This requirement is considered for a sole source award by the contracting officer due to the technical and proprietary nature of the equipment and supporting software that can only be provided by the OEM and/or their authorized representatives. A sources sought was sent out on 2/5/2026 for all small business venders to state if they could provide the equipment and supporting software required to meet this requirement, only one of the few responses that were received for this sources sought provided the information required in accordance with the sources sought.
Another consideration for any contract award is price reasonableness which the contracting officer has to make a determination based upon any available pricing information that was discovered during the market research stage of the pre-solicitation process. The contracting officer is under no obligation to award to any small business regardless of their socioeconomic status if the contracting officer based upon market research has determined that the best value to the government would be to award to other than a small business.
