The subject of the order is the provision by the Contractor of services consisting in cutting down trees and shrubs inwithin the operation of the Railway Lines Plant in Opole, along with the purchase by the Contractor of timber harvested as part of the logging divided into 2 tasks: - Task No. 1 - cutting trees and shrubs within the operation of the Railway Lines Plant in Opole with the purchase of timber harvested by the Contractor .

1. Contractors may participate in the Proceedings, wowhich there are no grounds for exclusion from the proceedings under Art. 24 sec. 1 point 12-23 of the Public Procurement Law (PPL) [excluding the premises specified in para. 1 point 13 lit. d and point 14 of the PPL regarding the crime referred to in art. 24 sec. 1 point 13 lit. d Pzp] (premises for mandatory exclusion) and pursuant to art. 24 sec. 5 Pzp (reasons for exclusion optional) oonce meeting the conditions for participation set out in point 8.6. IDW

According to art. 22 par. 1b of the Act, the Contractors who meet the conditions related to

2.1 may apply for awarding the Contract. Competence or entitlements to a given professional activity, if it results from separate regulations,

2.2. The economic or financial situation,

2.3. Technical or professional capacity.

3. In order to showthat there are no grounds to exclude from the Procedure and confirm that the conditions for participation in the Procedure have been met, each of the Economic Operators shall submit a Single Document in electronic form bearing a qualified electronic signature.

4. In the case of joint application for contractors, the Single Document shall be submitted by each of the contractors jointly applying for the order.

5. INa contractor who relies on the resources of other entities to demonstrate the absence of grounds for exclusion and compliance with them, to the extent that they refer to their resources, the condition of participation in the proceedings also submits a Single Document for each of these entities together with the obligation entities to hand over to the Contractor the necessary resources for the performance of ZaIn terms of education, professional qualifications or experience, Contractors may rely on the capacities of other entities if these entities provide services for the performance of which these capabilities are required. The Contractor who indicates in the Single Document parts of the orders he intends to entrust to subcontractors in order to demonstrate the lack of existence inpresent grounds for exclusion, submit a Single Document for each of these subcontractors.

7. The Awarding Entity shall call the Contractor whose offer has been best assessed to submit within the prescribed period not shorter than 10 days valid as at the date of submitting statements or documents confirming the circumstances referred to in the Single Document.

It is required that the Contractor demonstrates that he knowshe is employed in an economic and financial situation ensuring the performance of the Contract, i.e.: 1) he is insured against civil liability in the scope of activities related to the subject of the order: not less than: - in the case of an offer for Task No. 1 - 1 000 PLN 000.00 (in words: one million zlotys 00/100)

- in the case of submitting an offer on Task 2 - 1 000 000.00 PLN (in words: one million zlotys 00/100)

- In the case of submitting an offer for two tasks, the Contractor is obliged to prove that he has liability insurance in the scope of conducted activity related to the subject of the order for an amount not lower than the total value insurance required for both tasks, i.e. not less than PLN 2, 000.00.00 (say: two million zlotys)00/100)

In the case of joint offer (consortium), the insurance value will be the sum insured of the companies forming the consortium.

2) Has funds or creditworthiness - in the amount of: - - in the case of submitting an offer for Task No. 1 - no less

PLN 500, 000.00 (in words: five hundred thousand zlotys 00/100)

- in the case of submitting an offer for Task No. 2 - no less

500PLN 000.00 (in words: five hundred thousand zlotys 00/100)

- In the case of submitting an offer for two tasks, the Contractor is obliged to prove that he has not less than 1 month before the deadline for submitting bids, financial resources or creditworthiness than the total insurance value required for both tasks, i.e. not less than PLN 1, 000.00.00 (say: one million zlotysych 00/100)

As the exchange rate for PLN of financial data expressed in currencies other than PLN, the average exchange rate published by the National Bank of Poland on the first working day of the month in which the contract notice was published in the Official Journal of the European Union should be adopted. The contracting authority may at any stage of the procedure call for contractors to submit all or some of the axlesor documents proving that they are not subject to exclusion, meet the conditions for participation in the proceedings, and if there are reasonable grounds to consider that the previously submitted statements or documents are no longer valid, to submit valid statements or - Documents

2. Contractor within 3 days of posting information on the website referred to in art. 86 par. 5 Ustawy submits the statement referred to in art. 24 sec. 11 of the Act on the affiliation or lack of belonging to the same capital group as referred to in art. 24 sec. 1 point 23 of the Act. In the case of belonging to the same capital group, the Contractor may submit together with the statement documents or information confirming that connections with another Contractor do not lead to distortion of competition inproceedings. The statement prepared in accordance with the form included in Attachment No. 6 to the ToR shall be submitted by each of the Contractors who submitted the offer (also applies to Contractors appearing jointly).
