Implementation of agro-aviation services in the Forest State Forestry Offices commissioned by the Regional Directorate of State Forests in Wrocław in 2018 - Reference Number: ZO.270.1.3.2018
The subject of the order is the performance of agrotechnical services (aerial spraying of pine and oak stands from insect pests threatening the durability of the forest), a biplane planem on the territory of the Regional Forests Directorate of State Forests in Wrocław and in the Wymiarki forest inspectorate in 2018, in an amount of 80 hours of flight.
Main Site: The area of forest districts of the Regional Directorate of State Forests in Wrocław and the Wymiarki Forest District.
3.1. The subject of the order is the performance of agrotechnical services (aerial spraying of pine and oak stands from insect pestsh) threatening the durability of the forest), a biplane plane within the territory of the Forest District Directorate of the State Forests in Wrocław and the Wymiarki Forest District in 2018, in the amount of 80 hours of flight.
3.2. The treatments will be carried out by a pilot or pilots with:
- CPL pilot licenses,
- permission to perform agro flight,
- current certificate of completed training in the field ofuse of plant protection agents with agricultural equipment.
The treatments will be carried out with a biplane plane, which can take a load of the product with a mass of at least 1350 kg. The aircraft must be equipped with agrotechnical devices enabling ultra-low-volume spraying (ULV) and have a GPS device for precise guidance of the aircraft to the treatment areas and nalo logginghere and recording the places of spraying. An airplane intended for spraying must be able to take off with a load and land on a grass landing field 700 m long.
3.4. The number of hours of flight time planned for execution during the course of the order may be lower than the number of hours of air raid indicated in point 3.1. SIWZ, which, however, can not be the basis for any claimsń in relation to the Employer. The contracting authority may order in the course of execution fewer hours of flight time than the one indicated in point 3.1. SIWZ, however, not less than 50 hours of flight.
3.5. The Ordering Party is entitled to commission the Contractor an additional material range covering activities similar to those described above in a maximum amount of up to 70 hours of flight time ("Option"). Payment for the service performed as part of the optionand will be determined as the product of the number of flight hours taken and the price per 1 hour of gross flight indicated by the Contractor in the offer form. The Employer is not obliged to commission works covered by the subject of the Option, and the Contractor is not obliged to claim their order.
3.6. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors. If you intend to performsubject of the orders involving subcontractors The Contractor is obliged to indicate in his offer: parts of the orders (material ranges), which the implementation is going to entrust subcontractors and submission by the Contractor subcontractors. Such an indication should be placed on the offer form (Annex No. 1 to the Terms of Reference). In the absence of indication of subcontracting in the offer, the Contractor will be able toto overtake a subcontractor only on terms specified in the contract
3.7. The Employer requires employment by the Contractor or a subcontractor based on a contract of employment of persons performing activities included in the subject of the order consisting of the work of a pilot and mechanic, if the performance of these activities consists in performing work in the manner specified in art. 22 - 1 of the Act of June 26, 1974 - Kleave of labor (consolidated text: Journal of Laws of 2018 item 108, as amended).
6.2.1) This condition will be considered fulfilled if the Contractor is authorized to perform aviation activities within the scope of the contract, in particular, it has:
7.1.c) a certificate issued by the President of the Civil Aviation Authority or an equivalent document issued by a foreign state authority or by the competent institution-specialized, recognized by the President of the Civil Aviation Authority, valid on the last day of the deadline for submission of offers, in accordance with the provisions of the Act of 3.7.2002 Aviation Law (Journal of Laws of 2017, item 959, as amended) or current authorization of the President of the Civil Aviation Office for high-risk specialized commercial operations (SPO-HR / 965) - in the field of agro-flight operations

6.1. W postępowaniu mogą brać udział Wykonawcy, ktorzy nie podlegają wykluczeniu z postępowania o udzielenie zamowienia w okolicznościach, o ktoreferred to in Article 24 sec. 1 item 12-23 of the PPL, art. 24 sec. 5 point 1 and point 8 of the PPL. On the basis of:
1) art. 24 sec. 5 point 1 of the PPL The Awarding Entity will exclude a public contractor from the proceedings for which the liquidation has been opened, in the system approved by the court in the restructuring proceedings, the satisfaction of the creditors by the liquidation of his assets or courthe liquidated his property pursuant to art. 332 par. 1 of the Act of 15.5.2015 - Restructuring Law (consolidated text Journal of Laws of 2017, item 1508, as amended) or whose bankruptcy was announced, with the exception of the contractor who, after the bankruptcy, concluded an arrangement approved by a legally valid court order, if the arrangement does not provide for the satisfaction of the creditors by liquidating the assets of the bankrupt, unless-the court ordered the liquidation of his property in the mode of art. 366 para. 1 of the Act of 28.2.2003 - Bankruptcy Law (consolidated text Journal of Laws of 2017, item 2344, as amended),
2) art. 24 sec. point 8 of the PPL The Awarding Entity will exclude a public contractor from the public procurement procedure who has violated obligations regarding tax payments, fees or social security or health insurance premiums, which he ordersable to demonstrate by means of appropriate evidence, except in the case referred to in Article 24 sec. 1 point 15, unless the contractor has made payment of taxes, fees or social or health insurance contributions, including interest or fines, or has entered into a binding agreement regarding the repayment of such claims. - Contractor who is subject to exclusion pursuant to art. 24 par. 1 point 13 and 14 and 16-20 of the PZP or art. 24 sec. 5 point 1 and 8 of the PPL, may provide evidence that the measures taken by him are sufficient to demonstrate its reliability, in particular to prove compensation for damage caused by a crime or fiscal offense, financial compensation for damage suffered or remedied, a comprehensive explanation of the facts and et alcooperation with law enforcement agencies and undertaking specific technical, organizational and human resources measures that are appropriate to prevent further offenses or fiscal offenses or improper conduct of the contractor. The provision of the first sentence shall not apply if the contractor, being a collective entity, has been the subject of a final court ruling against applying for
The contractor is not subject to exclusion, if the contracting authority, considering the weight and special circumstances of the contractor's action, considers the presented evidence to be sufficient.
