The subject of the order is the delivery of a manned ZSP aircraft of a motorized research platform. A detailed description of the subject of the contract is included in Part II of the ToR. The subject of the order is the delivery of a manned ZSP aircraft - a motorized research platform. A detailed description of the subject of the contract is included in Part II of the ToR. Description of the subject of the contract. In accordance with art. 30 paragraph 4 Public Procurement Law authorizing equivalent solutions described in SIWZ by means of standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 30 paragraph 1 point 2 and 3 of PPL, if they allow obtaining features or parameters not worse than those referred to in part II of the ToR. In accordance with art. 30 paragraph 5 Public Procurement Law, the contractor who refers to the equivalent solutions described by the contracting authority, is obliged to demonstrate that the supplies he offers meet the minimum requirementsmagania specified by the contracting authority. Documents confirming the equivalence referred to in art. 30 paragraph 5 Public Procurement Law should be submitted with the offer. The contracting authority does not reserve the obligation for the contractor to personally carry out works related to the placement and installation as part of the supply contract. The contractor may entrust subcontractors with the implementation of the elements (parts) of the contract. In the case ofthe intention to perform the subject of the contract with the participation of subcontractors, the contractor is required to indicate in its offer: part of the contract (material scopes) which the contractor intends to entrust to subcontractors and the contractor to provide subcontractors. This indication should be placed on the offer form. In the absence of an indication in the subcontracting offer, the contractor will be able to introducesubcontractor only on the conditions set out in the contract. 93 item 1a of the Public Procurement Law, if the funds from the European Union budget that the contracting authority intended to spend on financing all or part of the contract will not be awarded to it.fulfillment of the condition of participation in the procedure with respect to the condition of competence or entitlements to conduct specific professional activities. technical or professional or fi situationsfinancial or economic status of other entities, irrespective of the legal nature of their relations with them. In such a situation, the contractor must prove to the contracting authority that, when carrying out the contract, it will have the necessary resources of these entities, in particular, presenting the undertaking of these entities to provide it with the necessary resources at the disposal of the contract. If youthe contractor, demonstrating compliance with the conditions for participation in the procedure, relies on the resources of other entities under the principles set out in art. 22a paragraph 1 Public Procurement Law, will be obliged to:

1) make a statement of another entity about meeting the conditions for participation in the proceedings (in terms of the condition in relation to which it provides its potential) and no grounds for exclusion submitted on the EAT form. EAT should be PLNcome alive together with the offer in electronic form with a qualified electronic signature;

2) submitting together with the offer the undertaking of another entity to give the contractor the necessary resources for the implementation of the contract. The undertaking must be submitted together with the original offer in the form of an electronic document bearing a qualified electronic signature or an electronic copy of the undertakingcertified as true to the original;

3) presentation in relation to these entities of documents confirming the absence of grounds for exclusion pursuant to art. 24 paragraph 1 point 13 22 and art. 24 paragraph 5 point 1 Public Procurement Law - indicated in point VI.3 of this announcement. The contractor will be obliged to submit these documents in the original in the form of electronic documents or electronic copies of the documentsor statements certified as true to the original within a time limit specified by the contracting authority, not less than 10 days, specified in the call issued by the contracting authority to the contractor after the opening of the offers.

In the case of the offer of contractors jointly applying for the award of the contract (consortium):

a) in the bid form, indicate the companies (names) of all contractors togetherrequesting a contract;

b) the offer must be signed in such a way as to legally bind all contractors jointly applying for the contract. The person signing the offer must have legal representation. The authorization must result from the content of the power of attorney attached to the offer, the content of the power of attorney should specify the scope of the authorization. The offer includesattach the original power of attorney in electronic form with a certified qualified electronic signature;

c) EAT submitted by each of the contractors jointly applying for the contract. These documents confirm the fulfillment of the conditions for participation in the procedure and the lack of grounds for exclusion to the extent that each of the contractors demonstrates compliance with the conditions for participation in the procedure and the lack ofgrounds for exclusion;

d) none of the contractors may be subject to exclusion due to non-compliance with the conditions referred to in art. 24 paragraph 1 point 12 23 and art. 24 paragraph 5 point 1 Public Procurement Law, while compliance with the conditions for participation in the proceedings of the contractor demonstrate in accordance with point 6.3. part I of the ToR;

e) documents confirming no grounds for exclusion indicated in point VI. 3 of this announcement appliesEach contractor jointly applying for the contract will be submitted by the deadline indicated by the contracting authority, not shorter than 10 days. In the event of joint application for the contractors by the contractors, a declaration of belonging not belonging to the same capital group shall be made by each of the contractors.

