss of the participation guarantee. The bidder will submit a statement accepting the contract terms contained in the contract assignment documentation. If there are objections to the project-contract, respectively changes / deletions of the contractual clauses or the addition of new clauses, any proposals for modification / completion / deletion of contractual clauses will be formulated in writing, through clarification requests. Mandatory contractual clauses may be amended and made known to all interested parties by the closing date for submission of tenders, while Clausethey may be negotiated / modified as long as they do not introduce conditions that would have allowed the award of the contract to another economic operator or if the change does not change the economic balance of the contract in favor of the contractor.
If the bidder makes an association with other operators, third-party supporters or subcontractors, other than expressly requested documentsof Cap. III.1.1 - Terms of Participation, including Supplementary Statement of Understanding / Association Agreement / Subcontracting Agreement, as appropriate, drafted in accordance with legal provisions, will be included in the offer.