6.2.2) The contracting authority does not impose specific requirements regarding the description compliance with the condition of participation in the proceedings with respect to the condition regarding the capacity of eEconomical. The condition with respect to the financial situation will be fulfilled if the Contractor shows that he has the financial means or the creditworthiness not less than PLN 200, 000.00. In order to confirm compliance with the conditions for participation in the proceedings referred to above, the Contractor will be required to provide the Employer with the following declarations and documents (within the time limits indicated inSIWZ):
7.1.d) information from the bank or cooperative savings and credit union confirming the amount of funds held or the creditworthiness of the Contractor, in a period not earlier than one month before the deadline for submitting bids.

7.1. In order to confirm the lack of grounds for exclusion from the proceedings referred to in point 6.1. and to confirm compliance with the conditions for participation in the proceedings referred to in point 6.2. The Contractor will be required to provide the Employer with the following statements and dokumenty (on the dates indicated in this ToR):
a) Contractor's statement constituting preliminary confirmation of compliance with the conditions for participation in the procedure set out in this SIWZ and no grounds for exclusion, submitted on the uniform European order form (hereinafter "EAT"), whose model it is specified in the Commission Implementing Regulation (EU) 2016/7 of 5.1.2016the standard form of a single European order document (Official Journal of the EU, L series 2016, No. 3, page 16). The content of EAT has been specified in Attachment 2 to the ToR, however, due to the necessity to provide a significant amount of information in the content of EAT, the Ordering Party recommends using an editable version of this document placed on the Ordering Party or at https://www.uzp.gov.pl/ nayfor-knowledge / uniform-European-document-orders. EAT should be submitted in writing. • b) evidence that the services shown in the EED to prove the fulfillment of the condition for participation in the technical or professional capacity in the field of experience have been carried out or are carried out properly. • The proofs referred to above are references or other documents issued by the entity forwhose services were performed, and in the case of periodic or continuous services are performed, and if for a justified reason of an objective nature the contractor is unable to obtain these documents, the contractor's statement. In the case of periodic or continuous services, references still to be made or other documents confirming their proper performance should be issued not earlyj) than 3 months before the deadline for submitting bids. e) excerpt from the relevant register or central records and business information, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion pursuant to art. 24 sec. 5 point 1 PPL;
f) certificate from the competent head of the tax office confirming that the contractor is not in favor oflega with the payment of taxes, issued not earlier than 3 months before the deadline for submission of tenders or other document confirming that the contractor has concluded an agreement with the competent tax authority regarding repayment of such receivables with possible interest or fines, in particular obtained the legally required exemption, postponement or spreading overdue payments or suspensions in installmentsto fully implement the decision of the competent authority, - the Purchaser requires a bid bond in the amount of PLN 15, 000. The bid bond should be paid by bank transfer to the bank account of the Employer: 93 1540 1030 2001 7700 2121 0003 with the following note: a deposit for the protection of the offer in the proceeding for "The performance of agrotechnical services in the territory of-forest districts of the State Forests at the request of the Regional Directorate of State Forests in Wrocław in 2018. "The deposit in cash will be effective if it is credited to the Contracting Party's bank account within the given period.
Deposit paid in a form other than money may be attached in original to the offer or submitted in the original before the deadline for submitting offers.
At the headquarters of Zaspeaker (room 119). The bid bond must secure the offer throughout the period of being bound by the offer. The offer of the Contractor, who will not pay the bid bond or will not secure the offer with an acceptable form of the bid bond within the prescribed period, will be rejected from the proceedings under Art. 89 paragraph 1 point 7b of PPL.
When selecting the offer, the Contracting Authority will be guided by the following criteria for the evaluation of offers:
1) Price - 60%,
2) Toprovision of persons designated for execution of orders - 40%
Within the criterion "Experience of persons designated for execution of orders", the Employer will assess the experience of the pilot or pilots indicated by the Contractor to implement the order. Annex 1 to the ToR.
OfferThis will receive a maximum of 40 points if the pilot or pilots designated by the Contractor to implement the orders have a documented airstrip of more than 3, 000 hours. The offer will receive 20 points if the pilot or pilots designated by the Contractor to perform the orders have a documented airstrip in the amount above 1 500 hours.
The offer will receive 0 points if the pilot or piloci indicated by the Contractor to perform the orders have a documented airstrip in the amount of 1 500 hours or less.
If the Contractor in the offer form will indicate 2 or more pilots to assess this criterion, the Employer will accept the pilot with the lowest coating - For the most advantageous offer will be the offer that will get the highest sum of points obtained in the above criteria foroffers. The offer may receive a maximum of 100 points.
Before concluding a public procurement contract, the Contractor whose tender has been considered the most advantageous is obliged to complete the following formalities:
1) submit to the Purchaser:
a) consortium agreement, if the contract will be implemented by contractors jointly applying for ordering;
b) pilot licenses-CPL,
c) pilot's license to perform agro-flight,
d) current pilot's certificate of completed training in the use of plant protection crops.
Failure to comply with the above-mentioned formalities will be treated as the Contractor's evasion of the public procurement contract.
