The subject of this procurement is "Select a contractor for the activities on pagesupervision under Art. 168 of the Territorial Development Territorial Plan under the project "Basic Reconstruction of Central Pedestrian Zone", BG16RFOP001-1.010 "Implementation of Integrated Urban Reconstruction and Development Plans 2014-2020 - Vidin." The Construction Supervision Service includes control over the construction process and preparation of the necessary documentation - from the opening of the construction site to the issuance of a permit for pThe implementation of this tender includes the following activities:
1) Activity 1: Preparation of a complex report for the assessment of the conformity of the constructed investment projects in accordance with Art. 142, para. 6, item 2 of the Territory Arrangement;
- Conformity Assessment under Art. 142, para. 6 (2) of the Territory Management Act (including assessment of the conformity of part "Constructive" according to Article 142, paragraph 10 of the Territory Management Act, asas well as assessment of the compliance of the investment projects of the pedestrian zone with the essential requirement under Art. 169, para. 1, item 6 of the SPA) - as a complex report for the pedestrian zone, which is the object of intervention under the project. In carrying out the assessment of the compliance of the investment projects with the essential requirements of the works, the Contractor shall be responsible for compliance with the requirements of Art. 142,para. 5 and para. Article 2: Activity 2: Exercise of construction supervision during the execution of the construction works -
Exercise of construction supervision: the contractor is responsible for its activities and obligations as a participant in the investment process, regulated in Art. 166 and Art. 168 of the TDA, as well as for those arising from Art. 178 of the TDA. Construction supervision is performed in the mandatory scope according to the requiredthe requirements of Ordinance No. 3 of 2003 for the preparation of acts and protocols during construction, taking into account the requirements of the Ordinance on the essential requirements for construction works and conformity assessment of construction products and all legal and regulatory acts in the field of the construction works in Bulgaria.
The construction, which is the object of exercising construction supervision, is fourththe third category of construction works, located in the city of Vidin - district 371, complex "Central Urban Area" and district 329, complex "Services Area"
The estimated total built-up area of the construction works is: - First Stage: 12 363 sq. M., - Second Stage: 15 804 sq. M., - Third Stage: 13 627 sq. M. The participant must hold a valid certificate / license for exercising the activities under Art. 166, para. 1, item 1 of the TDA-according to Art. 166, para. When a participant in a procedure is a foreign person, he / she must hold a document certifying the right to carry out such activities, issued by a competent authority of a Member State of the European Union or of another State party to the Agreement on the European Economic Area according to Art. 166, para. 7 of the Territorial Development Act - If the participant participates asassociation, certificate / license / for exercising the respective activity under Art. 166, para. 1, item 1 of the TDA must have each member of the group that will perform construction supervision and / or assessment of the compliance of the investment project, according to the distribution of the participation in the implementation of the activities provided for in the contract for the creation of the grouping. The requirement applies also to sub-fillThe participant shall provide the required information under item 1 of Part IV "Selection Criteria", Section A "Eligibility", item 1 of EEDOP, indicating data on the entry of the participant in the respective professional register in the Member State in which it is established with a precise reference to the document, number, date and scope, indicating whether the edocuments are available in electronic format as well as a web address, authority or service issuing the registration document.
To prove the above requirements, the participants submit before the conclusion of a public procurement contract according to Art. 67, para. 6 of the Public Procurement Act or upon request in the course of the procedure under Art. 67, para. 5 of the Public Procurement Act: a copy of a valid certificate / management license validated by the participantbringing together the activities under Art. 166, para. 1, item 1 of the TDA, accompanied by a list of the technically competent natural persons through whom the activity is exercised according to Art. 166, para. 2 of the TDA issued in the name of the Contractor (the participant (s) in the consortium according to the distribution of the participation in the performance of the activities provided for in the contract for the formation of the grouping) or an equivalenta document issued by a competent authority of a Member State of the European Union or of another State party to the Agreement on the European Economic Area according to Art. 166, para. 7 of the TDA.
1. The participant must have achieved a minimum total turnover in the scope of the contract - "exercise of construction supervision and / or assessment of the compliance of the investment project"for the last three financial years ended (2014, 2015 and 2016), depending on the date on which the participant was established or commenced its activities, at the estimated value of the procurement.
When using a subcontractor, the turnover requirements apply and for each of the subcontractors according to the type and the share of the order they will perform
The participant should provideand the required information under item 2.1. in Part ІV "Selection Criteria", Section B, "Economic and Financial Condition", item 2a of the EEDOP.