This condition will be considered fulfilled if the contractor proves that psettles in the bank or cooperative savings and credit union funds or creditworthiness, in the amount of at least PLN 1, 500, 000.00 (in words: one million five hundred thousand zlotys). In order to initially confirm that the condition of participation in the procedure has been met, the contractor will be required to provide the contracting authority with a declaration made on the form of a single European document forspeaking (hereinafter: "EAT"), when completing the document should be marked in part IV (α) first line EAT. EAT must be submitted together with the offer in electronic form with a qualified electronic signature.

In order to definitively confirm that the contractor meets the condition of participation in the procedure, at the request of the contracting authority, the contractor submits information from the bank or cooperative fundof credit and credit confirming the amount of financial resources or creditworthiness of the contractor, not earlier than 1 month before the deadline for submission of tenders. to the contractor after opening the offers. Contractors who are not subject to exclusion from the contract award procedure may participate in the proceedings in the circumstances referred to in art. 24 paragraph 1 point 12 23 Public Procurement Law

In addition, the contracting authority will exclude the contractor based on art. 24 paragraph 5 point 1 of the PPL. In order to pre-confirm the lack of grounds for exclusion from the procedure, the contractor submits a statementHandling in the form of a Single European Order Document (EAT) 24 paragraph 1 point 12 22 Public Procurement Law and art. 24 paragraph 5 point 1 of the PPL. The method of completing the EAT has been included in Chapter 7 of Part I of the ToR.da:

1A. an excerpt from the relevant register or from the Central Register and Information on Economic Activity, if separate provisions require an entry in the register or register, to confirm the absence of grounds for exclusion pursuant to art. 24 paragraph 5 point 1 Pzp;

2B. information from the National Criminal Register in the scope specified in art. 24 paragraph 1 item 13, 14 and 21 of the PPL, issued not earlier than 6 monthsbefore the bid submission deadline;

3C. Contractor`s statement that he has not issued a final court judgment or final administrative decision regarding late payment of taxes, fees or social security or health insurance contributions, or in the event of such judgment or decision being issued, documents confirming payment of these debts together with any possible deductionsdocuments or fines or conclusion of a binding agreement on the repayment of these debts (in relation to the exclusion condition described in Article 24 paragraph 1 item 15 of the PPL);

4D. Contractor`s declaration of no decision against him as a precautionary measure forbidding public procurement (with respect to the exclusion condition described in Article 24 (1) (22) of the Public Procurement Law

To confirmand the lack of grounds for exclusion from the contract award procedure in the circumstances referred to in art. 24 paragraph 1 item 23 of the PPL, the contractor will be obliged to submit a declaration of belonging or not belonging to the same capital group.

If the contractor has its registered office or place of residence outside the territory of the Republic of Poland instead of the documents:

a. indicated in item 1A pabove - submits a document or documents issued in the country in which he has his registered office or place of residence, confirming accordingly that its liquidation has not been opened or that bankruptcy has been declared,

b. indicated in item 2B above submits information from the relevant register or, in the absence of such register, another equivalent document issued by the competent court or administrative authority of the country, in which the contractor has its registered office or place of residence or place of residence has a person to whom the information or document relates to the extent specified in art. 24 paragraph 1 item 13, 14 and 21 of the PPL. These documents should be issued not earlier than 6 months before the deadline for submission of tenders. If in the country in which the contractor has its headquarters or place of residence, no documents are issued aboutmentioned above, they are replaced by a document containing a statement of the contractor, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to relate, submitted before a notary public or before a judicial, administrative or professional or economic self-government body competent for for the seat or place of residencethat person`s contractor or place of residence.
