Purchase item: Open bidding is conducted without the use of an electronic auction. At the same time, the customer indicates in the announcement the amount of the minimum step of the decrease in the price for the execution of paragraph 11 of Part 2 of Art. 21 of the Law of Ukraine "On Public Procurement" (Law). The date and time of the electronic auction are determined by the electronic procurement system automatically in accordance with Part 3 of Art. 21 of the Law without the participation of the customer. The situation is conditioned by the contradiction between normative legal acts governing the same legal relations (Law and Resolution of the Cabinet of Ministers of Ukraine dated 12.10.2022 No. 1178 in the current editions) and the peculiarities of the electronic procurement system.