In order to prove the above mentioned requirements, the participants shall submit before concluding a public procurement contract according to Art. 67, para. 6 of the Public Procurement Act or upon request in the course of the procedure under Art. 67, para. 5 of the Public Procurement Act:
1) certified copy of the annual financial statements for the lastthe three completed financial years (2014, 2015 and 2016), depending on the date on which the participant was established or started its activity, or their components when required to be published, 2) yearly reference for the realization total turnover in the scope of the procurement - "exercise of construction supervision and / or assessment of the compliance of the investment project"(2014, 2015 and 2016), depending on the date on which the participant was established or commenced.
Where, for a good reason, a participant is unable to provide the documents requested by the contracting authority, it may to prove its economic and financial standing with the help of any other document that the Assignor deems appropriate. The participant-should have valid professional liability insurance in accordance with Article 171 of the TDA and Article 5, Paragraph 3, Item 3 and Paragraph 4, Item 3 of the Ordinance on the Terms and Procedure for Compulsory Insurance in Design and Construction or an Equivalent a document for non-residents according to the legislation of the state in which they are established, with cover corresponding to the object of the contract deriving from the norm(if the participant participates as a joint venture, valid professional liability insurance must have each member of the grouping that will exercise construction supervision according to the distribution of the participation in the performance of the activities, provided for in the pooling agreement, and the subcontract is also applicableit is the responsibility of the subcontractors to perform the respective activities.
When the participant provides for the participation of subcontractors, the requirement shall be demonstrated for those subcontractors who, depending on the type and the share of the contract awarded, will execute construction supervision. 2.2. in Part IV "Selection Criteria", Section B, "Economic and Financial Condition", item 5 of EESUPPLEMENTARY PROVISIONS
In order to prove the above mentioned requirements, the participants present before concluding a public procurement contract according to Art. 67, para. 6 of the Public Procurement Act or upon request in the course of the procedure under Art. 67, para. 5 of the PPL:
1. Evidence of the existence of a valid professional liability insurance in accordance with Article 171 of the Territorial Units Act and Article 5, Paragraph 3, Item 3 and Paragraph 4, Item 3 of the Ordinance on Terms and Conditions of Obligationdesign and construction insurance or an equivalent document for foreign persons in accordance with the law of the country in which they are established, with coverage corresponding to the object of the contract deriving from a statutory instrument (the object of the contract is a third category of construction). a participant is unable to provide the documents requested by the assignor,he / she can prove his / her economic and financial status with any other document the contractor deems appropriate.
- Key Fire Safety Expert - to hold a higher education degree with a master's degree or equivalent in the case of was acquired abroad; specialty, on the basis of which qualification is acquired "fire and emergencysafety "or" fire safety and protection of the population "or an equivalent specialty; professional experience: at least 5 years experience in the specialty and specific experience: in the execution of a minimum of one service for exercising construction supervision or equivalent activity for foreign persons, - a Quality Control Specialist / Quality Manager - having a valid Certificate of Attention.completed training on quality control of building performance and on the compliance of construction products with the essential safety requirements or an equivalent document; professional experience: at least 5 years experience in the specialty and specific experience: experience in the performance of such a position / position of at least one construction supervision service or an equivalentactivity for non-residents, - Key expert "Safety and health coordinator" - to hold a certificate for "Safety and Health Expert" according to Ordinance № RD-07-2 from 16.12.2009 on the conditions and order for the conduct of periodic training and briefing of workers and employees on the rules for ensuring healthy and safe working conditions or an equivalent document;-professional experience: at least 5 years of experience in the specialty and specific experience: experience in the performance of such a position / position of at least one construction supervision service or equivalent activity for non-residents, - Key Expert "Real Cultural Heritage" holds a master's degree in the case of an acquisition abroad with a special degreein the field of conservation and restoration and 3 years of professional experience in this field and / or specialty "Architecture" with specialization in conservation and restoration in the field of real estate and 3 years of professional experience in this field or specialty "Architecture" and 5 years professional experience in conservation and restoration in the field of immovable cultural heritage and /or another specialty specializing in the relevant area of conservation and restoration or conservation conservation and restoration and having at least 5 years of professional experience in the same field or equivalent in the case of acquiring abroad; specific experience: experience in the performance of such a position / position of at least one construction supervision service or an equivalent-activity for non-residents.
