Cascading of Agrarian Laws, Lecture on Alternative Dispute Resolution before the Barangay Agrarian Reform Committee of Kayapa, Aritao, and Kasibu, Nueva Vizcaya

RATIONALE:

Republic Act 6657 otherwise known as Comprehensive Agrarian Reform Law provides for the Charter of the Department of Agrarian Reform. This law embodies the State policy of pursuing Comprehensive Agrarian Reform Program (CARP) aimed at liberating the vast potential wealth of Philippine agriculture by giving the majority of the Filipinos the real and rightful stake in the land. It also provides for the structural composition of public servants from the Secretary of the Department to the Rank and File employees.

RA 6657 also provides for the development of the past agrarian laws which were amended by this act and further strengthened by RA 9700.

Today, there are more and more land owners and farmers who acknowledge their improved living condition due to the program. Somehow, conflicts between Land Owners (LO-s) and Agrarian Reform Beneficiaries (ARB-s) are inevitable. Settlement of conflicts between LO-s and ARB-s must be given utmost and primordial consideration before they go to courts.Hence, a mechanism crafted by law was spawned, and that is the Alternative Dispute Resolution (ADR). ADR through Conciliation proceeding and Mediation is bolstered by the law-making body in order to declog court dockets, minimize litigations as much as possible and avoid unnecessary expenses and costs of cases.



Therefore, there is a necessity to bestow knowledge to the BARC membersof the following:

(a) Rights and Obligations of Land Owners and Agrarian Reform Beneficiaries under RA 6657;

(b) Salient features of RA 3844 or the Agricultural Land Reform Code on Tenancy;

(c) RA 9700 and other Agrarian Laws;

(d) The composition and functions of the BARC;

(e) Procedure to redress agrarian law in the implementation of cases and agrarian disputes;

(f) Mechanics of mediation;

(g) Procedure that facilitatesand protects their substantial rights; and

(h) Their role in the implementation of the program on land acquisition, project identification and agrarian justice delivery.

This activity aims to retool the Barangay Agrarian Reform Committee Chairmen in Kayapa, Aritao and Kasibu, Nueva Vizcaya that will enhance their capabilities, knowledge and skills by supplying them with agrarian law insights in serving the public, especially the conduct of Alternative Dispute Resolution in their jurisdiction.



DATE AND VENUE:

The activity shall be conducted on the11th and 12thof December in the Municipality of Bayombong or Solano.

DURATION:

From the afternoon of December 11, 2017, one of clock to five of clock and December 12, 2017, eight to twelve in the morning because of the travel time of the participants coming from different far flung areas of Kayapa, Aritao and Kasibu and going to the venue.
