HIRING OF CONSULTANCY SERVICES FOR THE DIVERSION TOOLKIT DEVELOPMENT

The Juvenile Justice and Welfare Council (JJWC), through the Policy and Research Division (PRD) intends to apply the sum of Three Hundred Seventy Thousand Pesos (Php370, 00.00) as Approved Budget for the Contract (ABC) chargeable against the JJWC UNICEF Funds for the Procurement of Consultancy Services for the Diversion Toolkit Development
I. RATIONALE
Republic Act No. 9344 as amended defines diversion as an alternative and child-appropriate process of determining the responsibility and treatment of a child in conflict with the law, on the basis of the child-s social, cultural, economic, psychological or educational background, without resorting to formal court proceedings. The same Act declares that the State shall apply the principles of restorative justice in its policies and programs for CICL. This principle requires the involvement of the victim, the parents of the CICL, the local duty bearers and the community in the process of resolving the conflict, teaching the CICL about the accountability and making him accountable, providing intervention to the child and the family to rehabilitate and successfully reintegrate the child to the community and prevent reoffending.
In 2015, the Universalia Study on the Evaluation of the Intervention and Rehabilitation Program in Residential Care Facilities and Diversion Programs for CICL commissioned by UNICEF found that at the LGU level, duty bearers such as the barangay officials, police officers and prosecutors usually are not aware about the provisions on diversion and their role in the implementation. To address this concern, the JJWC initiated various projects in partnership with UNICEF, to wit: (1) Integrated Case Management (ICM) Protocol and the Process Flowcharts to guide duty-bearers in the child-sensitive and rights-based treatment and management of children at-risk (CAR) and children in conflict with the law (CICL), (2) Training Module on ICM Protocol and the Enhanced Process Flowcharts to ensure that the protocols are actually translated into enhanced capacity of duty-bearers to manage the cases of CAR and CICL, (3) Biboy Film, which is both an advocacy and training material on initial contact and diversion, (4) Barangay Protocol in Managing CAR and CICL Cases, which was developed primarily for the use of duty-bearers at the barangay level. The Barangay Protocol has been issued by the Department of Interior and Local Government through Memorandum Circular No. 2017-43 issued on March 9, 2017.
Despite these initiatives, the translation of these protocols and training modules and the application of the restorative justice principle through the actual conduct of diversion proceedings and diversion and intervention programs for children at-risk and children in conflict with the law remains to be a challenge.
Notably, the National Situational Analysis of Children in Conflict with the Law also revealed that diversion program, although perceived as a relevant intervention to appropriately meet the needs of the CICL as it allows the CICL to remain in their families, provides limited information on the diversion programs implemented and the actual number of CICL whose right to diversion has been fulfilled by duty bearers. There is also limited information on the number of CICL undergoing diversion, on the results of the diversion process and on the number of CICL placed under alternative measures to detention.
Likewise, the results of the Trainings Needs Assessment conducted by JJWC among social workers, law enforcement officers, PAO Lawyers, Prosecutors and other court duty bearers revealed that majority (90%) of them have no experience in facilitating diversion proceedings or have attended or participated in such activities.
